The following is provided in response to the Request for More Information dated
December 28, 2011.
Items (4) and (9) of the NOV Requested Response Items have not been
satisfactorily addressed. The as-built plan sheets must be full-sized (and at a
scale of 1" = 20' or larger) with 1' topographical lines, the stormwater drainage
system, building footprints and road footprints, and all other relevant details for
the DWQ's review. Please provide a completely filled out Level Spreader
Supplemental Form with ALL required items. (For example, no dimensions for
the Level Spreader #4 by-pass were provided.) This form is available at:
http://portal.ncdenr.or /web/wq/ws/su/bmn-manual. In addition, complete
documentation for the buffer authorization has not been provided. Please
provide.
- The as-built plan sheets have been changed to be full-sized and at a scale of
1 " = 20' or larger. We also gathered additional survey of the as-built
conditions in order to provide additional detail regarding the current site
conditions.
- Level Spreader Supplemental Forms have been provided with all required
items. Please note the level spreaders have been constructed. Additionally,
they were designed using previous design guidance. Also, Operation and
Maintenance Agreements will be provided for all four level spreaders and
associated buffer strips. Theses will be signed by Wal-Mart who will be
responsible for the maintenance of all four level spreaders and associated
buffer strips.
- As we discussed in the meeting on January 3, 2011, we are unable to
provide the documentation for the impacts to the buffer below Level
Spreader 4 because no such Authorization was ever granted by the
Division. The clearing of the buffer, although inadvertent, was never
approved. As such, we are proposing re-establishment of the buffer by
planting 2-inch caliper trees as indicated in the November 15, 2010
submittal.
- Additionally, during the meeting on January 3, 2011, you requested that the
bypass from Level Spreader 4 and the outlet from Pond E/Sediment Basin 7
be piped beneath the riparian buffer/filter strip. The attached plans provide
a design to pipe the bypass from Level Spreader 4; however, the means of
piping or otherwise addressing the outlet from Pond E/Sediment Basin 7 is

still being determined. Once decision has been made and a design
developed, it will be submitted. However, it was determined that it would be
preferable to submit the remainder of the information for your review and
approval in order to reach our committed deadline and because it is
important to begin re-construction of Wetland A as soon as practicable.

to include details, when needed, for figures.
- The as-built plan sheets have been changed to be full-sized and at a scale of

review. Please provide a completely filled out Stormwater Wetland
Supplemental Form with ALL required items. (the form that was provided is
incomplete and does not include the Required Items Checklist) This form is
available at: http://portal.ncdenr.org/web/wq/ws/su/bmp-manual. The DWQ
assumes that you are extending the outlet pipe of Wetland A as shown on the
plan. Please verify. Confirm that the drain valve in the riser structure of
Wetland A will be operational as designed and provide a timeframe.
- The original construction drawings have been provided since it has been
agreed that Wetland A shall be re-constructed per the original (approved)
plan set and planting plan. These plans are full sized, but the scale is
1 "=40'. It is assumed that the original plans are sufficient in this instance.
- Stormwater Wetland Supplemental Forms have been provided with all
required items. Please note that the original design was a hybrid of the
current Division design standards that existed at the time and the City of
Durham (and draft Division) guidance that was available at the time. As
such, some of the design parameters do not meet current design guidance.
- During reconstruction the drain valve will be made operational which is
scheduled to be completed by the end of April.
4. Item (3) of the NOV Requested Response Items have not been satisfactorily
addressed. The proposal states "that a notch be provided in the bed rock in order
to lower the stream invert..." Please demonstrate and provide a scaled profile of
the stream (at Crossing #1) and show how water will flow through the culvert
during the 10 and 25 year storm events based on full build-out conditions
(completion of Phases 2 and 3). Provide headwater and tailwater conditions for
these storms as well.
- A scaled profile of the stream at Crossing #1 has been provided, which
includes a comparison of water surface elevations with and without the
notch for the 10 and 25 year storm events, assuming built-out conditions.
We have also provided the modeling results in the Appendix for your
review.
5. Please describe how the notch will be installed in the bed rock. The proposal
states, "The current accumulation of sediment within the culvert will be
removed and properly disposed of prior to notching the bedrock and only natural
sediment bed loads will subsequently pass through." Please add that the
"current accumulation of sediment and debris on the upstream end of the culvert
will be removed and properly disposed of prior to notching the bedrock." To the
monitoring, add "depth and extent of sediment deposition, if any."
- The plan to excavate the notch is as follows:
1) The current accumulation of sediment and debris on the upstream end,
within, and immediately below the culvert will be removed and
properly disposed of prior to notching the bedrock.
2) A special stilling basin (commonly known as a dirt bag) will be
provided with an impervious dike to trap the water to be pumped to the
special stilling basin. The dike will be established immediately below
the end of the bedrock outcrop.
3) A track hoe will be used to excavate or hammer a notch as shown in the
attached plan sheets. All work will be performed from the north side of
the stream to minimize damage to the buffer.
4) The debris will be mechanically removed by the track hoe or removed
by hand and properly disposed.
5) Once the notch has been satisfactorily constructed, any impacted
stream banks will be re-established to preconstruction conditions and
the construction access points will be ripped or disked and planted with
appropriate permanent vegetation considering the power line
easement.
6) Monitoring of the site will be for three years. Monitoring will occur
once per quarter for the first year and yearly for the next two years.
The monitoring will include taking photos from the same vantage
points, upstream, downstream, and at the culvert. Additionally, a brief
memo to will be submitted to the Division once per monitoring
occurrence, documenting the results.

