This project is located in Charlotte, North Carolina, just east of downtown along an unnamed tributary to Little Sugar Creek (Project Vicinity Map, enclosed). This project proposes to improve the storm drainage infrastructure (i.e., pipe systems and culverts) to reduce flooding and to enhance degraded stream reaches to reduce erosion and improve water quality. Existing Conditions The main project corridor is generally located along Hawthorne Lane and consists of several land uses. The current land use for the northern half of the project area is mostly residential with maintained lawns and small adjacent wooded areas. There is also a school with surrounding ball fields. The southern half of the project area consists of industrial and commercial land uses and includes a rail line. According to the NRCS Soil Survey of Mecklenburg County (2002), on-site soils are dominated by Mecklenburg- Urban land complex (MkB) for the northern half of the project area and Urban land (Ur) for the southern half of the project area. There are also small inclusions of Monacan soils and Arents (MS), Helena sandy loam (HeB), and Cecil-Urban land complex (CuB) (MRCS Soil Survey Map, enclosed). Fourth 1 Floor NC 28 28202--2844 Services - Jurisdictional Determination A jurisdictional determination request was submitted by CMSWS to the U.S. Army Corps of Engineers (USACE) on June 21, 2010. On June 15, 2010, representatives from the USACE, the N.C. Division of Water Quality (NCDWQ), CMSWS, and Baker Engineering met on-site to verify the jurisdictional determination and discuss the project's permitting and mitigation requirements (Minutes, enclosed). Attendees included Amanda Jones of the USACE, Alan Johnson'of the NCDWQ, Isaac Hinson of CMSWS, and Chris Yow of Baker Engineering. Per the field investigation, several stream jurisdictional determinations were changed and a revised Existing Conditions/Jurisdictional Determination map was submitted to the USACE for verification on July 27, 2010. No verification was ever issued, however, the enclosed Existing Conditions Map reflects the USACE's field-verified determination. The on-site streams are unnamed tributaries to Little Sugar Creek and are located in the Catawba River Basin (HU# 03050103). Little Sugar Creek is classified as "Class C" by the NCDWQ: The Mainstem Stream is a perennial relatively permanent water (RPW) that flows parallel and west of Hawthorne Lane for approximately 230 linear feet, enters a pipe system, discharges downstream of the CSX railroad crossing, then flows approximately 2,700 linear feet to its confluence with Little Sugar Creek. Tributary 1 emanates at a channel headcut as an intermittent Non-RPW. Tributary 1 becomes a perennial RPW approximately 135 linear feet downstream of its origin, flows east through the project area for approximately 620 linear feet, then enters a pipe system that goes under Hawthorne Lane and convenes with the Mainstem within the pipe system. These are the only on-site jurisdictional features and are illustrated on the enclosed Existing Conditions Map. The conditions of these streams were documented in the Jurisdictional Determination Request and were reviewed/verified during the June 15, 2010 field visit (Minutes enclosed). Photographs of these on-site jurisdictional features are enclosed. Agency Correspondence Cultural Resources A letter was forwarded to the North Carolina State Historic Preservation Office (SHPO) on November 19, 2010 to determine the presence of any areas of architectural, historic, or archaeological significance that would be affected by the project. As of the date of this submittal, a response from SHPO has not been received. A search of the Charlotte- Mecklenburg Historic Landmarks Commission list of designated historic landmarks revealed no historic properties that would be affected by the project. Due to the nature of the project, land-disturbing activities will predominantly occur within railroad and road right-of-ways and within existing drainage features. As such, potential impacts to any areas of architectural, historic, or archaeological significance are unlikely. Protected Species A letter was forwarded to the North Carolina Natural Heritage Program (NCNHP) on November 19, 2010 to determine the presence of any federally-listed, candidate endangered, threatened species or critical habitat within the project area. Fourth St., 14th Floor r WATER Charlotte, NC 28202-2844 Services species, significant natural communities, significant natural heritage areas, or conservation/managed areas at the site nor within 0.2 mile of the project area. NCNHP's records show a colonial wading bird colony (heronry) located about 0.2 mile to the east of the eastern end of the project, but it would not be impacted by the project. The project area is comprised of residential, institutional, and industrial