The Municipal Unit of the Division of Water Resources has reviewed the extension request for the Headworks
Analysis (HWA) for the Town of Fairmont due to problems with the Town's courier and laboratory in 2020. This
request was received by the Division on January 6, 2021. The NPDES permit standard conditions in Part IV
Section D Item 4, this one-time extension has been approved and the new due date for the Headworks Analysis
(HWA) is November 30, 2021.
In order to compile a sufficient amount of data for the Headworks Analysis, the POTW shall sample quarterly
from January 2021 to October 2021. The four samples can be collected in the month of January 2021, then one
sample during the three following quarters (Feb -April, May -July, Aug -Oct). Please be aware that the Division of
Water resources may pursue further enforcement action if this issue continues to occur.
Regardless of this approval action today, within 180 days of the effective date of any reissued NPDES permit (or
any subsequent NPDES permit modification) the Permittee would be required to submit to the Division a written
technical evaluation of the need to revise local limits (i.e., an updated IWS, or documentation of why one is not
needed). This action may include revising, updating or adding to the list of Significant Industrial Users (SIU's).
Pursuant to 15A NCAC 02H .0907(b) either the Division or the permittee may initiate pretreatment program
revisions. Any additional conditions or requirements provided to the permittee related to pretreatment or
pretreatment program updates must be complied with separately from this approval action.
