Subject: Withdrawal Notice - Astoria at Hope Mills
Hi Scott,
At this time, I am withdrawing your application from the Express Program, and the pre-application meeting scheduled
for tomorrow 1/20/11 has been cancelled. As I informed you in my previous email, you may submit your complete
stormwater management plan for approval via the regular program at no cost. However, please bear in mind that your
client is not authorized to impact any waters or wetlands until you meet all conditions of the applicable Water Quality
General Certification. Any unauthorized impact would be a violation of the GC.
If you decide to use the Express Review Program, please resubmit your initial interest for acceptance into the program
which is always based on the number of projects in the program and staff availability at that time. A copy of your email
and my response would placed on file to serve as your request for withdrawal and subsequent withdrawal notice to you.
If you have any questions, please let me or Lia know. Thanks.

Based on the email below, I don't think that we are required to get approval from your section. We have an
approved storm water plan from NCDENR DWQ for this project. Considering the fact that we do have a State
Stormwater Permit that meets the Phase II requirements for our project, we should probably cancel our
scheduled meeting for Thursday.
Please note however that in order to meet the Water Quality Certification 3821 Condition #12 along with the
Protocol for 401 SMP Approval & Implementation, we intend to submit a copy of our State Stormwater Permit
Approval to the 401 Oversight/Express Unit for their files.

Hi Scott,
Just came in today and now getting to respond to emails. Both the 401/Wetlands Permitting Unit and the Stormwater
Unit are in the same Branch of the same Section of DWQ (just to confuse you more).
Now, the stormwater unit issues a stormwater permit which is a stand-alone permit with specific duration (5 or 10
years). Our unit (401 & Wetlands) issues a stormwater management plan (SMP) approval as a condition of a 401 Water
Quality Certification. So our approval is attached to the 401 Certification which in turn runs with the 404 Nationwide
permit issued by the Corps. So if there's no stream or wetlands impact, and you need DWQ SMP Permit, you don't come
to us but you deal with the other unit.
Where there are stream impacts and other state stormwater program in place (eg phase II, etc), the 401 unit has a
duplicity of effort policy, that is, to accept stormwater plans approved by other DWQ stormwater programs or a certified
local government. And so you can get your permit approved through them and then submit copies of the approved SMP
to us to meet the condition of your certification.
Since we are the same DWQ but different Units, we basically have almost the same requirements and therefore ask for
the same information. I hope this helps. I hope to see on Thursday Jan. 20 @ 10am for the pre-application meeting for

Subject: storm water approval vs. storm water plan
What is the difference between getting a storm water permit from the storm water permitting division vs. getting the storm
water management plan approved by your division. Both applications are asking for the same data. It seems like a repeat
of everything that we have to do for the storm water permitting division.