development with small forested areas. Undeveloped wooded areas and stream-side zones are dominated by invasive plant species, so the occurrence of any federally-listed, candidate endangered, threatened species of critical habitat is unlikely. A copy of this Pre-Construction Notification is being submitted to the U.S. Fish and Wildlife Service for additional concurrence. Purpose and Need for the Project The purpose of this project is to alleviate flooding and enhance degraded stream segments within the project area. The existing storm drainage infrastructure is aging and in disrepair and consequently is insufficient for conveying design storm flows. As a result, structure and road flooding are frequent occurrences. Furthermore, as documented in a detailed stability and geomorphic analysis (available upon request), and as agreed upon by the USACE and NCDWQ during field reviews on October 31, 2008 and June 15, 2010 (Minutes enclosed), the downstream reach of the project area is degraded and in need of enhancement. In general, indicators of stream impairment consist of vertical and moderately eroding banks, over-widened channel dimensions, lack of floodplain access, and prevalence of invasive species (mostly kudzu) along the channel. Representative photographs of the degraded stream reaches are enclosed (Photos 7-12). Proposed Impacts to Jurisdictional Waters This proposed project consists of pipe system upgrades and stream enhancement activities, which are necessary to meet the flood control and water quality goals of the project. Proposed impacts are to perennial RPW streams and include pipe extension, placement of plunge pools and rip rap energy dissipaters, longitudinal channel adjustments to accommodate pipe system upgrades, and stream enhancement activities. Proposed project impacts are illustrated in the Louise Avenue CIP Construction Plans (enclosed) and are summarized in Table 1. Additional project impact details are provided below. Table 1. Charlotte, Fourth St., 142 Floor NC 28202-2844 Services r The proposed pipe extension on Sheet 3 is required to meet CSX's rail line loading requirements. The proposed extension plus the plunge pool energy dissipater at the outfall will result in 105 linear feet of permanent stream impacts. The step-pool sequence within Tributary 1 on Sheet 6 is necessary to provide a stable and relatively natural transition into the upgraded downstream pipe system. Temporary impacts from the proposed step-pool sequence total 56 linear feet. The Perennial Mainstem channel segment located along Hawthorne Lane (Sheets 6 and 7) will be enhanced to remove blockages, eliminate erosion, provide a heterogeneous channel bottom, and alleviate flooding. In order to provide a stable left bank slope and avoid conflicts with Hawthorne Lane, the enhanced channel will be slightly shifted to the west. Temporary impacts from stream enhancement activities along this reach will total 177 linear feet. This does not include permanent impacts from a proposed rip rap apron (12 linear feet) and plunge pool (39 linear feet), both of which are associated with storm drain infrastructure maintenance along this same channel reach. The remaining temporary impacts total 709 linear feet and will result from the enhancement of degraded reaches of the Mainstem channel located downstream of the CSX railroad crossing, as illustrated on Sheets P1 and P2. All enhanced stream segments will be stabilized with biodegradable coir matting and bioengineering measures. In accordance with two previous on-site meetings with the USACE and NCDWQ (Minutes enclosed), these reaches will provide mitigation for other on-site permanent impacts. In accordance with Nationwide Permit General Condition No. 27, CMSWS is submitting a Pre-Construction Notification pursuant to Nationwide Permit Nos. 3 and 27 (enclosed). Avoidance and Minimization After multiple plan revisions, impacts to on-site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable. The plunge pool at the outlet of the extended pipe (Sheet 3) is necessary to dissipate energy from flows exiting the pipe and to protect the proposed downstream enhancement reaches. This plunge pool and the one at the pipe outlet on Sheet 7 are proposed in lieu of rip rap aprons to minimize the linear feet of permanent stream impacts at these locations. In addition, natural channel design principles are incorporated into the proposed enhancement activities on Sheets 6, 7, P1, and P2. This should result in the functional lift of these currently degraded channel segments. In response to comments from the June 15, 2010 field meeting (Minutes enclosed), the step-pool sequence within Tributary 1 on Sheet 6 (detail on Sheet 2R) has been modified from the previous plan submittal to eliminate rip rap from between each cross-vane and to decrease the dimensions of each vane to maintain