Watts Kimley-Horn and Associates, Inc. 4651 Charlotte Park Drive Charlotte NC 28217 Subject Property: Shiloh Crossing Ut to Stirrup Iron Creek [030402, 27-33-4-2, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Watts: DWQ Project #04-1764 Ver. 4 Wake County On November 17, 2010, the Division of Water Quality (DWQ) received your Response to Notice of Violation NOV- 2010-WQ-0012 and application, both dated November 15, 2010, to fill or otherwise impact 0.479 acres of wetland, 349 linear feet of perennial stream (75 linear feet of temporary impact and 274 linear feet of permanent impact) and 20,495 square feet of Zone 1 Neuse River basin protected riparian buffers and 21,607 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed regional shopping center at the site. The DWQ has determined that your response and application were incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to place this project on hold as incomplete until we received this additional information. If we do not receive the requested information, your project will be formally returned as incomplete. Please provide the following information so that we may continue to review your project. Additional Information Requested: Items (4) and (9) of the NOV Requested Response Items have not been satisfactorily addressed. The as-built plan sheets must be full-sized (and at a scale of 1" = 20' or larger) with 1' topographic lines, the stormwater drainage system, building and road footprints, and all other relevant details for the DWQ's review. Please provide a completely filled out Level Spreader Supplement Form with ALL required items. (For example, no dimensions for the Level Spreader #4 by-pass were provided.) This form is available at: h!!p://portal.ncdenr.oriz/web/wq/ws/su/bMp-manual. In addition, complete documentation for the buffer authorization has not been provided. Please provide. 2. Item (5) of the NOV Requested Response Items has not been satisfactorily addressed. The plan sheets must be full- sized (and at a scale of 1" = 20' or larger) with 1' topographic lines, the stormwater drainage system, building and road footprints, footprints of the diffuse flow devices and all other relevant details for the DWQ's review. Please be sure to include details, when needed, for figures. Item (6) of the NOV Requested Response Items has not been satisfactorily addressed. The as-built plan sheets must be full-sized (and at a scale of 1" = 20' or larger) with V topographic lines, the stormwater drainage system, building and road footprints, and all other relevant details for the DWQ's review. Please provide a completely filled out Stormwater Wetland Supplement Form with ALL required items (the form that was provided is incomplete and does not include the Required Items Checklist). This form is available at: hLtp:Hportal.ncdenr.orgjweb/wg/ws/su/b!pp-manual. The DWQ assumes that you are extending the outlet pipe of Wetland A as shown on the plan. Please verify. Confirm that the drain valve in the riser structure of Wetland A will be operational as designed and provide a timeframe. 4. Item (3) of the NOV Requested Response Items has not been satisfactorily addressed. The proposal states "that a notch be provided in the bed rock in order to lower the stream invert..." Please demonstrate and provide a scaled profile of the stream (at Crossing #1) and show how water will flow through the culvert during the 10 and 25 year storm events based on full build-out conditions (completion of Phases 2 and 3). Provide headwater and tailwater conditions for these storms as well. 1;''leasedescribe lzo?v,xlie notch will be installed in the bed rock. The proposal states, "The current accumulation of sediment within the culvert will be removed and properly disposed of prior to notching the bedrock and only natt?ratsediment bed loads will subsequently pass through." Please add that the "current accumulation of sediment and debris on the upstream end of the culvert will be removed and properly disposed of prior to notching the bedroctk." To the, monitoring, add "depth and extent of sediment deposition, if any." Please submit this information within 30 calendar days of the date of this letter to: 401 Oversight/Express Review Permitting Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650 (hand deliveries only to Archdale Building 9`h Floor receptionist, Director's Office). If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
