See attached updated impact map that now shows a jack and bore with steel encasement pipe under the creek. All
proposed stream impacts have been removed from this exhibit so that only buffer impacts are being requested.

I wanted to check on the below request. We will need to provide this information to the Corps and formally request a
withdrawal of the application. In the meantime, the NCDWR was copied on the request from April. I have reached out

I talked with April Norton (Corps) today to let her know the new direction of the project. All we need to send her is
either a written description of the bore & jack construction method for the utility crossing, or an updated exhibit. We
will also need to request the withdrawal of the PCN application requesting use of NWP 29.
Jeremy if you can provide either the written description/exhibit, I will send that to her also requesting the withdrawal of
the application.

I received the below request from April Norton with the USACE this morning. Options I can think of would be: a) avoid
the stream impacts by utilizing bore & Jack or directional drill construction methods thereby avoiding the need for a 404
verification and therefore no need for her to make an ESA determination. Going this route would not allow any impacts
to streams throughout the site; or 2) have S&EC conduct the field work and prepare a T&E report to send to April so
that she can make an affect determination. Additionally, she is asking for us to provide details to include the type of
percussive activity, purpose, duration, and specific location where any blasting/percussive activities will take place.
One other option would be to check with M/I Homes to see if any due diligence was done on the front end and possibly
they have a Threatened & Endangered Species report.

Hi Debbie —
I have reviewed your application for Sykes Property in Durham, Durham County, North Carolina (SAW-2019-01698). I
understand that there are 31 linear feet of temporary impacts proposed; however I will need additional information
regarding endangered species.
An affect determination was not included with your application. For me to make an ESA affect determination I will
require additional information, as mentioned above. Your application states that blasting and/or other percussive
activities will be conducted by machines, such as jackhammers, mechanized pile drivers, etc. Your application does not
provide details that include the type of percussive activity, purpose, duration, and specific location (please review your
PCN, item number 5i).
Please provide the above requested information for your application to be considered complete.
