8. PROJECT SUMMARY: The applicant is proposing to redevelop an existing warehouse for a
drystack marina storage facility as well as construct a pier with floating docks. A pedestrian
pier, fueling platform, concrete loading zone, bulkhead extension, high ground grading, partial
building demolition and parking areas are also part of the project.
9. Narrative Description:
"I'he "Atlantic Veneer" project is located at 24.57 Lennoxville Road in Beaufort,
Cartc;ret County. Lcainoxville Road is found by tur>>irig right off ofIl~n-~y 70 Bast (adjacent to
Gaskills general store) onto Leruloxville Road. Follow this road for about 3/4 of mile. The site
will be located on the north side of Taylors Creek and east of Front Street Village
Marina. The proposed project was previously a part of the "Blackcat" Marina proposal. The
"Blackcat project was not permitted and was withdrawn on January 27, 201 1.
The entire parcel is 9.53 acres with the project area at 3.3 acres (143,748 square feet). The
site averages 8' in elevation above NHW. Currently on the high ground portion of the site
is an existing warehouse, garage, house, driveway, parking area, sidewalks, septic system,
bulkhead, and atwo-slip docking facility. The shoreline has a total length along the NHW
contour of 1055' with 371' within the project area. Along the shoreline is a 32' wide
expanse of Coastal Marsh that contains Smooth Cordgrass (Spartina alterniflora) and Salt
Meadow Cordgrass (S artina patens) and a section of jurisdictiona1404 wetlands landward
of the coastal wetlands. There are scattered oysters located along the edge of the coastal
wetland areas. The high ground portion of the tract is vegetated with upland grasses, pines,
shrubs and live oaks.
The Division of Water Quality classifies this area as SC Waters. Taylors Creek is not a
Primary Nursery Area and is closed to the taking of shellfish. The Town of Beaufort's
Land Use Plan classifies this area as Mixed Use with Conservation within the AECs. There
is a Federal Channel within Taylors Creek with a setback of 61'. There is a permitted
commercial marina to the west and residential development to the east of the proposed
project. The commercial marina dock extends 109' below NHW and the residential dock
extends 49' below nhw into Taylors Creek.
10. Protect Description:
The applicants withdrew their previously submitted marina project known as the "Blackcat
Marina" on January 27, 2011. This proposal is a scaled down version and proposes to
renovate the existing warehouse located on the western portion of the tract to
accommodate a 155 drystack marina. The project would demolish the front portion of the
warehouse to accommodate 19 parking spaces, a 3 space parking area on the east side of
the existing building, conduct interior building improvements within the existing building
footprint, the installation of a concrete boat launch pad, and the addition of a fixed pier,

floating platforms with gangways, fixed fueling platform with boat sewage pumpout,
pedestrian pier/walkway, fish cleaning station, bulkhead extension, above ground fuel
storage tanks, driveway, access road and grading.
A total of 57,000 square feet of high ground would be graded and filled during the process.
The existing impervious surface is 14% within the 75 AEC and is 59.5% for the entire
tract. The applicants have stated that a stormwater permit is not required because the
project meets the 2008 Coastal stormwater Rules redevelopment exclusion. They have
submitted proposed plans to DWQ for written concurrence of the applicability of this
exclusion. Overall the project also proposes the disturbance of 1.3 acres of ]and but the
applicant indicated that no erosion and sedimentation plans have been submitted to the
Division of Land Quality.
Tlie high ground work would consist of the following: the installation of a 12' x 58' concrete
launch pad on the south end of the drystack building, above ground fuel storage tanks(located
on the east side of the existing building, an 8' x 10' fish cleaning station, a 15' x 50' asphalt
loading area located north of the three space parking area, a 20' x 495' driveway/access road
from Lennoxville Rd, a 12' x 32' turnaround and a 6' x 23 0' wooden walkway connecting the
three-parking space area to the asphalt access lane. In order to comply with The Town of
Beaufort parking requirements (one space for every four drystack slips) and to accommodate
for the 19 parking spaces on the north side of the existing warehouse as well as 3 spaces
(which includes one ADA space) on the east side, a portion of the existing building, existing
drive and asphalt parking area would be removed. There are existing impervious areas along
the project area that would be removed as well. These include brick pavers, asphalt driveway
connecting to Lennoxville Rd, existing concrete area with loading ramp on the east side of the
building, the existing concrete drive for the house, and an asphalt drive on the east side of the
proj ect area. Most of the demolition would remain outside of the 75' coastal shoreline with the
exception of a 300 square foot portion of the existing drive on the southeast side of the project
area. The parking area would be located over existing impervious areas. The remaining 17
parking spaces required by the Town of Beaufort would be located on the applicant's property
across Lennoxville Road. The applicant does not designate an exact area for these spaces.
There is an existing bulkhead located on the southeast side of the project area along the
shoreline in front of the existing home. The applicants propose to connect to the existing
bulkhead and extend the new bulkhead west for 350'. There is a 220 square foot area of
jurisdictiona1404 wetlands located at an existing outfall location that would be filled in
order to accommodate installation of the bulkhead. The bulkhead would be 10' to 15'
above the nhw contour and landward of all coastal wetlands and would be landward of the
jurisdictiona1404 wetlands except at the outfall area. The bulkhead would be of vinyl sheet
piling design with a concrete cap.
The applicants are proposing a 12' x 117' (this includes the 20' gangways) pier for boat
launching and a 6' x 141' pedestrian pier. The boat launching pier would extend from the
concrete launch pad south for 13' then extend over coastal wetlands for another 25', and
over scattered oysters for 9' and finally extending 70' over open water. The pedestrian pier
would begin at the south portion of the access lane and extend south over high ground for

