Attached please find a minor modification request from Mr. Steven Jones of Bogue Shores. The applicants' currently
have a valid CAMA permit to excavate a 40' x 40' area within some of their boat slips. However, their dredge contractor
has informed them that due to shoaling adjacent to the dock, an additional area (30' x 60') needs to be excavated to
allow for ingress and egress from the dock. The applicant is very anxious to get this done before the moratorium kicks
in. Therefore, DCM promised that we would ask all agencies to review this request as quickly as possible and provide us
any comments that you may have. Therefore, if you could let me know your thoughts on this as soon as possible, I
would appreciate it.

RE: Modification of State Permit #189-05, Bogue Shores, 1300 W. Fort Macon Rd, Atlantic
Beach, Carteret County
Please find enclosed a request from Mr. Steven Jones to modify the CAMA permit issued to
Bogue Shores. The original permit, 4189-05, was issued on 12/21/05 and is set to expire on
12/31/12. The permit authorized excavation of a 40' x 40' area within slips 8-10.
The applicant is proposing new excavation in a 30' x 60' area directly west of the previously
permitted area. The water depths within this area are an average of -1.5' nlw. A total of 167
cubic yards would be removed to a final depth of =4' nlw. Per the applicant, due to the shallow
water depths this is necessary for access to slips 8-10. The proposal is consistent with the
specific guidelines found in 15A NCAC 07H.0208. A check in the amount of $100.00 is
included with the request. I recommend the modification be authorized as proposed, contingent
all original conditions apply as well as the following specific conditions:
• The excavation shall remain within the proposed area as shown on plats dated
received 2/16/11 and not exceed a final depth of -4' nlw.

The original application requesting permission to excavate an area of 40ft x 40ft.
Since the application was requested the access to the 40ft x 40ft area has become
impassible due to shallow depths of water. At this time I have a dredging contractor
onsite for today and tomorrow, I would like to request an additional area to be excavate
so we can gain access to the original area that we are excavating. With these being small
areas the biggest cost is mobilization, so I am asking if we can get permission to process
with the additional area today which is February 16, 2011.