WETLAND A -OPERATION AND MAINTENANCE AGREEMENT
The we#land system is defined as the marsh areas and pretreatment including forebays and
mirco~pool.
Maintenance activities shall be performed as follows:
1. After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wetland system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and genera! condition.
b. Check and clear the orifice of any obsVuctions such that drawdown of the temporary
pool occurs within 2 to 5 days as designed.
2. Repair eroded areas immediately, re-seed as necessary to malntaln good vegetative cover,
mow vegetative cover to maintain a maximum height of six inches, and remove trash as
needed.
3. Inspect and repair the discharge pipe from the basin annually to maintain proper
functioning.
4. Remove accumulated sediment from the wetland system when the depth is reduced to
75% of the original design depth {see diagram below). Removed sediment shall be
disposed of in an appropriate manner and shall be handled in a manner that will not
adversely impact water quality {i.e. stockpiling near a wetland or stream, etc. ~.
The measuring device used to determine the sediment elevation shall be such that it will
give an accurate depth reading and not readily penetrate into accumulated sediments.
If the elevation of the marsh areas exceed the permanent pool elevation, the sediment
should be removed to design levels. This shall be performed by removing the upper t3
inches of sail and stockpiling it. Then the marsh area shall be excavated six inches below
design elevations. Afterwards the stockpiled soil should be spread over the marsh surface.
The soil should not be stockpiled for more than two weeks.
When the permanent pool depth reads 351.75 feet in the forebay and micro-pool, the
sediment shall be removed.

5. Wetland planting densities in the marsh areas should be maintained by replanting bare
areas as needed. Wetland plants should be encouraged to grow in the marsh areas.
6. If the wetland must be drained for an emergency or to perform maintenance, the flushing of
sediment through the emergency drain shall be minimized to the maximum extent practical.
7. All components of the wetland system shall be maintained in good working order.
$. Level spreaders or other structures that provide diffuse flow shall be inspected annually. All
accumulated sediment and debris shall be removed from the structure, and a level
elevation shall be maintained across the entire flaw spreading structure. Any down
gradient erosion must be repaired and/or replanted as necessary.

- I will keep a maintenance record on this BMP. This maintenance record will be kept in a
- log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
- of structures, safety of the public, and the removal efficiency of the BMP.
Important maintenance procedures:
-~ Immediately after the filter strip is established, any newly planted vegetation
- will be watered twice weekly if needed until the plants become established
(commonly six weeks).
-~ Once a year, the filter strip will be reseeded to maintain a dense growth of
- vegetation
~ - Stable groundcover will be maintained in the drainage area to reduce the
sediment load to the vegetation.
- Two to three times a year, grass filter strips will be mowed and the clippings
- harvested to promote the growth of thick vegetation with optimum pollutant
removal efficiency. Turf grass should not be cut shorter than 3 to 5 inches and
may be allowed to grow as tall as 12 inches depending on aesthetic requirements
- (NIPC,1993). Forested filter strips do not require this type of maintenance.
Once a year, the soil will be aerated if necessary.
- Once a year, soil pH will be tested and lime will be added if necessary.
- After the filter strip is established, it will be inspected quarterly and within 24 hours
after every storm event greater than 1.0 inch (or 1.5 inches if in a Coastal County).
Records of operation and maintenance will be kept in a known set location and will be
- available upon request.