the approximate 4- foot channel cross-section. Additional design revisions from the previous plan submittal are proposed for the Mainstem Stream located along Hawthorne Lane on Sheets 6 and 7. Changes include removal of rock toe protection along the entire reach and the incorporation of in-stream structures to enhance stability and in-stream habitat. Previous plan sheet iterations that depict the greater impacts and thereby demonstrate avoidance and minimization are available upon request. Fourth St., 141h Floor , WATE R Charlotte, NC 28202-2844 Services Compensatory Mitigation Within the past four years, three other City of Charlotte projects resulting in permanent loss of Waters of the U.S. have been permitted along the same 5,000 linear-foot contiguous stream reach as the Louise Avenue CIP (Project Area Map, enclosed). These projects were: 1. Louise Avenue Culvert Replacement USACE Action ID 2006-41402-361, DWQ notification not required 2. Solid Waste Services (SWS) - Otts Street Facility USACE Action ID 2008-1585, DWQ notification not required 3. Seigle Avenue Culvert Replacement USACE Action ID 2009-00680, DWQ# 09-0362 While none of these individual projects required compensatory mitigation for permanent stream impacts, it was determined during an October 31, 2008 field review with the Interagency Review Team (IRT) that, due to their proximity, the total impacts from these three projects and the proposed Louise Avenue CIP would have to be cumulatively mitigated (Minutes enclosed). Cumulative permanent impacts that are subject to mitigation requirements are outlined in Table 2. Table 2. It was further determined that temporary impacts, as indicated in Table 1, will not require mitigation. The locations of the previous projects and the Louise Avenue CIP, including the proposed on-site mitigation reaches, are illustrated in the enclosed Project Area Map. Mitigation Reach 1 is approximately 298 linear feet and begins at the CSX railroad crossing before terminating at the Louise Avenue road crossing (Sheet P1). Mitigation Reach 2 begins downstream of the Louise Avenue road crossing and extends downstream for approximately 411 linear feet (Sheet P2). The on-site mitigation reaches total 709 linear feet. Given the approved 1:1 mitigation ratio, this is more than enough to offset the 420 linear feet of cumulative permanent impacts. The on-site compensatory mitigation reaches will be built concurrently with the proposed Louise Avenue CIP. As documented in a detailed stability and geomorphic analyses, and as agreed upon by the IRT during the October 31, 2008 field review (Minutes enclosed), these mitigation reaches are degraded and if enhanced, have the potential to provide functional uplift. In general, indicators of stream impairment consist of vertical and moderately eroding banks, over-widened channel dimensions, lack of floodplain access, and prevalence of invasive species (mostly kudzu) along the channel. Representative photographs of the mitigation reaches are enclosed (Photos 7-12). A detailed report documenting stability and geomorphic assessments along with design rationale for the proposed mitigation reaches is available upon request. Due to lateral site constraints and the inability to restore pattern to these reaches, CMSWS proposes to use a priority III restoration approach to construct a Rosgen 134c stream type mitigation reaches. These improvements are consistent with Enhancement I as defined in the North Carolina Stream Mitigation Guidelines (2003 interagency guidance document). Sheets P1 and P2 illustrate the plan and profile views for proposed Mitigation Reaches 1 and 2. These sheets are supplemented by details (Sheets D1-D5), typical cross-section drawings (Sheet XS 1), and landscape plans (Sheets LP3 and LP4). In general, enhancement measures will include dimension and profile improvements; installation of various in-stream habitat structures and riffle-pool sequences; bank stabilization using biodegradable mesh and native riparian vegetation; and riparian buffer restoration, including invasive plant eradication and native plant establishment. Native plant establishment areas and the associated planting plans are depicted on Sheets LP3 and LP4. Invasive/exotic species will be controlled along these mitigation reaches. This mitigation narrative provides a summary of the proposed on-site mitigation plan. A detailed Mitigation Plan narrative that includes performance standards, site protection measures, contingency plan, monitoring and long-term management, and financial assurances is enclosed. Additional impacts will result from the installation of rip rap aprons and plunge pools to dissipate erosive forces exiting the newly upgraded infrastructure. Activities and associated impacts to jurisdictional waters are depicted in the enclosed Louise Avenue CIP Construction Plans. A detailed narrative describing the proposed impacts to Waters of the U.S. is provided in the attached Cover Letter. