Please reference your agent's November 1, 2010 request for a time extension of our
April 26, 2007 Department of the Army authorization to discharge fill material into 0.181 acre of
riparian wetlands adjacent to an upper tributary to Howe Creek. These impacts are associated
with the construction of the Helmsdale at Landfall residential development, located off
Arboretum Drive in the Landfall community, in Wilmington, New Hanover County, North
Carolina. Specifically, you are requesting to extend the expiration date for an additional three
(3) years.
After review of the request, we have determined that the time extension can be authorized
for two (2) years provided no deviation or other modifications have occurred from the original
operational plans. Your permit expiration date has been extended to December 31, 2012. Please
be reminded that all conditions of the original permit remain applicable. We are requesting, in
addition to these conditions, that as-built surveys of the authorized impact areas be provided to
our office within 30 days of completion of the project.
