On November 17, 20110, the Division of Water Quality (DWQ) received your Response to Notice of Violation NOV-
2010AVQ-0012 and application, both dated November 15, 2010, to till or otherwise impact 0.479 acres`of wetland, 349
!!near feet of perennial stream (75 linear feet of temporary impact and 274 linear feet of permanent impact) and 20,495
square feet of Zane I Neuse River basin protected riparian buffers and 21,607 square feet of /.one 2 reuse River basin
protected riparian buffers to construct the proposed regional shopping center at the site. The DWQ has determined that
your response and application were incomplete andr'or provided inaccurate information as discussed below. The'DWQ
will require additional information in order to process your application to impact protected wetlands and/or streams can the
subject property. Therefore. unless we receive five copies of the additional information requested below, we will have to
place this project on hold as incomplete until w-c received this additional information. If we do not receive the requested
in ormatton, your project will be faunally returned as incomplete. Please provide the following information so that we
may continue to review your project.
Additional Information Requested:
Items (4) and (9) of the NO%' Requested Response Items have not been satisfactorily addressed. The as-built plan
sheets must be full-sized (and at a scale of 1" = 20' or larger) with I' topographic lines, the stormwater drainage

completely filled out Level Spreader Supplement [orm with ALL required items.. (For example, no dimensions

Wetland A as shown on the plan. Please verity. Confirm that the drain valve in the riser structure of Wetland A
w ill be operational as designed and provide a timeframe.
4. Item (3) of the. NOV Requested Response items has not been satisfactorily addressed. The proposal states `.that a
notch be provided in the bed rock in order to lower the stream invert...'. Please demonstrate and provide a scaled
profile of the stream (at Crossing 1) and shoe how water a ill tlow through the culvert during; the 10 and 25 year
storm events based on full build-out conditions (completion of Phases 2l and 3). Provide headwater and tailwater
conditions for these storms a well.
5. Please describe how the notch will be installed in the bed rock. The proposal states. "The current accumulation of
sedunent w ithin the culvert will be removed and properly disposed ofpriorto notching the bedrock and only
natural sediment bed loads will subsequently pass through." Please add that the "current accumulation of
sediment and debris on the upstream end of the culvert will be removed and properly disposed of prior to notching
the bedrex k." To the monitoring, add "depth and extent ofsediment deposition, if any."
