Project Summary: The applicant wishes to construct a single family residence, a retaining wall, a dock, and a gazebo. 9. Narrative Description: The property is located at Lot #44 in the Wilson Creek Heights subdivision on West Wilson Creek Drive in New Bern, Craven County. The lot is a 0.79-acre tract adjacent to Wilson Creek. This site is developed with an existing 600 ft2 asphalt driveway and a 720 ft2 concrete slab. The existing driveway is located in the southeast corner of the parcel connecting to West Wilson Creek Drive. Field Investigation Report: Sean Corcoran Page 2 The existing concrete slab is near the northeast corner of the lot, approximately 10' from the shoreline of Wilson Creek. Both of the adjacent properties are developed single family residences. The average elevation of the high ground of the parcel is +5' above the normal water level (nwl). Vegetation on this particular tract is mainly comprised of woody vegetation. The northern portion of the lot has over 150' of shoreline along Wilson Creek. There is approximately 0.25 acres of Section 404 Wetlands, which includes part of an island, adjacent to the shoreline. These wetlands are predominantly comprised of cypress trees. Immediate offshore water depths adjacent to the lot range from about -1' to -4' nwl. The subaqueous substrate is soft without shell. This waterbody is about thirty feet across at this location. This tributary is a part of the Neuse River basin. These waters of West Creek are not classified as a Primary Nursery Area and there is no submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as C; Swamp, Nutrient Sensitive Waters. There is not a defined channel in the nearby vicinity of the project area. 10. Proposed Development: The applicant wishes to develop the lot with asingle-family residence, retaining wall, gazebo, and dock. The residential structure and associated driveway combined will be greater than 5,000 square feet. They are to be sited on high ground at the southern end of the lot, more that 50' from Wilson Creek. The retaining wall will be constructed within the Section 404 Wetlands adjacent to the shoreline. This wooden retaining wall will be approximately 100' in length and 5' in height. The backfill material for this wall will 6110.10 acres of Section 404 Wetlands. A wooden pier and connecting gazebo are proposed for the northeastern corner of the property. The 12' by 12' gazebo will be sited on top of the existing concrete slab. The "L"-shaped pier will approximately follow the shoreline from the retaining wall along the edge of Wilson Creek, elevated over the Section 404 Wetlands. There are no formalized boat slips proposed. This pier will be 6' wide and a total of 88' long. There will be a 6' by 10' walkway connection from the pier to the gazebo on the existing concrete slab. 11. Anticipated Impacts: The "L"-shaped pier will shade 570 square feet of Section 404 Wetlands. The corner of the "L" will extend 3' waterward into a 22' wide tributary. It will not be a hazard to navigation. It will be 5' from the nearest adjacent riparian property line. The retaining wall and subsequent backfill will impact 4,356 square feet of Section 404 Wetlands and DWQ Neuse River Riparian Buffer. The roofed gazebo will be constructed over apre-existing concrete slab within Zone 1 of the DWQ Neuse River Riparian Buffer. There is no new impervious surface proposed within the 50' buffer. The single family residence and associated driveway will be constructed entirely on high ground, more that 50' from Wilson Creek. t. Immediate off shore water depths in the area range from - 1' to -4' nwl. These waters are closed to the harvest of shellfish and there are no beds of submerged aquatic vegetation present. The waters of Wilson Creek are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This proposal should not pose a hazard to navigation. The docking facility will not exceed the '/ width of the waterbody. This proposal involves the filling of 5,344 ft2 of high ground. This proposal involves the filling of 4,356 ft2 of Section 404 Wetlands. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) The retaining wall alignment will not go below the normal water level at the time of construction; 2) The retaining wall must be constructed prior to any backfilling activities; 3) In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters; 4) Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, sand fence, etc.); 5) Aground cover sufficient to restrain erosion shall be provided within the shorter of 15 working or 30 calendar days of completion of any phase of grading on cut or filled slopes; 6) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No non-water dependent uses of structures maybe conducted on, in or over public trust waters without permit modification; 7) The authorized covered platforms (gazebos) shall be single story, and shall not be designed to allow for second story use; 8) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization; 9) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work; 10) The authorized structure and associated activity must not cause an unacceptable interference with navigation; 11) The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. Contract has been in play for approximately 90 days, to present date.The contract is to obtain a major permit thru the N.C.D.E.N.R. & all other Major agencies involved through federal, or state for consideration of the appropriate back-fill of one tenth of an acre of land.This Includes the construction of approximately 240 feet of appropriate retaining wall, to prevent damage to property with erosion & property loss. A walkway at the East end of retaining wall is also proposed to start & follow along hillside of ridge,it is approx. 180 feet in length & leading to proposed gazebo. Gazebo is proposed to be built on existing concrete pad,as it has existed for many years, an only needs repairman rights. A secure platform built above it thru common engineering is all it would require to become code. North ot~gazebo,the walkway is proposed to continue several more yards in length,to proposed 12x16 platform that would 95% rest on edge of property with pilings half total length penetrated,bolted & secured which would allow stability also canoe access.
