PROJECT DESCRIPTION: The project site is approximately 3,000' to the north of the existing municipal docks (Carolina Beach Harbor), within a 5.7 acre area in the Carolina Beach Yacht Basin/Myrtle Grove Sound. The project area also includes the Town of Carolina Beach's property located at 9011 Sandpiper Lane, off Canal Drive, in Carolina Beach, New Hanover County. To fmd the property from the NCDENR-Wilmington Regional office, turn left onto Market Street from Cardinal Drive. Travel approximately 0.75 miles and turn left onto College Road. Continue south along College road (Highway 421) from Wilmington towards Carolina Beach (approximately 15 miles). Cross Snow's Cut bridge and continue to travel south along Highway 421. Turn left onto Carl Winner Drive (located approximately 2.5 miles from Snow's Cut bridge) and continue until you reach Canal Drive. Turn left onto Canal Drive and travel north approximately 0.7 miles and the property of interest would be located on the left hand side. The proposed mooring field location would be waterward of this property towards the northwest within Carolina Beach Yacht Basin/Myrtle Grove Sound. The high ground portion of the property is approximately 0.047 acre with 25' of shoreline frontage. The lot averages 2'above normal high water (NHW) and the shoreline is stabilized by a wooden retaining wall. Most of the high ground portion consists of a graveUpaved parking area. Waterward of the retaining wall is an area of Coastal Wetlands located approximately 25 feet in width, which consists primarily of smooth cordgrass (Spartina altern~ora). An existing public access pier extends from the existing retaining wall towards Carolina Beach Yacht Basin, measuring approximately 30' in length by 5' in width. The pier terminates onto a covered platform, measuring approximately 13' in length by 10' in width. There are currently no docking structures at this location. The applicant received a CAMA Major Development Permit No. 81-09 on July 10, 2009 through the Express Review Permitting Program for the construction of new public transient floating docks, a new pump-out facility with associated upland development, and a boatlift for town's Police Department, located within the most southwestern portion of the Carolina Beach Harbor. In the project vicinity, the waters of the Carolina Beach Yacht Basin are classified as SB by the NC Division of Water Quality, and they are CLOSED for the harvest of shellfish. These waters are NOT designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The Carolina Beach Land Use Plan classifies the waters as Conservation. PROPOSED PROJECT: The applicant is proposing to establish a permitted public mooring field with an associated dinghy dock to accommodate ten vessels within Carolina Beach Yacht Basin/Myrtle Grove Sound. The rectangular-shaped mooring field would begin waterward of Sandpiper Lane and run parallel with the Carolina Beach Yacht Basin for approximately 1,000' to a point waterward of Scotch Bonnet Lane. The application states that the proposed mooring field would provide safe, controlled mooring facilities for transient boaters from the AIWW and the Atlantic Ocean within a 5.7 acre area. The application also states that the mooring field is specially designed for boats greater than 26' in length, but no larger than 5 5' in length. Each mooring would be designed with a 75' swing radius and anchored with either a USACE concrete mooring block, driven pile system or a pre- engineered manufactured system. The application states that the maximum lateral loads of the anchor system would be calculated by a professional engineer licensed within the state of North Carolina in conjunction with geotechnical information, to determine the actual mooring anchoring system. The proposed mooring field would be marked by fixed, controlled area signs indicating the extents of the mooring field, supported by two (2) 10" diameter class B timber piles. The piles would be marked with two (2) rows of 6" wide reflective white tape that would be located 6" from the bottom of the sign with an 8" gap between rows of tape. The bottom of the sign would be located 6'-9' above mean high water (MHW). The application states the signs and mooring buoys would conform to the U.S. Coast Guard, Aids to Navigation Manual- M16500.3A and N.C. Wildlife Resources regulations for regulatory signage. Town of Carolina Beach Mooring Field Page Three The application states that the applicant anticipates the signs being a 4NW (48" x 48") and would consist of a white background with an orange reflective border. The signs would be placed perpendicular to the AIWW and would provide a nominal range of 2 nautical miles (nm). The buoys would be comprised of