Based on your review and approval of the enclosed information and support documentation, we are requesting an additional release of ten percent (10%) of the Bank's credits, which equates to 64,987.91 lbs (28.591 ac.) Nutrient Off-Set credits and 2.034 ac. Neuse Buffer credits (see attached credit release schedule). As of the end of the second growing season for the Flat Swamp Neuse and Nutrient Offset Buffer Restoration Project (2010), annual monitoring is complete. The second growing season has resulted in a healthy and vigorous stand of character trees. Species planted are seen in Table I below. Supplemental planting was completed adjacent to Neuse Buffer designated waterways and water courses entering these systems to close out site vehicular access and replant damaged areas noted during first year monitoring. Consequently, additional NOC and NBC area is accounted in the revised as-built survey for the end of the second growing season in 2010. A separate request to NCDWQ will follow this Annual Report to file the revised as-built and update credit ledgers accounting for the project. The maintenance and monitoring period has commenced and will continue for 5 growing seasons or until final review and project release. The Flat Swamp Neuse and Nutrient Offset Buffer Restoration Project is on a successful trajectory following the second-year annual vegetation maintenance and monitoring. Average tree density for the entire project based on thirty eight (38) one (1)-are plots is 710 trees/ac. The project target goal is 320 trees/ac. at the end of 5 years. Vegetation data show vigorous growth during the second year in both height (4.7 ft. avg) and basal diameter (.95 in. avg) indicative of excellent growing conditions and maintenance of planted trees. Late season herbaceous control was necessary again in 2010. No additional herbaceous control is foreseen for subsequent years following the 2nd monitoring year. The purpose of the Bank Parcel is to improve water quality through the restoration of riparian and non-riparian buffers as proposed in the Bank Parcel Development Package (GV, 2009) and supporting documentation. The Flat Swamp watershed has been extensively impacted by clearing, ditching, ongoing agricultural practices and road building over the past 100 years. These activities have obliterated many of the historical stream and wetland systems, including the riparian and non-riparian wetlands, as well as small coastal plain zero, first and second order streams that once flowed to the Neuse River. The site is in the upper reaches of the Flat Swamp Creek watershed and therefore has a large influence on the water quality and habitat in Flat Swamp Creek, Core Creek, and ultimately the Neuse River. The primary objective is to establish Nutrient Offset and Neuse Buffer credits, provide mitigation for Neuse Buffer and Neuse Nutrient offset payments within the Neuse River Basin, and/or to sell resulting credits to third parties public or private. The FSB is located in the North Carolina Division of Water Quality (NCDWQ) sub-basin 03-04-08 of the Neuse River Basin. More specifically, the site is located within US Geologic Survey (USGS) 8-digit hydrologic unit code (HUC) 03020202 and 14- digit HUC 03020202080020. Flat Swamp creek originates approximately 3.2 miles southwest of Fort Barnwell and 4.5 miles northeast of Dover in Craven County, North Carolina. As of the end of the second growing season (2010) for the Flat Swamp Neuse and Nutrient Offset Buffer Restoration Project, annual monitoring is complete of the nearly 250K bare root tree seedlings planted on a 7x10 spacing (-622 trees/ac) consisting of character species proposed in the BPDP (2009). The second growing season has resulted in continued rapid growth of a healthy and vigorous stand of character trees. According to second year vegetation plot data from thirty eight (38) one (1)-are plots tree survival is between 14 and 22 trees/1-are equating to 567 to 891 trees/ac (91-100% survival). The average survival for all character trees 710 trees/ac. And the average diameter and height is 24.2 mm (.95 in) and 143.9 cm (4.7 ft) respectively across all character species. The project target goal is 320 trees/ac at the end of 5 years and therefore the project has met success criteria again for the second monitoring year within each plot and overall. First and second year vegetation data shows there has been significant leaf and stem growth establishing that the buffer restoration was successful during the critical period following construction and after the second year during heavy competition from herbaceous plants. Continued monitoring of the site shows additional leaf and stem growth late into the growing season thus improving chances for survival and rapid growth for subsequent years. The purpose of the Bank Parcel is to improve water quality through the restoration of riparian and non-riparian buffers as proposed in the Flat Swamp Mitigation Bank Parcel Development Package (GV, 2009) and supporting documentation. The Bank Parcel is located in North Carolina Division of Water Quality (NCDWQ) sub-basin 03-04-08 of the Neuse River Basin. Flat Swamp Creek is a tributary of the Neuse River and flows east from the site intersecting Core Creek before emptying into the south side of the Neuse River. The FSB is located in the headwaters of Flat Swamp Creek (Latitude 35 degrees 15 minutes 10.96 seconds N and Longitude 77 degrees 22 minutes 04.05 seconds E). The site is bounded by Dover Fort Barnwell Road (SR 1262) to the north and