Sullins Dee Freeman Governor Director Secretary December 20, 2010 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Todd Whittington, President Lincolnton Hospitality, LLC 105 Rutledge Road Greenwood, South Carolina 29649 Subject Property: Hampton Inn Hotel DWQ #: 10-1043 Lincoln County Request for Information: POST-CONSTRUCTIONSTORMWATER MANAGEMENT PLAN Dear Mr. Whittington: On December 13, 2010, the Division of Water Quality (DWQ) received a set of approved Erosion and Sediment Control (E&SC) Plans and design calculations from Mr. Mitchell Baker, Sr. of MLB Engineering for review and approval as a post-construction Stormwater Management Plan (SMP) for your project. Please note that E&SC plan is different from post-construction SMP, and that the approved E&SC does not authorize you to place any fill in or otherwise impact a stream or wetland. Even though your impacts are under the threshold for a 401 Water Quality Certification, a SMP permit or approval is required before any impact could occur. Please be advised that, as of today, Lincoln County is not delegated by DWQ to review and approve SMPs. As a result, submit a complete SMP to DWQ for review within 15 days of the date of this letter since this would be permitted after-the-fact. Failure to comply with this SMP requirement will result in a recommendation to the Director of DWQ for notice of violation and subsequent enforcement action. You have the option of using the Express Review Program to expedite your permit application. All information about what you need to include in the submittal package and the Express Review process and fees can be found at httv://vortal.ncdenr.org/web/wq/swp/ws/401. Your selected stormwater best management practices (BMPs) shall treat the entire site and, at a minimum, achieve 85% TSS removal efficiency.