60', over coastal wetlands for another 25', over scattered oysters for 6' and finally 50' over
open water. The pedestrian pier and launch pier (with platforms) would not extend farther
than 80' to 100' below nhw depending on location into a 414' wide water body. The
launch pier and pedestrian pier would connect to two floating platforms by way of
gangways. The floating platform on the east side would be 6' wide x 140'. There would be
a fixed 6' x 20'fueling platform with pump out on the landward side of the eastern floating
platform. There would be a total of four `no sewage discharge" signs as well as four
"pumpout available" signs located along the floating platforms. The western floating
platform would be 6' wide x 172.' long. Both of the floating platforms would encroach 6'
into the 61' IJSACOE setback for 6'. According to the a~>plicant the typical boat to be
served would be mixed types and would range between 13'to 35'. There aJ•e two existing
slips located at the existing docking facility with no nee-~~ wet slips prol~~osed.
Water depths will~in this area as•e an average of -10'.
11. Anticipated Impacts:
Installation of the piers and docks would incorporate 3,150 square feet of open water. The piers
would shade 90 square feet of jurisdictional wetlands, 90 square feet of high marsh, 216 square
feet of low marsh and 126 square feet of oyster rock. Approximately 57,000 square feet of high
ground would be impacted by the project with a finished impervious percentage of 14% within
the AEC and 59.5% for the entire tract. The proposed floating platforms encroach 6' into the 61'
USACOE setback. A total of 220 square feet of jurisdictiona1404 wetlands would be filled to
accommodate the bulkhead alignment. No coastal marsh would be filled or excavated during this
project. Minor impacts to the marsh and oyster rock during construction of the docks and piers
would be expected as well as temporary increases in turbidity.

SUBJECT: Comments and Recommendations - CAMA Major Permit -Moehring Group Holding, Lp `Atlantic
Veneer Drystack Marina", Beaufort, Carteret County
The following is my assessment and consequent recommendations of the above referenced proposal.
This proposal involves the renovation of an existing warehouse fora 155 drystack marina as well as
high ground. disturbance and development, pedestrian walkway, pier with platforms, fuel dock and.
bulkhead. The width of the docks would be greater than six feet, however per 7H.0208 (6) (A) could be
permitted if the greater width is necessary for safety or to improve public use access.
The bulkhead placement would remove a total of 90 square feet of USACOE designated wetlands
however per 15A NCAC 07H .0208 (b) (1) (A) could be allowed through fringes or regularly and
irregularly flooded wetlands if the loss of wetlands would not cause a significant adverse impact and if
there is no reasonable alternative that would avoid the wetland losses. The adjacent waters of Taylors
Creek are closed to shellfish harvest and are not Primary Nursery Area. The development conforms to
the guidelines set forth under 15A NCAC 07H .0208 and 15A NCAC 07H .0209. Assuming that state
and federal agencies concur with the proposal, the District recommends the project be authorized as
proposed, contingent upon the following conditions:
All excavated materials will be confined above mean normal water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
2 The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion
within 30 working days of project completion.

