Surrounding land use is comprised of primarily industrial and commercial retail space. 3b. List the total estimated acreage of all existing wetlands on the property: 0.11 3c. Ms. Deborah Edwards (formerly with NC DWQ) determined that a buffered feature was not present in the central and northern portion of the site but became subject to the Neuse River Buffer Rules at a location off site (see attached NBRRO 04-033) in the ditch the Corps considered jurisdictional. 3d. Explain the purpose of the proposed project: The purpose of the proposed project is to construct apartment complex with the necessary infrastructure including access and parking. 3e. Describe the overall project in detail, including the type of equipment to be used: The subject site is bordered on the south by a jurisdictional ditch and is completely bisected by existing jurisdictional linear wetlands, a wetland pocket and an unimportant jurisdictional channel. The applicant requires the proposed impacts in order to construct the apartment complex and necessary infrastructure including access and parking. The parking pads and drive configurations are done such that fire access is provided around all buildings to get the proper fire protection coverage and access. Handicap accessibility is also a factor in the design of the subject site. Parking requirements are set forth by the City based upon the number and type of units. Finally, two (2) points of access from the roadway are required for entrance/egress and the only feasible locations for those driveways exist along Miami Boulevard. Creating an entrance from Hopson Road would have created additional impact to the jurisdictional ditch that runs in an east-west direction along the southern property line as well as causing parallel Riparian Buffer impact for the feature that runs in a north-south direction along the adjacent property lines. The railroad right-of-way to the west eliminates points of access to the site from that direction. Equipment typical to residential construction will be utilized including excavators, track-hoes, bulldozers and the like. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order to determine the extent and location of streams and wetlands on the property. The proposed impacts are necessary in order to complete the Creekstone Development. The jurisdictional wetland bisects the subject property on a North-South axis. The only way to create a viable site plan that was both economically feasible and consistent with the zoning requirements for the site necessitates the proposed fill. The parking pads and drive configurations are done such that fire access is provided around all buildings to get the proper fire protection coverage and access. Handicap accessibility is also a factor in the design of the subject site. Parking requirements are set forth by the City based upon the number and type of units. Two (2) points of access from the roadway are also required for entrance/egress and the only feasible locations for those driveways exist along Miami Boulevard. Creating an entrance point from Hopson Road would have caused parallel Riparian Buffer impact due to the presence of a buffered jurisdictional ditch that runs in a north-south direction between the property lines as well as creating additional impact to the un-buffered jurisdictional ditch that runs in an east-west direction along the southern property line. The railroad right-of-way to the west eliminates points of access to the site from that direction. Further, due to the weak presence of hydric soils in most of the jurisdictional areas (note the break in jurisdiction), the weak hydrology which is driven by runoff from Miami Boulevard, it is unlikely wetlands existed onsite prior to the existence of the road. The wetlands are of low quality and the required stormwater devices will likely improve downstream water quality over what currently leaves the property. The applicant is also aware of the regional conditions associated with the Nationwide Permits 29. With respect to residential development conditions (Regional Conditions section 4.9) the applicant does not anticipate any impacts to streams and wetlands associated with single family recreation facilities as there are none proposed, there are no 100 year floodplain limits identified on this project and therefore, there are no permanent wetland or stream fills proposed within the floodway and the stream classification for this project is C; Nutrient Sensitive Waters (NSW) (i.e. not Outstanding Resource Waters or High Quality Waters). Please note that there is a minimal amount of linear wetland impact (0.033 ac) associated with the necessary stormwater device (a constructed stormwater wetland), however, as stated above, it is our belief that this device will likely greatly improve downstream water quality over what currently leaves the subject property. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Orange protective silt fencing will be placed outside of the impacted wetland corridor to ensure protection of the non- impacted wetland and jurisdictional ditch at the southern property boundary. The draft states that most small scale residential developments are unlikely to cause cumulative impacts. This project does not meet any of the three criteria of private projects that can clearly result in cumulative impacts. The proposed apartment complex is relatively small in nature, is within a commercially developed landscape bounded by existing commercial and office space properties and therefore, the utility infrastructure (i.e. water and electricity) are already in place to service the proposed development.
