WAIVER of 401 Water Quality Certification

Dear Mr. McGirt:
Your application for a 401 Water Quality Certification to fill 219 linear feet of intermittent streams at the McGirt
Trucking facility in Mecklenburg County was received in the Division of Water Quality's Central Office on June 24, 2002.
According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is waived
unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water
Quality Certification for your plans to impact waters as described in your June 24, 2002 application materials.
However, if additional impact occurs or your development plans change, this waiver is no longer valid and a 401
Water Quality Certification will be required.

Comments:
McGirt Trucking (the applicant) proposes to impact approx. 219 feet of intermittent channel (119 feet
of unimportant channel and 100 feet of important channel) for the purpose of developing the site for
commercial development. The site currently serves as a deposition site for fill dirt that McGirt
accumulates through its trucking business. As a result of the ongoing fill activities on this site, the
upper reaches of the channel have been impacted by sedimentation from insufficient erosion control
measures. Because the channel originates on the eject site, it is difficult to determine specific
impacts to aquatic life since there are no representative portions that can be examined that haven't
already been impacted. McGirt plans to compensate for the proposed im acts by maintaining a
25-foot buffer on the unim acted perennial portion of the channel as well as performing a series of
habitat evaluations, including benthic macroinve rteb rate survey for a period of three years after the
completion of the eject,

There was no SW plan submitted with the project. It is unclear to the writer whether or not a SW
management plan should be submitted and approved even though the applicant has not as vet
decided who the tenant on the proper will be. Central Office staff should make this determination
prior to the issuance of the 401,
