Public Works 115 West Main St. Lincolnton, NC 28092 Dear Mr. Whittaker: Subject: Airlie Industrial Park DWQ #11-0089 Lincoln County, NC On January 26, 2011, your 401 Water Quality Certification application was received by the Division of Water Quality (DWQ). Your application has been reviewed and the following is required: Stream crossing in Phase I. The application states that the stream impact will not exceed 149 linear feet (If). The initial stream detail showed the pipe to be 149 If. Based on that information and the submitted detail, the stream impact would be approximately 175 to 180 If. A subsequent submittal for the stream detail showed the pipe to be 127 If. However, based on the plan the actual stream impact still exceeded 149 If (-165 If). In addition, there was no change in the slope of the fill or road right of way. This needs to be clarified. • The stream impact includes any stream impact for the installation of the culvert. (pipe, rip rap, etc.). The impact is not the length of pipe. However, measurement of pipe length and any other impacts should be identified. Storm water. The purpose of the application is for the development of an industrial park. A stormwater plan is required (condition #12, general certification #3821). Based on the submittal, storm water BMPs are not planned because there is only one building proposed at this time (thus impervious area is below 24%). Impervious area for a project is based on build out. You may place deed restrictions on the project and individual lots indicating that impervious area shall not exceed 24% or submit a stormwater management plan that will meet the approval of the DWQ stormwater management review team. At minimum the location of the storm water BMPs and basic design would be required. • The application states the stream is approximately 5 ft in width. The proposed pipe is 7 ft in width. Care must be taken that the stream is returned to original dimension immediately above and below the culvert. • Is water and sewer already available for this site/development? If not, this may raise concerns of additional development pressure should such utilities be extended to the area. • Mitigation shall be required should the impacts associated with Phase I exceed 150 If of stream. Also the impacts for Phase II will be added to the Phase I impacts thus requiring mitigation payments for the total stream impacts for the entire project. The owner is shown as Ingleside Real Estate (McGill Associates is shown as the agent for Ingleside) however the "applicant" is Lincoln County. Pursuant to 15A NCAC 2H .0507(h), please be advised that this project will be placed on hold until all the necessary information is provided. Failure to submit the requested information may result in the application being withdrawn from consideration. You may reapply, but a new fee and application will be required.