3 No excavated or fill material will be placed at any time in any vegetated wetlands/marsh or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing(s).
4 The docks encroach 6' into the 61' USACOE setback and should have written concurrence to remain
within this location. The piers and platforms shall not exceed a maximum distance of 100' from nhw and
50' to 75' from the edge of marsh.
5 The bulkhead shall remain landward of all coastal wetlands.
6 All non-water dependent uses shall be a minimum of 30' landward of nhw except for those exceptions
allowed in 15A NCAC 07H.02.09 (d) (10).

Introduction
Moehring Group Holding, LP proposes to redevelop an existing warehouse for use as a drystack
storage marina. The building, known as the export warehouse, was constructed in the early
1980's and was previously used by the Atlantic Veneer Corporation to store wood products.
The project site consists of 3.3 acres located on Lennoxville Road adjacent Taylors Creek,
outside the corporate limits of the Town of Beaufort. The export warehouse drystack marina
project site comprises the western portion of a ± 9.5-acre waterfront parcel owned by the
applicants. The eastern portion of this parcel is also the site of a boat basin previously proposed
as part of The Blackcat, a larger marina project. The Blackcat was not permitted and was
withdrawn from consideration on January 27, 2011. (Please see attached letter from Daniel
Govoni, Assistant Major Permits Coordinator with the NC Division of Coastal Management,
officially retiring The Blackcat CAMA permit application.)
The property is located within the Extraterritorial Jurisdiction (ETJ) of the Town of Beaufort. It is
zoned Industrial Warehouse (1-W). The Town of Beaufort Board of Commissioners determined
that recent changes (in November 2010) to the Town's zoning ordinance designating marinas as
a "special use" are not applicable to this project and that the proposed drystack marina is a
permitted use. The project site is not located within a designated Historic District of the Town
of Beaufort. Commercial site plan approval by the Town will be required. Planning is underway
with Town officials to address all local requirements.
A commercial marina (Front Street Village) is located to the west of the project site, with single-
family residential uses to the east. The Atlantic Veneer Corporation plant is located across
Lennoxville Road on the north side of the project.
An existing onsite septic system has been authorized by the Carteret County Health
Department for change of use to serve a drystack marina with no more than 155 storage slips
and four employees. Interior plans are being developed to determine the exact number and

placement of racks to store the boats. A private well located on Atlantic Veneer property an the
north side of Lennoxville Road will provide potable water to the project.
No permanent boat slips are proposed for this project. Boat staging areas are designated on the
south side of two proposed floating docks. Once constructed, the owners intend to pursue
Clean Marina designation for the facility.
Site Description
The project site currently contains the warehouse, afree-standing garage, driveway, parking
area, and sidewalks. An existing septic system and a small section of bulkhead are also present.
Beyond the project area, the parcel also contains a parking lot, residential buildings, docks with
two boat slips, boat ramp, driveway, and bulkhead.
The site topography is relatively flat, with a gentle slope along the waterfront towards Taylors
Creek. The base flood elevation of the site is 7 feet (NAND 88 datum). Normal low water depths
of 10' + are found at the waterward end of the proposed docking facility.
A federal channel is located in Taylors Creek along the shoreline of the project site. The channel
is 100 feet wide with average normal low water depths of 15 feet. The Corps of Engineers
enforces a setback of 60 feet from the channel where no fixed structures are allowed. This
project complies with the setback requirements.
Native and landscape vegetation is found on the site, with areas of coastal and Section 404
wetlands located on the south side of the property. A copy of the jurisdictional wetland
determination approved by the US Army Corps of Engineers in September 2010 is included with
this application. A small amount of jurisdictional wetlands will be affected by the project.
A tree survey conducted as part of this project identified several live oak, hickory, cedar, and
pine trees with diameters measuring 5 inches or greater when measured at four feet above
grade. The locations of these trees are shown on project plans.

