3. Project Description
3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of
this application:
The subject property is currently unoccupied. Improvements include an abandoned two-story residential home, with
associated outbuildings and driveway. Two (2) public sewer easements transect the subject property in both the
central portion as well as in the southeastern corner. All other areas on the subject property are undeveloped and
forested.

3e. Explain the purpose of the proposed project:
The purpose of the proposed project is to construct a new high school to replace the existing high school, originally
built in 1956. The existing school has deteriorated over time and currently has significant ventilation issues as well
as mold. Based on the level of maintenance and repairs needed at the existing school, DPS has agreed to replace
the school entirely. Based on soil conditions and size of the original site, a new site for the school replacement
project was chosen.

Proposed development will consist of a new high school, athletic fields, track and stadium, parking areas and
stormwater management. Equipment typical for construction and grading will be used to construct the
proposed project such as track hoes, bulldozers, dump trucks, etc.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant requested a detailed delineation of streams and wetlands within the proposed project boundaries
prior to finalizing the plan to ensure the limitation of impacts of the natural environment. Following the delineation,
the proposed grading and disturbance limits were shifted in places to minimize impacts to the wetlands, streams
and buffers. The configuration of the tennis fields and baseball diamonds in this alternative allows for the multi-
purpose field to be located further west in avoidance of the river buffers on the east side of the site. Similarly, the
orientation of the stadium and competition field on the west side of the site have been shifted slightly from
previously assessed on -site alternatives, to further avoid buffer impacts.
1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction
techniques.
In order to prevent the potential for secondary impacts, all erosion and sedimentation control practices, including
the application of silt fences and erosion control matting, will be constructed and maintained according to the
standards and specifications of the current North Carolina Erosion and Sediment Control Planning and Design
Manual.
Prior to construction, the contractor will install watershed fencing to delineate approved working limits.
Temporary silt fencing, wattles and dewatering devices will be installed to treat runoff from the work
area. All impacted areas will be restored to the pre -construction conditions including stabilization of the slopes and
other disturbed areas. The contractor will maintain erosion and sedimentation control
measures until groundcover or vegetation is well established.

(G.S. 113A) Due to projected impacts on Jurisdictional Waters of the U.S., an Individual
Permit and associated Water Quality Certification are required by the USACE under Sections
401 and 404 of the US Clean Water Act. SEPI, Inc. is assisting DPS in preparing an Individual
Permit application and associated Statement of Findings -Environmental Assessment
(SOFEA) under USACE's NEPA Guidelines under 30 CFR 230. By default, approved NEPA
documents, such as the proposed SOFEA, automatically satisfy the requirements of SEPA
State NC Environmental Policy Act).

Hey Anna,
I conducted a site visit with you at the above referenced property on September 19, 2019 to verify the limits of any
potentially jurisdictional waters of the United States (WoUS) within the project area. I have determined that the
(revised) delineation map that you provided to me on September 23, 2019 entitled "Jurisdictional Features Map"
accurately depicts the limits of any potentially jurisdictional WoUS within the project area.
I will issue the Preliminary Jurisdictional Determination for this project in the order that it was received, but please note
that I have a substantial backlog of permits and JDs to work through at this time and it may take several months.
However, please note that delineation concurrence is more than sufficient for any required permitting under section
404 of the Clean Water Act.

Explanation: The streams)/pond(s) listed above has been located on the most recent published NRCS Soil Survey
of Durham County, North Carolina and/or the most recent copy of the USGS Topographic map at a 1:24,000 scale.
Each feature that is checked "Not Subject" has been determined to not be an intermittent stream, perennial stream, a
pond connected to a stream feature, or the feature is determined not to be present. Stream features that are checked
"Subject" have been located on the property and possess characteristics that qualify it to be subject to the buffer
rules. There may be other streams located on the property that do not show up on the maps referenced above and are
therefore not subject to the buffer rules. However, if the stream features are present on the tract they are subject to
all other applicable North Carolina stream standards and permitting requirements as outlined in 15A NCAC 0213,
and may be considered jurisdictional according to the US Army Corps of Engineers.
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected
parties that dispute a determination made by the DWR may request a determination by the Director. An
appeal request must be made within sixty (60) days of date of this letter. A request for a determination by the
Director shall be referred to the Director in writing. If sending via US Postal Service: c/o Karen Higgins;
DWR — 401 & Buffer Permitting Unit, 1617 Mail Service Center; Raleigh, NC 27699-1617. If sending via
delivery service (UPS, FedEx, etc.): Karen Higgins; DWR — 401 & Buffer Permitting Unit, 512 N. Salisbury

This determination is final and binding unless, as detailed above, an appeal is requested within sixty (60)
days. This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be
