401 Water Quality Certification
Cherokee Mountain Club
DWQ Project # 11-0148
Jackson County
Response deadline: April 18, 2011
Dear Mr. and Mrs. Fortner
Dee Freeman
Secretary
The Division of Water Quality (DWQ) has performed a preliminary review of a 401 Water Quality Certification
application submitted for the above referenced property. Additional information will be required in order to
complete the review process.
Please provide the following information so that we may continue to review your project. Similar questions
were raised with your previous 401 WQC Application (previously applied for under the name Mac's Indian
Village). A copy of WQC No. 3821 is provided for your reference only.
Additional Information Requested:
Clarify Project Size and Plans. The property size is listed as 33.5 acres (B. Lc). The future
plans for the project indicate it will be phased (B.6.a.). If future plans for the project include
cabins and roadways, please provide the details and any other impacts to surface waters or
wetlands that may be required. DWQ is unsure why such a large access is necessary if not for
future development purposes.
2. Provide Greater Detail for the Proposed Impacts. It is not clear why 120 feet of impact is
necessary for a stream crossing for an 18 foot wide road. Please provide greater plan detail and
document why the creek cannot be accessed at a perpendicular angle; the constraints of the
adjacent properties are not clear from the information provided. If headwalls are necessary for
the culvert - this impact should be included and detailed. Culverts must be properly buried (ref.
Condition 13, of WQC 3821).

Stormwater Management Requirements. Part E.2.a. of the application lists 0%
imperviousness for the project. All proposed building footprints, roads, driveways, etc. need to
be accounted for in the percent imperviousness calculations. If the impervious area for the
project is greater than or equal to 24%, stormwater management must be provided (ref.
Condition 12, of WQC 3821).
Please provide your response in writing to the addresses below by April 18, 2011. Four copies of the required
information should be provided to the 401 Permitting Unit at:
Mr. Ian McMillan
401 Permitting Unit
1650 Mail Service Center

and a single copy to the Asheville Regional Office at:

If we do not hear from you by the deadline, we will assume that you no longer want to pursue this project and
we will consider the project withdrawn.
This letter only addresses the preliminary application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application are not
authorized (at this time) by the DWQ. Please call Ms. Wilson 828 (296)-4665, if you have any questions.
