Sullins Dee Freeman Governor Director Secretary October 22, 2009 CERTIFIED MAIL - RETURN RECEIPT REQUESTED Eric Keravuori, Director of Engineering Town of Wake Forest 4011 Elm Avenue Wake Forest, NC 27587 Subject: Proposed Northside Loop and Juniper Road Realignment in Wake County, DWQ Project Number 20091109 Dear Mr. Keravuori: The NC Division of Water Quality has reviewed your submittal for a 401 Water Quality Certification and Neuse Buffer Authorization for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: 1. As per General Certification 3704, condition 10, compensatory mitigation for 185 feet of impacts to Hatters Branch (sites 4 plus 5) is required for this project. Please provide a compensatory mitigation plan to conform to the requirements of 15A NCAC 2H.0500. 2. Please provide a stormwater management plan for this project, showing all proposed inlets and outlets for the entire project. a) Northside Loop drainage areas B, D, E, and F have level spreaders. How is stormwater from drainage areas A and C being treated? b) Also, how is stormwater for the new impervious surface on Juniper Road being handled? (Are there discharge points at sites 2, 3, and 4?) c) Please make sure plans include stationing for sites, inlets and outlets. 3. Please provide a Required Items Checklist with all required items for every proposed level spreader. The Required Items Checklist and many of the required items were omitted for Level Spreaders B, D, E, and F. 4. The filter strip down slope of Level Spreader B is too steep per Chapter 8 of the DWQ BMP Manual. The elevations listed in the Level Spreader Supplement Form do not match the topographic lines on the plans. The DWQ recommends that this level spreader be relocated to a location closer to the roadway where the topography of the site is much flatter. 5. The filter strip down slope of Level Spreader D contains a draw and is too steep per Chapter 8 of the DWQ BMP Manual. The DWQ recommends that this level spreader be relocated so that it is at least 30 feet from the draw (along its entire length). Then, a 30-foot filter strip with a slope of six percent or less could be graded and sodded to meet diffuse flow requirements. The graded area must be completely outside the protected riparian buffer. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
