Dear Mr.Vehaun:
On August 28, 2019,staff from the North Carolina Department of Environmental Quality(NCDEQ)
conducted a compliance audit of the Town of Woodfin's National Pollutant Discharge Elimination
System (NPDES) Municipal Separate Storm Sewer System (MS4) Permit.The audit resulted in
NCDEQ issuing a Notice of Violation (NOV-2019-PC-0638)to the Town on September 17, 2019. On
July 10, 2020,the Town was notified that certain response actions had not been satisfied and was
given an additional thirty days to submit the required materials.As of December 31, 2020 the
response actions required by NCDEQ have not been completed.
The Town of Woodfin is in violation of the following permit conditions:
1) Failure to Submit a Stormwater Management Plan
The permittee failed to submit a plan in response to notification from NCDEQ.

2) Failure to Submit Corrected Information
The permittee failed to submit corrected information within the timeline established by the
notification dated July 10, 2020. [Part IV, Item E]
3) Failure to Provide Information
The permittee failed to furnish information requested by NCDEQ to determine whether cause
exists for modifying, revoking and reissuing, or terminating coverage under the permit.

This Recommendation for Enforcement is being sent to the Director of the Division of Energy,
Mineral,&Land Resources. These violations and any future violations are subject to a civil
penalty assessment of up to$25,000 per day for each violation.Regardless of penalty
assessments, NCDEQ requires all violations to be properly resolved.Should you have any
