This office has reviewed the subject erosion and sedimentation control plan. 'We find the plan to be
acceptable with modifications and hereby issue this letter of Approval with Modifications. The
Modifications Required for Approval are listed on the attached page. This plan approval shall expire three
(3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required
by Title 15A NCAC 413 .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an electronic Notice
of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction
General Permit. After the form is reviewed and found to be complete, you will receive a link with payment
instructions for the $100 annual permit fee. After the fee is received, you will receive the COC via email.
You MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form may
be accessed at deq.nc.gov/NCG01. Please direct questions about the eN01 form to Annette Lucas at
Annette.lucas@ncdenr.gov or Paul Clark at Paut,clark@ncdenr.gov. If the owner/operator of this project
changes in the future, the new responsible party is required to apply for his/her own COC.
Title 15A NCAC 413 .0118(a) and the NCG01 permit require that the following documentation be kept on
file at the job site:
1. The approved E&SC plan as well as any approved deviation.

2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 12 months.
Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to insure
compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Program is performance -oriented, requiring protection of
existing natural resources and adjoining properties. If, following the commencement of this project, it is
determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-S 1 through 66), this
office may require revisions to the plan and implementation of the revisions to ensure compliance with the
Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water
quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to
this land -disturbing activity. This approval does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the Financial
Responsibility Form, which you provided. This permit allows for a land -disturbance, as called for on the
application plan, not to exceed the approved acres. Exceeding the acreage will be a violation of this permit
and would require a revised plan and additional application fee. You are requested to file an amended form
if there is any change in the information included on the form. In addition, it would be helpful if you notify
this office of the proposed starting date for this project. Please notify us if you plan to have a preconstruction
conference.

MODIFICATIONS REQUIRED FOR APPROVAL .

1. The new NCGOI Construction stormwater permit requires Ground Stabilization and
Materials Handling and Self -Inspection, Recordkeeping and Reporting requirements
on your plans. The NCG01 compliance plan sheets for these can be found at

2. If contiguous lots are graded such that one acre or more is disturbed, individual lot
controls will be insufficient, and surface dewatering is required in order to maintain
compliance with the NPDES general construction permit. This site is limited. to
individual lot disturbance. If contiguous lot grading for lots totaling 1 acre or more is
to take place, an approved plan is required before grading takes place, with specific
locations for surface dewatering, specifications and calculations for surface dewatering.

3. Any off -site borrow and waste required for this project must come from a site with an
approved erosion control plan, a site regulated under the Mining Act of 1971, or a
landfill regulated by the Division of Solid Waste Management. Trash/debris from
demolition activities or generated by any activities on site must be disposed of at a
facility. regulated by the Division of Solid Waste Management or per Division of Solid
Waste Management or Division of Water Resources rules and regulations. [15A

4. The site, or portions of the site as applicable, are required to be stabilized after any
period of inactivity. Slopes steeper than 3:1, perimeter dikes, swales, and ditches must
be stabilized within 7 days. All other areas must be stabilized within 14 days. [N,C,G.S.
143-215.1]
5. Silt fence may not be placed such that portions of the lot are exposed to erosion. [I5A
NCAC 4B .0105]
6. All access to the lots must be through the construction entrances. Construction
entrances must be in place prior to lot disturbance. [15A NCAC 4B .0105]
7. All inlets collecting drainage or that might potentially be affected by the lot
construction shall have inlet protection. Inlet protection must be maintained until all
areas draining to the inlet are fully stabilized, [15A NCAC 4B .0105]
8. All measures, including stone drive, will be inspected after rain and at least weekly for
adequacy and needed maintenance. [N.C.G.S. 143-215.1]

9. All disturbed areas not built upon will be provided with permanent groundcover.

10. Effective October 1, 2010, persons responsible for land disturbing activities must
inspect the sediment and erosion control measures on a project after each phase of the
project to make sure that the approved erosion and sedimentation control plan is being
followed. Self -inspection reports are required. A sample self -inspection report, as
well as details of the self -inspection program, can be found on the Land Quality web
site:

Not every project will have all the possible phases, but a list of phases may include;
• Installation of perimeter erosion and sediment control measures.
• Clearing and grubbing of existing ground cover,
• Completion of any phase of grading that requires provision of stabilization.
• Installation of measures during any phase of the project.
• Completion of construction or development.
• Quarterly inspections until the establishment of permanent ground cover
is fully
established.
Please note these inspection requirements are in addition to NPDES inspection