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. After multiple plan revisions, impacts to on-site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable. The plunge pool at the outlet of the extended pipe (Sheet 3) is necessary to dissipate energy from flows exiting the pipe and to protect the proposed downstream enhancement reaches. This plunge pool and the one at the pipe outlet on Sheet 7 are proposed in lieu of rip rap aprons to minimize the linear feet of permanent stream impacts at these locations. In addition, natural channel design principles are incorporated into the proposed enhancement activities on Sheets 6, 7, P1, and P2. This should result in the functional lift of these currently degraded channel segments. In response to comments from the June 15, 2010 field meeting (Minutes enclosed), the step-pool sequence within Tributary 1 on Sheet 6 (detail on Sheet 2R) has been modified from the previous plan submittal to eliminate rip rap from between each cross-vane and to decrease the dimensions of each vane to maintain the approximate 4-foot channel cross-section. Additional design revisions from the previous plan submittal are proposed for the Mainstem Stream located along Hawthorne Lane on Sheets 6 and 7. Changes include removal of rock toe protection along the entire reach and the incorporation of in-stream structures to enhance stability and in-stream habitat. Previous plan sheet iterations that depict the greater impacts and thereby demonstrate avoidance and minimization are available upon request. 1 b. Within the past four years, three other City of Charlotte projects resulting in permanent loss of Waters of the U.S. have been permitted along the same 5,000 linear-foot contiguous stream reach as the Louise Avenue CIP (Project Area Map, enclosed). Solid Waste Services (SWS) - Otts Street Facility USACE Action ID 2008-1585, DWQ notification not required 3. Seigle Avenue Culvert Replacement USACE Action ID 2009-00680, DWQ# 09-0362 While none of these individual projects required compensatory mitigation for permanent stream impacts, it was determined during an October 31, 2008 field review with the Interagency Review Team (IRT) that, due to their proximity, the total impacts from these three projects and the proposed Louise Avenue CIP would have to be cumulatively mitigated (Minutes enclosed). Cumulative permanent impacts that are subject to mitigation requirements are outlined in Table 2 of the attached Cover Letter. It was agreed upon during the June 15, 2010 field meeting (Minutes enclosed) that these would be the mitigation- requiring impacts and that the on-site mitigation measures (described below) would be sufficient to provide 1:1 mitigation for the cumulative permanent impacts. It was further determined that temporary impacts, as indicated in Table 1, will not require mitigation. The locations of the previous projects and the Louise Avenue CIP, including the proposed on-site mitigation reaches, are illustrated in the enclosed Project Area Map. The on-site mitigation strategy consists of enhancing two reaches (Mitigation Reaches 1 and 2, Plan Sheets P1 and P2 of Construction Plans, enclosed) of the Mainstem Perennial Stream. Mitigation Reach 1 is approximately 298 linear feet and begins at the CSX railroad crossing before terminating at the Louise Avenue road crossing (Sheet P1). Mitigation Reach 2 begins downstream of the Louise Avenue road crossing and extends downstream for approximately 411 linear feet (Sheet P2). The on-site mitigation reaches total 709 linear feet. Given the approved 1:1 mitigation ratio, this is more than enough to offset the 420 linear feet of cumulative permanent impacts. The on-site compensatory mitigation reaches will be built concurrently with the proposed Louise Avenue CIP. As documented in a detailed stability and geomorphic analyses, and as agreed upon by the IRT during the October 31, 2008 field review (Minutes enclosed), these mitigation reaches are degraded and if enhanced, have the potential to provide functional uplift. In general, indicators of stream impairment consist of vertical and moderately eroding banks, over-widened channel dimensions, lack of floodplain access, and prevalence of invasive species (mostly kudzu) along the channel. Representative photographs of the mitigation reaches are enclosed (Photos 7-12). A detailed report documenting stability and geomorphic assessments along with design rationale for the proposed mitigation reaches is available upon request. Due to lateral site constraints and the inability to restore pattern to these reaches, CMSWS proposes to use a priority I I I restoration approach to construct a Rosgen 64c stream type mitigation reaches. These improvements are