VS KCI Associates of North Carolina, PA (KCI), is writing this letter to request a modification to the buffer impacts authorization granted by DWQ in a letter issued to the Town of Wake Forest and dated March 2, 2010. Additionally, revised impacts were granted by DWQ in a letter issued to the Town of Wake Forest and dated August 23, 2010 for boardwalk construction. The project is currently under construction and abutment construction is the controlling operation. The project has been plagued with delays from subcontractor performance and weather delays. The Contractor has recently been issued a Stop Work Order for unsafe working conditions at Bridge B and Bridge D. The safety concerns at Bridge D have been addressed; however Bridge B is still concern. The contractor has excavations of approximately 8 to 10 feet in depth with no shoring. Obviously the excavation is non-compliant and needs attention before work continues at this location. KCI is requesting that a modification be granted to the temporary buffer impacts at Bridge B to provide the contractor additional space and provide access for construction equipment around the excavations. The additional impacts will allow the contractor to slope the excavation back at a 1.5:1 and provide a safe working area within the excavation. The buffer impacts will only be temporary and the contractor will re-establish the natural cover of the temporarily impacted areas after construction is complete. KCI has provided Drawing C-1.2 with the associated temporary buffer impacts highlighted for your review. In addition, an updated spreadsheet with associated buffer impacts has also been provided.
