Mumford NNP - Briar Chapel, LLC 16 Windy Knoll Circle Chapel Hill, North Carolina 27516 Dear Mr. Mumford: February 16, 2011 X5_0132 Utz{ 1,t)z? l D FED 1 8 2011 Reference the Department of the Army (DA) permit issued on October 2, 2006, to Mitch Barron of Newland Communities for impacts associated with the Briar Chapel Development. Also reference the modifications to this permit approved in December, 2007 and August, 2009. This development is approximately 1,589 acres in size and is located west of US Highwayl 5-50 1, north of Andrew's Store Road (SR 1528), and south of Mann's Chapel Road (SR 1532), approximately 5 miles south of Chapel Hill, in Chatham County, North Carolina. Coordinates (in decimal degrees) for the site are 35.8251 'North, 79.1059 ° West. The site contains several unnamed tributaries and adjacent wetlands of Pokeberry Creek and Wilkinson Creek, in the Cape Fear River Basin (8-Digit Cataloging Unit 03030002). Permanent impacts authorized by this permit and the subsequent modifications totaled 2,237 linear feet of stream channel and 0.4374 acre of wetland, and temporary impacts totaled 634 linear feet of stream channel and 0.197 acre of wetlands. Mitigation was implemented for the unavoidable impacts by payment into the North Carolina Ecosystem Enhancement Program, restoration of stream channel at the Harpers Crossroads Mitigation Site, and on-site preservation of wetlands and streams. Also reference your permit modification request received by the Corps by emails dated February 8, 9 and 14, 2011. This modification request involves reducing impact amounts at the location identified within the 2009 modification as Impact U, which had a permitted impact amount of 233 linear feet of permanent stream channel, 21 linear feet of temporary stream channel, and 0.009-acre of permanent wetland impact. These impacts were due to the culverted crossing of Andrews Store Road and a nearby side road. The proposed modification would reduce these impacts by allowing Andrews Store Road to remain as a culverted crossing but utilize a bridge on the nearby side road, therefore -2- reducing permanent impacts to the stream. In addition, a temporary impact is proposed to allow for the installation of 3 utility lines. Impact U is now proposed for a total of 173 of permanent stream channel impacts, 0.009 of permanent wetland impacts, and 31 linear feet of temporary stream channel impacts. The Corps has completed the evaluation of your request and concurs with your request for a change in impacts associated with your referenced DA permit including the change to plans as requested. The approved plans for this crossing are attached for your file. No additional mitigation is required for this modification. Please note that all other permit conditions and exhibits remain in effect as written.