consistent with Enhancement I as defined in the North Carolina Stream Mitigation Guidelines (2003 interagency guidance document). Sheets P1 and P2 illustrate the plan and profile views for proposed Mitigation Reaches 1 and 2. These sheets are supplemented by details (Sheets D1-D5), typical cross-section drawings (Sheet XS1), and landscape plans (Sheets LP3 and LP4). In general, enhancement measures will include dimension and profile improvements; installation of various in- stream habitat structures and riffle-pool sequences; bank stabilization using biodegradable mesh and native riparian vegetation; and riparian buffer restoration, including invasive plant eradication and native plant establishment. Native plant establishment areas and the associated planting plans are depicted on Sheets LP3 and LP4. Invasive/exotic species will be controlled along these mitigation reaches. This mitigation narrative provides a summary of the proposed on-site mitigation plan. The project area is comprised of residential, institutional, and industrial development with small forested areas. Undeveloped wooded areas and stream-side zones are dominated by invasive plant species, so the occurrence of any federally-listed, candidate endangered, threatened species of critical habitat is unlikely. The original Baker assessment report recommended approximately 420 LF of priority 11 restoration and 200 LF of enhancement. The general consensus from Alan Johnson of DWQ and Amanda Jones of USACE (collectively known as the MBRT) was that the reach was fairly stable, although with invasive vegetation and gabion baskets, and that less priority II restoration should be constructed and more enhancement. The MBRT agreed that invasive vegetation removal, native vegetation planting, and selective bank stabilization/profile enhancement would be appropriate stream improvements for this reach. ? Reach 2 was examined next at the upstream end from Louise Avenue. Baker proposed 275 LF of priority II stream restoration and selective bank stabilization, invasive vegetation removal, and planting for approximately 900 LF. The MBRT agreed that this reach looked more impaired and the stream improvements proposed by Baker would provide adequate "functional uplift". ? Reach 1 was then examined and the MBRT agreed with Baker's restoration approach, which includes 396 LF of priority II stream restoration. Similar to Reach 2 the MBRT concluded that the stream improvements were justified by the potential "functional uplift" of this reach. ? It is Baker's conclusion following the meeting that less stream mitigation credit will be approved by the MBRT than was approximated in the Louise Avenue Geomorphic Report (November 2006). However, the MBRT stated that since the project is not for mitigation banking and for on-site mitigation, they would be less critical with the mitigation (on-site) credit proposal. Within the past four years, three other City of Charlotte projects resulting in permanent loss of Waters of the U.S. have been permitted along this contiguous stream reach. These projects were: 1. Louise Avenue Culvert Replacement USACE Action ID 2006-41402-361, DWQ notification not required 2. Solid Waste Services (SWS) - Otts Street Facility USACE Action ID 2008-1585, DWQ notification not required 3. Seigle Avenue Culvert Replacement USACE Action ID 2009-00680, DWQ# 09-0362 While none of these individual projects required compensatory mitigation for permanent stream impacts, it was determined during an October 31, 2008 field review with the Interagency Review Team (IRT) that, due to their proximity, the total impacts from these three projects and the future Louise Avenue CIP would have to be cumulatively mitigated. Cumulative Impacts As summarized in Table 1, previous and proposed cumulative permanent stream impacts total 420 linear feet. Activities that are considered permanent impacts and that require mitigation consist of installation or extension of culverts and the installation of rip rap aprons or plunge pools. Table 1. Fourth St , 142 Floor NC 28202-2844 Services Compensatory Mitigation Reaches The current mitigation strategy consists of enhancing two reaches, Mitigation Reaches 1 and 2, of the main on-site perennial tributary. Mitigation Reach 1 is approximately 298 linear feet and begins at the CSX railroad crossing before terminating at the Louise Avenue road crossing. Mitigation Reach 2 begins downstream of the Louise Avenue road crossing and extends downstream for approximately 411 linear feet. As documented in the detailed stability and geomorphic analyses, and as agreed upon by the IRT during the October 31, 2008 field review, these mitigation reaches are degraded and if enhanced, have the potential to provide functional uplift. In general, indicators of stream impairment consist of vertical and moderately eroding banks, over-widened