Dear Mr. Waller:
On February 8, 2011, Amy Euliss, Division of Water Quality (Division) regional staff conducted a site
visit following the discovery by Flat Iron-Lane Joint Ventures and NCDOT staff, of sediment in
jurisdictional wetlands on the I-85 Yadkin River Bridge Project in Davidson and Rowan Counties. The
site visit was in conjunction with yourself, Mrs. Stephanie Braquet, Division Environmental Specialist,
NCDOT Division 9, Phil Suggs, Roadside Environmental, and other NCDOT and contractor staff.
During the site visit, it was noted that a sediment loss had occurred as a result of a series of two failed
basins, including a skimmer failure on one basin which led to a dam failure on the second basin.
However, the extent of the sediment loss was unable to be determined, because the bulk of the material
had been removed from the jurisdictional wetland. The fill of a jurisdictional wetland without
authorization is a violation of Title 15A NCAC 2B .0231(a) and (b) (1) and (5).
Upon discovery, NCDOT quickly contacted the Division to report the sediment. Prior to
recommendation from the Division, NCDOT and Flat Iron-Lane removed the sediment from the wetland.
During the aforementioned site visit, Amy Euliss determined that no additional restoration work was
required. Please be advised that the Division of Water Quality shall be contacted to direct all future
sediment removals, as detailed in the "NPDES Permit No. NCGO10000 Construction Stormwater
Guidance Frequently Asked Questions", which is accessible at

NCDOT and Flat Iron-Lane Joint Ventures are at this time in compliance with their NPDES permit.
NPDES inspection records are up to date and thorough, and the Division was notified within 24 hours of
the loss (not counting Sunday). The Division would like to commend both NCDOT Division 9 and Flat
Iron-Lane Joint Ventures for their prompt response to this matter. The Division appreciates the time
NCDOT staff spent discussing the site, and the immediate response taken by NCDOT and the contractor.
