Additional information is again required in order that we may determine your project's compliance with 15A NCAC 2H .0500. The Division will require this information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, we will place this project on hold as incomplete until we receive this additional information, and if we do not receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506. Please provide the following information so that we may continue to review your project. 1. The Division has been notified by the US Army Corps of Engineers (USAGE) that they have determined this project does not qualify for a Nationwide Permit and must be covered under an Individual Permit. Please submit the Individual Permit application to the Division at the time of submittal to the USAGE. 2. Per our discussion in a meeting on February 8, 2011, please provide more detailed documentation regarding avoidance and minimization of stream impacts for this project. This should include stream relocation, retaining walls, alternative designs and layouts of the buildings and parking areas, etc, including modifying the type of use of the property. C. Division of Water Quality, Wetlands/401 Certification Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. If you will not be able to provide the requested information within that timeframe, please provide written confirmation that you intend to provide the requested information, and include a specific timetable delineating when the requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that you no longer want to pursue this project and we will consider the project as returned. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the Division.