a white barrel buoy with a single blue horizontal strip located at mid distance between the top of the buoy and the waterline. The application states that based on preliminary calculations, the buoy dimensions would be 30" in diameter affixed with 1.25" heavy chain. The buoys would be anchored with an approximate 3.25 ton (buoyant weight) pre-cast concrete mooring block approximately 6'x6'x3', or an equivalent helical earth anchor system. The coordinates of the signs and buoys are defined in the application. The application states that the existing water depth at the location of the proposed mooring field is -15' at mean lower low water (MLLW). Further, additional information, such as "No Discharge" and the buoy identification would be provided on the mooring buoy To accommodate the proposed mooring field, two "dinghy" docks would be available, one at the existing marina transient area located the Carolina Beach Harbor that currently accommodates ten (10) transient day docks with a sewage pump-out facility. The town currently has all the other necessary amenities that also include toilets, showers, municipal garbage pickup and parking. The other proposed location at the location of the access pier and gazebo at 9011 Sandpiper Lane. As proposed, the existing gazebo would be removed and the existing pier would be extended an additiona136' in length by 5' in width to a total length of 85'. An access ramp would lead onto a new floating dock, measuring 36' in length by 5' in width, which would run in the same alignment as the access pier. The floating dock would accommodate up to four (4) vessels at one time. The application states that water depth in the vicinity of the proposed dock range from -6.0' to -8.0' below the elevation of normal low water (NLW). The application also states that the proposed floating dock would accommodate up to four (4) vessels (See Sheets S 1 through 52.0). The application states that the entirety of Myrtle Grove Sound within the project area is a "No Wake Zone" as within the NC Administration Code (15A NCAC10F.0306 Carolina Beach, therefore no additional controlled area signage is proposed. An Environmental Assessment (EA) was submitted on April 19, 2010 for multi-agency review. The EA and a Finding of No Significant Impact (FONSI) were submitted to the State Clearinghouse and the coordinator has indicated that because of the nature of the comments received during the State Clearinghouse review, no further environmental review action is required under SEPA on January 19, 2011. 10. ANTICIPATED IlVIPACTS: The formalizing of the mooring field would result in the controlled use of 5.7 acres of Public Trust Waters. It is however anticipated that the permitted, controlled mooring field would allow for a safer and cleaner use of Carolina Beach Yacht Basin/Myrtle Grove .Sound. The mooring field would be well defined and marked as a mooring area, thus reducing impacts to navigation from passing vessels. Placing a figure on bottom disturbance is difficult; however the placement of 3.25 ton pre-cast concrete mooring block would create approximately 360 sq. ft. of bottom disturbance, along with an equivalent helical anchor system; however, no impact to shellfish or SAVs would be anticipated. As proposed, the proposed mooring field would not encroach into the USACE AIWW setback requirement. The proposed new pier and floating dock extension would incorporate approximately 360 sq. ft. of Estuarine and Public Trust Waters. As proposed, the pier extension and the floating dock would be located within the applicant's area of riparian access, within'/4 of the width of the waterbody and not beyond the Town of Carolina Beach's established pierhead line; however, the new pier and floating dock would encroach into the adjacent riparian property owners' 15' setback requirement. The application states that the town is currently seeking a waiver from both the adjacent riparian property owners. No impacts to Coastal or "404" wetlands would occur as a result of construction. Mairs Date: February 11, 2011 Office: Wilmington ~, (`~~ ? ~ 1 MYRTLE GROVE SOUND MOORING FIELD CAROLINA BEACH, NC Background & Project Description The Myrtle Grove Sound Mooring Field, within the town of Carolina Beach is located within the Myrtle Grove Sound, and provides safe, controlled mooring facilities for transient boaters. .The mooring facility is specifically designed for boats greater than 26' but for vessels no larger than 55', and will provide safe harbor for transient boaters from the AIWW or the Atlantic Ocean. The proposed project includes ten (10) mooring locations bounded within a 5.7 acre area. Each mooring will be designed with a 75' swing radius and wilt be designed with either