NC 28801-2714 Subject: Nationwide 14 Permit Application SR-1501, Red Marble Road Intersection Realignment Cherokee County State Project No. 14C.020031 (DWQ Minor Permit Fee $240) Dear Ms Beckwith: The North Carolina Department of Transportation (NCDOT) is proposing to realign SR 1501, Red Marble Road, in Cherokee County. This proposal entails reconstruction of the intersection with US 19/74/129 to increase sight distance, which is a necessary safety improvement. Funds have been allocated for this project, and NCDOT would like to perform these activities in the 2011 paving season. I am enclosing a pipe installation detail, photographs, a marked county map and USGS topographic map. We propose to extend one culvert. The culvert will be installed slightly below the existing streambed elevations where bedrock is not encountered to minimize impacts to aquatic habitats and allow the existing stream gradients to remain as unchanged as physically possible. The streams at the site are not consistent with the USGS topographic map, which shows Totherrow Branch flowing into Turnpike Creek northwest of the intersection of SR 1501 and SR 1608, Stover Road. Totherrow Branch flows more or less parallel with SR 1501 to the northeast and flows under US 19/74/129 to the Valley River. Turnpike Creek flows southwest of existing SR 1501. The new road alignment will be placed between the existing SR 1501 and Turnpike Creek. SR 1501, Red Marble Road 2 February 18, 2011 The North Carolina Natural Heritage Database was checked for records of federally threatened and endangered species. There are no records listed in the database for Turnpike Creek. Additionally, there are no records for the adjacent watersheds, Harris Creek and Bent Creek. There are no records within the Valley River for greater than three miles downstream of the confluence of Turnpike Creek. The project will require the extension of one pipe for realignment of the road to improve the intersection. There will be some impact to the trout buffer along one section of the new alignment. Overall the project is limited in scope and impacts should be minimal. For these reasons, we believe this project will have "no effect" on threatened or endangered species. Impacts to historic or cultural resources are not anticipated. The project has been submitted to the NCDOT Human Environment Unit for cultural resources review. If the State Historic Preservation Office (SHPO) and the Office of State Archaeology determines that further investigations are required, NCDOT will conduct the appropriate site investigations and obtain compliance from SHPO prior to project construction. The best management practices will be used to minimize and control sedimentation and erosion at this site. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion is being controlled effectively. If the planned devices are not functioning as intended, they will be replaced immediately with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe culvert construction and will remain in place until the project is stabilized. Impacts to Waters of the United States Turnpike creek (DWQ Class C; Tr.) has a well-defined channel and is shown on the topographic map as a perennial stream. The channel substrate of the stream is composed primarily of gravel, sand and silt. Turnpike Creek flows into Valley River approximately 1000 feet downstream. The Valley River meets the definition of a Traditional Navigable Water approximately six miles downstream of the confluence with Turnpike Creek. For these reasons, we believe that Turnpike Creek is a Relatively Permanent Water and is under the jurisdiction of the U.S. Army Corps of Engineers. In order to make the needed safety improvements to SR 1501, it will be necessary to impact waters of the United States in the Hiwassee River Basin. Specifically, NCDOT is requesting to extend one culvert in Turnpike Creek. The road footprint will be cleared, filled and the new road paved. Only the shoulder area will be widened at the permit site to provide a proper alignment with the road section that is relocated.
