Dear Messrs. Chapin and McMillan:
On behalf of our client, Woolpert, Inc. (Woolpert) and the project applicant, Charlotte
Mecklenburg Utilities (CMU), S&ME, Inc. (S&ME) would like to thank you for your
recent review and approval, with conditions, of the Bank Stabilization Installation and
Additional Stream Crossing submittal provided to you on December 15, 2010. Your
review determined that the proposed bank stabilization and additional crossing could be
included under the current authorization of Nationwide Permit (NWP) No. 12 and the
corresponding North Carolina Division of Water Quality Certification (WQC) No. 3819
(formerly, 3699) for the Reedy Creek Interceptor Project, referenced above. However,
DWQ also stated that the impacts are not authorized until the standard processing fee
$570.00 is provided. S&ME contacted the DWQ and the USACE to clarify whether an
additional small wetland impact associated with construction of an access road and
placement of a permanent culvert (approximately 0.001 acre of Wetland 1) could also be
included in the submittal. Based on our telephone conversations, you agreed that the
additional wetland impact could be included in this submittal, along with the
aforementioned processing fee. We have attached a map of the additional impact to
Wetland 1 for your files.

On December 17, 2010 the Division of Water Quality (DWQ) received correspondence seeking
modification to the above reference project. The DWQ has determined that your application was
incomplete and/or provided inaccurate information as discussed below.
Additional Information Requested:
The request for modification to the already issued 401 will require a permitting fee of $570
made payable to Division of Water Quality (DWQ).
Please submit this information within 30 calendar days of the date of this letter. If you will not be able to
provide the requested information within that timeframe, please provide written confirmation that you
intend to provide the requested information, and include a specific timetable delineating when the
requested materials will be provided. If we do not hear from you in 30 calendar days, we will assume that
you no longer want to pursue this project and we will consider the project as returned. Please be aware
that any impacts requested within your application are not authorized (at this time) by the DWQ. Please