channel dimensions, lack of floodplain access, and prevalence of invasive species (mostly kudzu) along the channel. A detailed report documenting stability and geomorphic assessments along with design rationale for the proposed mitigation reaches is available upon request. Goals and Obiectives Due to lateral site constraints and the inability to restore pattern to these reaches, CMSWS proposes to use a priority III restoration approach to construct a Rosgen 134c stream type mitigation reaches. These improvements are consistent with Enhancement I as defined in the North Carolina Stream Mitigation Guidelines (2003 interagency guidance document). The objective is to compensate for 420 linear feet of permanent stream impacts by enhancing 709 linear feet of stream located along the same contiguous reach of stream channel. It was agreed upon during a June 15, 2010 field meeting with the U.S. Army Corps of Engineers and N.C. Division of Water Quality that the on-site mitigation measures would be sufficient to provide 1:1 mitigation for the cumulative permanent impacts. Site Selection Mitigation Reaches 1 and 2 are located within the same contiguous 5,000 linear foot stream reach as the previous projects and the proposed Louise Avenue CIP. This on-site mitigation strategy should help to ensure the direct offset of the cumulative impacts, as well as allow for the construction of the mitigation reaches as part of the Louise Avenue CIP. Mitigation Work Plan The current construction plans of the proposed Louise Avenue CIP are enclosed with this submittal. Sheets P1 and P2 illustrate the plan and profile views for proposed Mitigation Reaches I and 2. These sheets are supplemented by details (Sheets D1-D5), typical cross-section drawings (Sheet XS I), and landscape plans (Sheets LP3 and LP4). In general, enhancement measures will include dimension and profile improvements; installation of various in-stream habitat structures and riffle-pool sequences; bank stabilization using biodegradable mesh and native riparian vegetation; and riparian buffer restoration, including invasive plant eradication and native plant establishment. Native plant establishment areas and the associated planting plans are depicted on Sheets LP3 and LP4. Subsequent treatments will be administered based on monitoring results and requirements. The on-site compensatory mitigation reaches will be built concurrently with the proposed Louise Avenue CIP. Performance Standards The mitigation reaches will be monitored for stability and vegetative success (see below for section on Monitoring and Long-term Management). Any areas of erosion, structure failure, or any other observed functional deficiency will be corrected in accordance with the plans per the contractor's warranty. Native vegetation will be installed during the first dormant season (October 15-March 15) during or following construction in accordance with the planting plan. The vegetation will also be monitored to ensure 85% survival of all individuals. Plant mortality that exceeds 15% will be replaced per the contractor's warranty and subsequent plantings will be monitored to ensure 100% survival. Proiect Success CMSWS will be responsible for ensuring compliance with the approved compensatory mitigation plan. Site Protection Since this is a City of Charlotte project and the mitigation reaches are located on City of Charlotte properties, the City cannot grant itself a conservation easement. Therefore, conservation declarations have been drafted, with the assistance of City Attorneys, to perpetually protect the compensatory mitigation reaches and their riparian buffers. Due to site constraints (i.e., sanitary sewer, parking lots, buildings, rail road), a 50-foot buffer on both sides of the channel is not feasible. Per the indicated "SDE" on Sheets P1 and P2 of the enclosed Construction Plans, the proposed conservation declarations along the mitigation reaches vary in width from approximately 25 feet to 60 feet, with an approximate average buffer width of 40 feet from top of bank. Contingency Plan In the event of unforeseen circumstances that prevent the suitability, construction, or maintenance of the proposed reaches to provide compensatory mitigation, the City of Charlotte Umbrella Stream and Wetland Mitigation Bank (Umbrella Bank) will be used to provide compensatory mitigation for cumulative permanent project impacts. Monitoring and Long-term Management Since this is proposed to be a self-mitigating project and will not generate mitigation bank credits, CMSWS proposes to perform one year of visual monitoring following earthwork and plant installation. Monitoring will consist of inspecting stream geomorphology, in-stream structures, and stability as well as monitoring vegetation within the buffer to ensure compliance with the stated performance standards (see above).
