RIPARIAN BUFFER RESTORATION
AREA, CITY OF HIGH POINT, NC
THIS DECLARATION OF RESTRICTIVE COVENANTS FOR THE CEDROW
PARK RIPARIAN BUFFER RESTORATION AREA, High Point, NC, is made this /f d y of
?/??c'ytdrt<, 2010, by the City of High Point, NC, a North Carolina municipal corporation,
{hereinafter referred to as "Declarant"},
RECITALS:
A. Declarant is the owner of certain real property located in High Point, Guilford
County, NC, which property is described on EXMIT "A" attached hereto and incorporated by
reference herein and depicted on EXHIBIT "B" the plat attached hereto and incorporated by
reference herein.
B. Declarant desires to subject the described property to the restrictions set forth in
this Declaration for purposes of creating a riparian buffer restoration area pursuant to the Cedrow
Park Riparian Buffer Mitigation Plan dated July 2, 2010 and approved by the North Carolina
Department of Environment and Natural Resources. The restrictive covenants set forth herein
are intended to ensure continued compliance with the mitigation condition of the major variance

issued by the North Carolina Environmental Management Commission ("DWQ No. 03-1554')
and the City of High Point (Case # WSV 09-01) for the City of High Point Riverdale Landfill.
C. The restrictive covenants set forth herein shall run with the land, and shall be
binding on the Declarant and all parties claiming under it. The restrictions may be enforced by
the State of North Carolina and the City of High Point.
NOW, THEREFORE, Declarant hereby declares that the property described in
EXHIBIT "A" and depicted on EXHIBIT "B" shall be held, transferred, leased, occupied and
used subject to the following restrictions which are hereby imposed for the purpose of
maintaining the riparian buffer restoration area in perpetuity in its natural or mitigated condition.
The restrictions set forth in this Declaration shall touch and concern and run with the title to the
real property subjected to this Declaration and shall be binding on all parties having any right,
title or interest in the described property or any portion thereof. This Declaration shall bind the
respective heirs, devisees, fiduciary representatives, successors, successors in title and/or assigns,
and shall inure to the benefit of the State of North Carolina and the City of High Pont, each of
which may enforce its terms.
RESTRICTIONS
No person or entity shall perform any of the following activities within the riparian buffer
restoration area property described in EXHIBIT "A" and depicted on EXHIBIT `B:"
a. Fill, grade and excavate or perform any other land disturbing activities;
b. Cut, mow, burn, remove or harm any vegetation;
C. Construct or place any roads, trails, walkways, buildings, mobile homes,
signs, utility poles or towers, or any other permanent or temporary structures;
d. Drain or otherwise destruct or alter the hydrology or drainage ways of the riparian

buffer restoration area;
e. Conduct any activity that negatively affects in a material manner the sediment
removal functions of the riparian buffer restoration area;
f. Dump or store soil, trash or other waste;
g. Graze or water animals, or use for any agricultural or horticultural purpose.
