Dear Mr. McMillan:
This letter is in response to the email from Lauren Witherspoon with DWQ, dated
February 10, 2011, regarding the placement of rip-rap within the disturbed areas of the
stream within the existing 40' sewer easement associated with sewer crossings of Marsh
Creek and the stream crossing adjacent to the railroad bridge.
On behalf of the City of Raleigh, we are requesting a revision to the DWQ 401-
certification for the 42" Crabtree Creek North Bank Sewer Emergency Replacement
project. The current request is for 67 if of permanent stream impacts, 68 if of
temporary stream impacts, 0.294 acres of temporary wetland impacts and 1,024 sq
ft of permanent buffer impacts to Zone 1 associated with the replacement of the 42"
Crabtree Creek North Bank Sewer.
Project History
Approximately 4500 if of the Crabtree Creek North Bank 42" sewer line was replaced.
The replacement of the 42" sewer line resulted in 125 If of temporary stream impacts and
0.294 acres of wetland impacts, which were authorized under a NWP 3 from the Corps
and a Water Quality Certification and Buffer Authorization from DWQ (DWQ Project
#07-1093, Ver. 2).
Proposed Permanent Impacts
During the replacement of the 42" sewer line, it was determined that rip-rap was needed
to stabilize the disturbed stream banks of the crossing of the UT to Crabtree Creek,
adjacent to the railroad bridge (Impact Exhibit 3) and the Marsh Creek stream crossing
(Impact Exhibit 6). The rip-rap was necessary to stabilize the disturbed stream banks, as
the flow rates within these streams were so high that the vertical stream banks would

erode and fail without stabilization. Lauren Witherspoon with your office has reviewed
these crossings and concurs that stabilization with rip-rap is necessary to prevent erosion.
Impact Exhibit 3
The proposed rip-rap within the stream bed of the UT to Crabtree Creek (Impact Exhibit
3) is the result of replacement of existing rip-rap that was installed when the 42" sewer
was originally constructed. Since the rip-rap within the stream bed was existing, the
replacement of the rip-rap within the stream bed was authorized under the original NWP
3 and DWQ 401 Water Quality Certification (DWQ Project #07-1093, Ver. 2).
Additional rip-rap will be placed on the stream banks at this crossing for stabilization.
Since no rip-rap will be placed within the stream bed, there will be no stream impacts.
However, Lauren Witherspoon determined that the placement of rip-rap on the stream
banks will result in permanent buffer impacts, and requested that the buffer impacts be
quantified and addressed in the Buffer Impact Table. Therefore, placement of rip-rap on
the stream banks at Impact Exhibit 3 will result in 462 sq ft of permanent buffer impacts
within Zone 1.
Impact Exhibit 6
The placement of rip-rap within the stream bed and banks of Marsh Creek are necessary
to stabilize the disturbed areas of the stream and will result in 45 if of permanent stream
impacts. Due to the vertical banks and high flow rate within Marsh Creek, the rip-rap is
necessary to stabilize the disturbed areas to prevent erosion and failure of the stream
banks. The placement of rip-rap on the stream banks will result in 742 sq ft of permanent
buffer impacts within Zone 1.
The Impact Tables within the PCN have been revised to reflect the placement of rip-rap
within the streams and buffer, as previously discussed. Copies of the PCN Impact Tables
have been provided as an Appendix. Revised Impact Exhibits 3 & 6 have also been
provided as an Appendix.
Mitigation
Since the proposed permanent stream impacts are less than 150 If, there is no proposed
stream mitigation.
Coordination with Corps of Engineers
Jamie Shern with the Corps of Engineers was contacted regarding the permanent stream
impacts associated with the use of rip-rap for stream stabilization. In an email dated

I understand that these drawings are modifications of, or in addition to, those activities required for the 4,000+
If of emergency sewer replacement that you notified me of last year. Let me know if I ever assigned you a job
number (USACE Action ID #) for the project. If not, I will need to assign the project a new number. All of the
impacts are covered by NWP 3. Please remember that the reestablishment of preconstruction contours is a
condition of NWP 3. So to the extent that class 2 riprap needs to be placed onto the bed of Marsh Creek, or
others, the riprap should match the elevation of the original stream bed. I think the intent of the condition is that
the riprap not be high enough that it could block the movement of aquatic critters during periods of low flow.

Attached are drawings of the two creek crossings we discussed for the emergency work that was recently
completed along Crabtree from Raleigh Boulevard down to Marsh Creek. The drawing titled Crabtree CK is an
overall to give you the general location. The 45 feet is the run of Marsh Creek where stone is need for scour
protection. The other crossing will only have stone where it had previously existed as a stream fording just below
the railroad bridge. What permit should be fall under for this work?