a USACE concrete mooring block, driven pile system or a pre~ngineered manufactured system. Maximum lateral loads will be calculated, by a professional engineer licensed within the state of North Carolina, based on the 55' vessel utilizing practices that are standard for marine engineering. These lateral loads will then be utilized, in conjunction with geotechnical information, to determine the actual mooring anchoring system. The mooring field will be marked by fixed, controlled area signs indicating the extents of the mooring filed. The locations of these signs are shown within Appendix E, drawing S1.1. The controlled area signs will conform to US Coast Guard, Aids to Navigation Manual - M16500.3A and NC Wildlife Regulations for regulatory signs. We anticipate the signs being a 4NW (48" x 48") and will consist of a white background with an orange reflective border. This signs will be placed perpendicular to the ICW channel and will provide a nominal range of 2 nm. The piles will be marked with (2) rows of 6" wide reflective white tape that will be located 6" from the bottom of the sign with an 8" gap between rows of tape. The bottom of the signs will be located 6'-9"above MHW. The mooring buoys will conform US Coast Guard and NC Wildlife Regulations and will be comprised of a white barrel buoy with a single blue horizontal strip located at mid distance between the top of the buoy and the waterline. An environmental assessment of the proposed mooring basin has been completed by the Town of Carolina Beach and was submitted on April 19, 2010 to the North Carolina Department of Administrations Clearing House. Presently the E.A. is in the process of being approved by the North Carolina Department of Administrations Clearing House. A copy of the submitted E.A. may be seen in Appendix F. Two dinghy dock locations will be available to the transient boaters moored within the mooring field. The first option is the existing Marina Transient Area located within the Carolina Beach Harbor. This facility is located approximately 3,000 feet to the south of the proposed mooring field. This facility has ten (10) transient day docks and a sewage pump out station. The second dinghy dock is a proposed extension to the current Town's fixed pier located at 9011 Sandpiper Lane, and will serve as a secondary dinghy dock access to the mooring field. This new facility will consist of a new 180 sf elevated fixed timber pier extension and 180 sf of floating dinghy docks. The existing shoreline will remain in its natural maintained vegetative state, and no upland development is proposed at this time. The site at 9011 Sandpiper lane is bordered by two tracts of land, with the Sand Piper Lane Right of Way being owned by the Town of Carolina Beach. Presently, New Hanover County indicates that the adjacent property to the south, map # R08815-006-001-000 is owned by Alexander and Tracey Torello, while the site is bordered to the north, map #R08815-007-010-000 is owned by Steven and Cathy Casey. Per our previous application, this property was in the process of being sold from Mr. Collins at the time of the initial submittal. The deed has been recorded with New Hanover County, and the property information is enclosed. The Casey's have been apprised of the proposed plans via certified, return receipt required. The green card will be submitted under a separate cover once it is returned. At this time the town is requesting a waiver of the 15 foot setback from both owners based on the plan shown on drawing S2.0. Preliminary conversations between the town and the owners have been positive, and we are proceeding forth with this arrangement. No material will be removed from below the Normal High Water Line. Stormwater Management This project lies within the Cape Fear River Basin, and drains to Myrtle Grove Sound/AIWW. Currently, the site at 9011 Sandpiper Ln. sheet flows to a maintained vegetated area along the waterfront, while the remainder flows directly into the waterway via natural contours. These portions of the site will remain and thus continue to drain in the same manner. Because 10,000 SF or more of new imperious area, the owner will not apply for an NCDENR Stormwater permit. Erosion & Sedimentation Control All work for this proposed project will be completed by barge and therefore there will be no upland disturbance on the site at 9011 Sandpiper Ln. The moored vessels will utlize the existing pump out station located at the Marina Transient Area located at the Carolina Beach Town Marina. There is no upland devlopment proposd for this project. c. Construction of the mooring field will be will be comprised of a submerged anchoring device, such as an USACE concrete block or a manufactored system.
