This is in response to the NOV's that were sent for our farms 40-7, 40-141 and 40-146 40-95. This is the first time any of our
farms have had high freeboards. We were inspected on 11 /6/20 and Mrs Marlene was aware of our freeboard levels. After the
Rain event stopped (11 /13/20) 1 immediately filled out my POA and emailed them to Mrs. Marlene. I figured emailing my PDA
within 24 hours would be an acceptable way of notifying Mrs Marlene. When I spoke to Mrs Marlene on 11 /18/20 she made me
aware that she had not received the email. I had misspelled her last name. it was not my intention to not inform Mrs Marlene
of our freeboard levels.
The reason for our freeboards Farms 40-7 40-146 we had a temporary injunction placed on us and could not pump. We have
been to court and got this issue resolved. We have also picked up 85 more acres which will allow us to keep our lagoons
pumped down like we want. We have also purchased a new pivot to assist the towable pivot we have on the farm currently.
We have also purchased two new electric irrigation pump and a Aerway that will allow us to pump on days where the wind is
not working with us.
