Sullins Dee Freeman Governor Director Secretary March 8, 2011 DWQ Project # 10-0647 Wake County Arthur and Janet Begun 104 Aberson Court Cary, NC 27519 Subject Property: 104 Aberson Court UT to Crabtree Creek [030402, 27-33-(10), C, NSW] STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. and Mrs. Begun: On September 23, 2010, the Division of Water Quality (DWQ) issued a Neuse Riparian Buffer Protection Rules Minor Variance to impact approximately 242 square feet of Zone 2 of the protected buffers to construct a sunroom on the above named property. Condition Number 4 of the minor variance requires that you submit a final, written stormwater management plan to the DWQ, which must be approved in writing before the impacts specified in the variance may occur. On January 12, 2011, the DWQ received a stormwater management plan (dated January 11, 2011) from your consultant, Mr. Andrew Rodak, P.E. of Duncklee & Dunham. On March 7, 2011, the DWQ received revisions to the stormwater management plan (dated March 7, 2011) from Mr. Rodak. The DWQ approves the SMP and subsequent revisions to satisfy the stormwater condition required in your Neuse Riparian Buffer Protection Rules Minor Variance. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. This approval requires you to follow the conditions listed in the General Water Quality Certification (GC 3821) for the project and the following additional conditions listed below. The SMP approved by this office consists of a bioretention cell as and all associated stormwater conveyances, inlet and outlet structures, vegetated shelf planting plan, the grading and drainage patterns depicted on plan sheets, and the O&M agreement dated August 4, 2010. The approved SMP must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the Division of Water Quality. The stormwater management structures shall have maintenance access and drainage easement to allow for the ability to maintain the structures and to perform corrective actions. Wetlands. Operation and Maintenance of BMP: Maintenance activities for the proposed wet detention basin shall be performed in accordance with the notarized wet detention basin O&M agreement signed by Mr. Arthur Daniel Begun on August 4, 2010. The O & M agreement must transfer with the sale of the land or transfer of ownership/responsibility for the BMP facility. DWQ must be notified promptly of every transfer. 3. Notification of Construction: The applicant and/or authorized agent shall contact the DWQ Express Review Program in writing at the letterhead address within ten (10) days of the commencement of construction.
