Duncklee & Dunham, P.C. (Duncklee & Dunham), on behalf of our client Arthur Begun, submits this
response letter to address a request for additional information with regards to a Stormwater Management
Plan supporting a Minor Variance Request for the subject property in Cary, Wake County, North
Carolina. The request for additional information was submitted to Mr. Begun in a letter dated
February 21, 2011. For clarification purposes, a description of the attached information addressing each
of the requested informational items is provided after the noted item requested.
Please provide a minimum of two underdrain pipes in parallel.
Based on the underdrain pipe calculations that were submitted with the Stormwater Management Plan, a
minimum diameter of 2.5 inches is required for the underdrain piping to sufficiently drain the entire
surface area of the bioretention cell; therefore, a four-inch diameter pipe was proposed in the design.
However, based on our phone conversation of February 25, 2011, you requested redundancy in the design
in the event one pipe became clogged and could not function as designed. Therefore, and additional four-
inch pipe installed in parallel has been added to the design. The pipes will be joined in a tee-header pipe
that will drain through one pipe into the outlet structure.
2. Please re-design the forebay so that is not a lower elevation than the main treatment area of the
bioretention cell. This is likely to cause short-circuiting.
The top elevation of the bioretention cell has been raised 18 inches to allow for the minimum required
depth for the forebay and to maintain a bottom elevation equal to the surface elevation within the cell.
This requires the grass filter surrounding the cell to be 4.5 feet in width to maintain the required 3:1 slope.

The soils report provided does not document the actual elevation in feet per mean sea level of the
seasonal high water table. Please ask the soil scientist to provide this information. Also, please
insure that the proposed design complies with the BMP Manual's requirements regarding the
seasonal high water table.
I calculated the seasonal high ground water table elevation using surface topographic data from the Town
of Cary and the depth to the seasonal high ground water table in the native soil as provided by the Soil
Scientist. As indicated in the Soil Scientist report, the footprint of the bioretention area will be in an area
of fill that, based on soil type, has created an artificially high seasonal ground water table due to the
"sponge effect' of the fill. As per our phone conversation on February 25, you indicated that more clarity
is required in discussing what seasonal high water depth is applicable to the design criteria.
Since the bioretention cell will be essentially replacing the fill material (similar footprint and depth), the
underlying native soil seasonal high water table is used as design criteria for the bioretention cell. The
depth to the native seasonal high water table can also be verified by observing the stream on the
southwest corner of the property, within which the stream bed elevation is approximately five foot below
the surface elevation at the top of the fill. The attached e-mail from the Soil Scientist re-iterates the
distinction between the seasonal high water table depths listed in his report.
4. In order to use and Internal Water Storage Zone (IWS), the media depth above the gravel layer
must be at least three feet-the depth specified in the current design is inadequate. Piedmont
installations of IWS also run the risk of collecting stagnated water if the soils do not have enough
permeability to drain between storms. The DWQ recommends using a traditional grassed
bioretention cell design at this location. If you decide to pursue an IWS design, then please
provide the appropriate media depth.
The intent of the IWS design was to provide additional nutrient removal within the bioretention cell in
consideration of the impact to the riparian buffer. However, given the small size of the bioretention area
and relatively shallow depth of the seasonal high water table that would prohibit increasing the depth of
fill above the IWS, the IWS has been removed from the design, per your recommendation.
Please provide specifications for the following:
a. The precise species of sod that will be used
b. Sod installation
c. The procedure for establishing the sod on the bioretention cell, including watering and a
one-time fertilizer application.
The sod originally specified for the bioretention design was a blend of Kentucky Bluegrass and tall
fescue. However, Mr. Begun has requested that Zoysiagrass be considered as a groundcover for the cell.
After consultation with Dr. Dan Bowman of North Carolina State University's Department of Crop
Science, it was determined that Zoysiagrass would be a suitable groundcover for the cell, as long as
adequate sun exposure was provided. The property currently has zoysia grass in the front (north side) of
the lot, and except where it is shaded by the existing house, it does well. The area where the bioretention
area will be constructed is comparable in sunlight exposure to the portion of the lawn with zoysia grass in
the front. Mr. Bowman recommended two types of zoysia grass for consideration: Zenith and Companion
Compadre. An alternate sod specification for hybrid bermudagrass is provided for the bioretention area;
the property owner has agreed to replace the zoysia sod with this if it does not survive.

The subsurface media will be cultivated to a depth of 6-8 inches prior to sod installation. A one time
application of a slow-release nitrogen fertilizer (shall be applied at a rate of 3-3.5 lbs. per 1,000 square
feet of surface area. Additionally lime will be added to the soil for pH adjustment as needed. The sod
shall be placed in 16" x 24"strips in a staggered pattern, with no overlapping. There is no need to anchor
the sod to the soil or apply mulch on the sod. The sod should be watered at a rate of 1 to 1 '/2 inches at a
frequency of 2-3 times per day during the first four weeks after installation (a special permit may be
required if water-use restrictions are in effect). Following the first month, the sod should be watered at a
rate of 1 inch weekly as needed during dry periods; less often during periods of frequent rainfall.
The sod should be maintained at a height of 2-2 1/2 inches using a sharp mower blade. No other sod
maintenance is required except the repair/replacement of bare patches as needed. The sod specifications
are provided on attached Figures 3 and 4.

To clarify the depth to the seasonal high water table elevation on the referenced property; because of the placement
of fill during the construction of the existing residential structure a temporary, perched water table exists at 24-
inches below land surface. The depth to the true seasonal high water table is greater than 60-inches below grade or at
approximately 350-feet msl.
