The proposed project is located entirely within the Falls Lake State Recreation Area (FLSRA). The project will include the construction of an engineered pedestrian bridge across Little Lick Creek as well as low-level boardwalks to cross small inundated depressions in the existing road bed (Figure 2). The purpose of this letter is to confirm that the project is exempt from Neuse River Basin Buffer Rules based on the following project details: • All activity associated with the project will be confined to the prior right-of-way of Jimmy Rogers Road, now under ownership of the USACE, which was an existing facility prior to issuance of the Neuse River Basin Buffer Rules. • The current condition of the road bed contains no upright woody vegetation (see photo log). The open nature of the road bed was maintained by the USACE after taking ownership, and was intended for future use as the FLSRA "South Shore Trail". The South Shore Trail was included in the original FLSRA master site plan but was never constructed by the USACE because the original wooden traffic bridge crossing Little Lick Creek was destroyed by fire in the mid-1990's. • The MST, as it approaches Falls Lake from the east and west, will be a natural earth trail entirely on the existing road bed. No gravel or impervious trail material will be used. • The engineered pedestrian bridge to replace the destroyed traffic bridge will be constructed entirely within the footprint of the old bridge (see general bridge drawings). The new bridge will be constructed completely in the dry and all construction access will be limited to the prior right-of-way. • Coordination with Eric Alsmeyer of the USACE Raleigh Regulatory Field Office indicates that no Clean Water Act Section 404 permits are required for the project, and that minor shoreline stabilization below the waterline of Falls Lake is allowable without notification under the conditions of Nationwide Permit 3.