Project Description
The project includes demolition of portions of the existing warehouse building, as well as
interior building improvements to include installation of boat racks and a recycled water system
for boat wash-down. New construction includes a concrete pad for boat launching, pier with
gangways, floating docks with staging areas, fixed fueling platform with a boat sewage pump-
out, pedestrian pier/walkway, fish cleaning station, bulkhead extension, parking and loading
areas, installation of above-ground fuel storage tanks, and adriveway/ access road. Grading
sufficient for proposed improvements and to provide stormwater controls equal to or better
than existing development is also proposed. No dredging is planned.
Demolition
Page 4 of the project plans provides demolition details, including removal of a front portion of
the existing building. The area of the building to be removed (and associated impervious
surfaces calculation} will be converted to a parking area.
Existing paved areas totaling 14,294 SF are also designated for removal. An existing asphalt
parking area on the north side of the building (3,273 SF), brick pavers (426 SF), asphalt driveway
connecting to Lennoxville Road (2,524 SF), existing concrete area with loading ramp (4,448 SF),
concrete drive connecting to the existing detached garage (796 SF), and asphalt drive located
along the east side of the project (2,827 SF) will be removed. As noted on the project plans,
portions of the targeted paved areas may remain in or beneath the final paving configuration as
permitted for structural integrity and needed grading. Block walls noted on plans are slated for
remova! also.
Most of the demolition will occur outside of the CAMA AEC. A small section of the asphalt drive
located in the southeast portion of the project site is the only area within the AEC designated
for demolition.
Docking Facility and Bulkhead
An elevated pier connected to a highground concrete pad will be used to launch and retrieve
boats for storage in the drystack. The concrete pad will measure 12' x 58'and will connect to an
elevated 12' wide slatted pier with two parallel gangways, each measuring 6' x 20'. Pier length
from edge of marsh waterward is 69' {49' plus attached gangways). Pier length from the edge
of marsh to Normal High Water measures 20', with an additional 28' above NHW to edge of the
concrete pad.

Total length of the pier is 117', including attached gangways. The 12' pier width is necessary for
safe launch and recovery of boats being transported by forklift. The concrete pad and elevated
pier will be engineered to support the weight of the forklift and boats. The pier will be elevated
a minimum of 3' above the wetland substrate and oyster bed located at the site. The pier will
partially shade a small amount of wetlands and shell bottom.
As previously noted, two parallel gangways each measuring 6' x 20' are located at the
waterward end of the pier to allow for access to floating docks. The western ramp also inc{udes
a 6' x 6' landing on the landward end.
This project incorporates floating docks with pilings located on the landward side o'f the
structures outside of the required federal channel setback. Two floating docks will connect to
the pier gangways and will serve as boat staging areas. The western floating dock measures 6' x
172' and is located 15' from the riparian boundary of the adjacent riparian neighbor. The
eastern floating dock measures 6' x 140'.
No permanent boat slips are proposed. The boat staging areas will be located waterward of the
floating docks within the channel setback. Normal low water depths along the outer edge of the
docking facility measure a minimum of 10 feet.
A 6' wide slatted pedestrian pier/walkway connecting to the eastern gangway and extending to
the proposed asphalt lane is also included. Over the water, the elevated walkway will be
constructed parallel to the fixed launch and retrieval pier. It will then angle over the highground
to connect to the proposed asphalt lane. The pier/walkway is provided as a safety measure to
allow customers to access launched boats without entering the drystack building and walking
along the launch and retrieva! ramp where boats are being transported by heavy equipment. It
will also provide for improved access to the docks in the event of an emergency. From edge of
marsh waterward the pedestrian pier/walkway measures 52', with an additional 20' above
marsh to NHW. From NHW to edge of pavement the pier/walkway measures 69', for a total
structure length of 141'.
A 6' x 20' stationery fueling platform with a boat sewage pump-out is also proposed. Gas and
diesel tanks will be connected to upland above-ground fuel storage tanks (ASTs). The fueling
platform will be located at the end of the eastern ramp of the launch and retrieval ramp.

