WITHERS &7 R"ENEL ENGINEERS I PLANNERS I SURVEYORS February 15, 2011 Ms Amy Chapman NCDENR Division of Water Quality 401 Permitting Unit 1650 Mail Service Center Raleigh, NC 27699-1650 Dear Ms. Chapman Withers & Ravenel, on behalf of Four Star Ventures LLC, is requesting a modification to a buffer impact authorization received on September 30, 2010 (DWQ Project# 2004-1145v2). We are requesting that a portion of the approved impact area be exempt from the 8' minimum deck height requirement shown on the previously approved plans. The existing soil in a portion of the impacted buffer area shall remain intact to maintain structural stability of the existing staircase footing and supporting wall. This ground in this area shall be re-vegetated after construction in accordance with the approved buffer authorization; however the deck height in this area may be less than 8'. The area in question is shown in red on the attached exhibit. All other portions of the impacted buffer area will have at least 8' deck height, as required by Division policy and Buffer Interpretation/Clarification #2007-002. There are no other modifications being requested at this time. Construction of the previously authorized impacts will be in accordance with all previously issued conditions of certification, and there is no increase in the net buffer area impacted.
