application. This sheet of the project plans repositions the floating docks in accordance with the conditions specified in
the forwarded correspondence from Todd Horton of the Corps. I am providing this PDF to expedite processing of the
federal comments required for this application.

Sector North Carolina Waterways Division has reviewed the revision made by
Moehring Group and deems the effect to the safety of navigation on Taylors
Creek to be minimal with the encroachment into the Setback. Although it is
not recommended to allow any encroachment into the Setback, we do not
anticipate any adverse effects to the navigable waters in the proximity of
the project areas and therefore we do not object to the approval by the
Department of the Army.

I have reviewed the secondary proposal you submitted. If the eastern floating
dock with fuel facility is located outside the channel setback, then you
would not be required to obtain any approval from the USACE Navigation
Branch, only from CAMA and USACE Regulatory office for your permits. We would
allow the western floating dock to cross into the channel setback as proposed
in your modified drawing, but the pilings must remain outside the channel
setback limit. The eastern end of the west floating dock should be placed
outside the setback limit, as shown in the proposed drawing, but the western
end of the west dock can be located within the setback, excluding the
pilings.
From a Navigation perspective, I would approve your modified plan, but please
contact Dave Timpy to determine if any additional information is required in
order to obtain a USACE Regulatory permit. If you have any additional
questions, please feel free to contact me.

Todd,
My company is providing planning and permit assistance to the Moehring Group
in conjunction with a proposed drystack storage marina to be built on
Taylors Creek in Beaufort. Dave Timpy shared your review comments on the CAMA
application for the proposed drystack. We understand that you have asked that
the floating docks proposed for use as boat staging areas be moved landward
of the channel setback line.
On behalf of the Moehring Group, we are asking that you consider a compromise
on the placement of the floating docks. Attached is a drawing prepared by
our clients showing the eastern dock (including the fuel platform) relocated
entirely out of the setback, with the extreme western end within the setback
as originally proposed. The pilings of the western dock would remain out of
the setback, as originally proposed.
(Keep in mind the attached drawing was prepared by the owners to illustrate
the proposed compromise dock placement. If acceptable, we will revise the
project plans.)
Normal low water depths at the relocated eastern dock appear sufficient for
use as boat staging areas. However, it appears that dredging will be required
to dock boats on the western end if the structure is moved out of the
setback. Please keep in mind that the docks are not proposed for use as
permanent boat slips, but will be used as boat staging areas. As such, boats
should only be docked for brief periods as they are removed and then
replaced in the drystack.
Our clients are also concerned that the adjacent project (Front Street
Village) was recently permitted with floating docks within the setback, and
existing multiple pilings at the neighboring site are also farther into the
setback than the proposed Moehring Group floating dock. As such, if the
proposed (attached) compromise is not acceptable, we are requesting
justification as to why placement of the Moehring Group floating docks
partially within the setback would be a problem.
Please let me know if you need additional information. We very much
appreciate your consideration.