An existing bulkhead is located in the southeast corner of the project site. Project plans include
extending the bulkhead west to the property line for a distance of 350'. An area of wetlands at
an existing outfall location measuring 220 square feet (.005 acre) will be impacted by the
bulkhead construction. Due to the impracticality and additional cost of constructing a "box" in
the bulkhead around the area, filling the wetlands is necessary to straighten the bulkhead
alignment. 22.2 cubic yards of fill material will be needed. No mitigation is proposed due to the
high cost involved for the small area (the minimum fee charged by the NC Ecosystem
Enhancement Program is for .25 acre, which for this site would be more than $15,000).
Pages 5 and 6 of the project plans present the proposed development. Page 7 provides the
section drawing from the rear door of the building to the edge of the federal navigation channel
through the boat launch and retrieval pad and pier centerline. Page S gives an enlarged view of
the proposed docking facility.
Upland Development
Upland development associated with this project involves renovations to the existing
warehouse building to convert its use for drystack storage. New proposed highground
development includes construction of a 12' x 58' concrete pad for boat launching (to be
connected to the boat launching pier), an 8' x 10' fish cleaning station (to include a PVC fishing
line recycling receptacle), and a 15' x 50' asphalt loading area. Also included is a
driveway/access road measuring 495' x 20' from the edge of Lennoxville Road to the concrete
ramp. The access road includes a 12' x 32' turnaround. Installation of fuel storage tanks is also
proposed in the highground area as shown on project plans.
Parking for the project will be provided in accordance with local regulations. The Town of
Beaufort requires one parking space for every four dry slips, plus one space for every two
employees. A portion of the parking for the project will be at the site as shown on project plans.

or better than existing development is also proposed. Most of the proposed upland work is
outside the CAMA AEC.
Building renovations include removal of a front portion of the building measuring
approximately 45' x 220'. (This area and associated impervious surFace calculation will be
converted to parking to serve the facility.) Interior renovations include installation of racks for
boat storage.
A proprietary closed loop recycling system for boat washdown is also proposed for installation
inside the building. The recycling system will include a floor depression and trench drain as
shown on project plans. By locating the recycling system inside the building, the system will not
be exposed to stormwater, thus contributing to the anticipated NPDES "no exposure exclusion"
for this project. Also, based on discussions with staff of the NC Division of Aquifer Protection, it
is anticipated that the recycling system inside the building will qualify for "deemed permitted"
status and will require no permit from this agency.
Existing paved areas within the project must also be removed to accommodate needed grading
and proposed improvements. Up to 14, 294 SF will be removed as shown on project plans,
although portions may remain in or beneath the final paving configuration, contingent on
structural integrity and as allowed by required grading.
stormwater Management
This project meets the 2008 Coastal Stormwater Rules redevelopment exclusion, which requires
no net increase in built-upon area (BUA) and that the project provides equal (or better)
stormwater control. Existing BUA at the project site totals 85,868 square feet, compared to
proposed BUA of 85,500 square feet. The proposed project also provides equal or better
stormwater control, in that sheet flow is increased and direct piped flow is reduced and
receives treatment not currently provided. An existing catch basin and pipe are to remain.
Grading plans are included with this application.
Proposed plans have been submitted to the Division of Water Quality (DWQ) for written
concurrence of the applicability of the stormwater redevelopment exclusion. DWQ has
requested additional information. The revised plans are being prepared and will show the
existing and proposed conditions and other required components.

it is anticipated that an NPDES permit will not be required far this project. Discussions and
onsite investigation with DWQ staff indicate that the "no exposure exclusion" will likely apply to
the project. Staff indicated that the final determination will be made after the project is built.
Construction Methods
Conventional upland building and marine construction mcthLdology will be employed in the
development of the project. A trackhoe, bulldozer, and dump truck will be used for demolition,
grading, and other upland development. A small tractor with front end loader will be used to fill
the small area of wetlands behind the bulkhead. The backfill will be placed on the site after the
bulkhead is installed.
Given that the project is expected to disturb approximately 57,000 square feet, approval and
implementation of an erosion and sedimentatian control plan will prevent negative erosion and
sedimentation impacts.
In areas with adequate water depths, marine construction will employ barge mounted
equipment with pile driving capability. In other areas construction will occur from the landward
side.
