Thank you for the e-mail you sent me earlier today in response to the subject notice of violation (NOV).
The information you provided shows the facility submitted the November 2007 discharge monitoring
report (DMR) in a timely manner, well within the regulatory time frame. Based upon this information,
the NOV has been retracted and its record has been removed from our data systems. The data you sent
will be entered into our compliance monitoring database.
I regret any inconvenience the NOV has caused. It is obvious this situation -arose as a result of the
mishandling of your DMR by State of North Carolina personnel. We will continue to investigate this
matter to try to find where mistakes occurred and will use the information to help ensure the same
mistakes are not repeated in the future.