west, Jonestown Road (SR 1258) and Camp Oak Road (SR 1261) to the east, and Dover Bay to the south (Appendix L Figure 1). A Bank Parcel Development Package (GreenVest, 2009) and Neuse River Riparian Buffer and Nutrient Offset Mitigation Banking Instrument were completed and executed by NCDWQ for the Bank Parcel in 2009. Riparian headwater system improvement is accomplished through the restoration of forested buffers along jurisdictional streams and watercourses draining to jurisdictional streams. Restoration of the riparian and non-riparian areas using strategic vegetation planting practices provides stream bank stability, stream shading, water quality improvements through nutrient uptake and sediment filtering, as well as providing wildlife habitat. These riparian buffers will be restored by planting appropriate native species of trees, shrubs, and herbaceous vegetation in zones specific to landscape position, topography and hydrology. Monitoring of vegetation will occur for a minimum of five (5) years following the first full growing season, describing the conditions of each Bank parcel and relating those conditions to the success criteria. Reports will be submitted annually to the Division of Water Quality and shall contain the following: 1) A U.S. Geological Survey map showing the location of the Bank; 2) A detailed narrative summarizing the condition of the Bank and all regular maintenance activities; 3) Appropriate topographic maps showing location of sampling plots, permanent photo points, location of transects, etc.; 4) Monitoring data, including specific vegetative counts and photographs; and 5) A copy of the Bank credit/debit ledger Stem counts will be conducted within strategically placed 10m x 10m plots (.0247 ac). When choosing the location for each plot, the primary goal will be to obtain a representative sample of the entire area of disturbance. Therefore, plots will be scattered throughout the project and will attempt to capture all habitat and vegetation density variations. The quantity of monitoring plots was determined in accordance with The Carolina Vegetative Sampling Protocol (Levels I & II), such that no more than two (2) percent of any one Parcel is encompassed in monitoring plots. This analysis equated to thirty-eight (38) monitoring plots distributed across the 306.25 acre buffer restoration area (Figure 2). 2.1.1 Vegetation Success Criteria Vegetation success will be based on tree survivability over a five year monitoring period. Success will be measured by density and growth of character tree species as defined by the Guidelines for Riparian Buffer Restoration prepared by the North Carolina Ecosystem Enhancement Program. "Character Trees" are defined as planted or volunteer species identified from a survey of local vegetation on less degraded sections of the specified reference site and from reference literature such as Classification of the Natural Communities of North Carolina (Schafale and Weakley, 1990) that details native species. "Characteristic Tree Species" include, but is not limited, to species listed in Table 1. Survivability will be based on achieving at least 320 stems (Character Trees) per acre after five years. Planted species must account for a minimum of 30 percent of the above densities. Natural regeneration of species from adjacent forested communities will occur and can be counted in the overall stem counts provided they are native hardwood tree or Character Tree species. A survey of vegetation at the end of each year's growing season (October/November) will be conducted annually over the five year monitoring period in order to verify survivability of the installed plantings. This survey will track the total mortality on an annual basis and be used to calculate survivability at the end of five years. Baseline data was collected for the planted vegetation following installation and routine site inspections were performed throughout the first growing season in 2009. This was completed to insure planted trees were growing well with minimal competition and/or destructive predation. Periodic inspections will continue throughout the monitoring period to insure restoration success. 4 Flat Swamp Mitigation Bank GreenVest/Flat Swamp, LLC Neuse & Nutrient Offset Buffer Restoration Parcel Annual Monitoring Report Year 2 - 2010 Survivability of less than 320 stems per acre at the end of the five year monitoring period may require the installation of additional plantings as replacement for the mortality as approved by NCDWQ. Additionally, visual observations of herbaceous cover and/or competition, invasive species, and herbivore predation will occur during the maintenance and monitoring period of the project and corrective measures to address mortality problems will be implemented as approved by NCDWQ. Visual observations are recorded via permanent photo locations located at each vegetation plot origin and are included in Appendix A. Some herbaceous competition continues to be present from morning glory within some plots central to the site. However, tree growth is vigorous and should out-compete the annual growth from this species. As part of the BPDP, woody invasive competition and other species competing with character trees will be monitored and controlled if necessary. Deer browsing is minimal considering the location of the project and population of deer. Most browsing and damage has occurred in the southern portion of the site. Deer are actively hunted on the site and browsing should not affect the long-term health of the restoration areas.
