Below is an outline of the USACE comments with a brief narrative addressing each item. The USACE comments with Kimley-Horn responses and explanations are as follows: 1)In order to verify compliance with General Condition 23. (a) and (b), please provide justification for the location of the proposed sewer main/easement that deviates from the existing (to be abandoned) sewer main/easement. Specifically, why the proposed could not be installed in close proximity to the existing (to be abandoned). For example, the proposed sewer main/easement south of Beverly Drive results in greater impacts to waters than installation near/within the existing sewer main/easement. It is critical that the existing interceptor remain in service until the proposed interceptor is tested and certified to be placed in service. The existing interceptor passes beneath and in close proximity to existing homes and roadways (near Beverly Drive and in other areas), which presents safety concerns during both construction and in the future. Due to grade and cover, it is critical to avoid crossing the existing interceptor with the proposed interceptor due to the physical conflict that would present. This would require bypass pumping approximately 30 million gallons of raw sewage every day, posing a possible risk to public and environmental health. It would not be possible to avoid conflict with the existing interceptor if constructing the new interceptor beneath the roadway. Page 2 kimley-horn.com 421 Fayetteville Street, Suite 600, Raleigh, NC 27601 919 677 2000 2)Under NWP 12 regional condition 4.1.11 use of riprap or any other engineered structures to stabilize a stream bed should be avoided to the maximum extent practical. If riprap stabilization is needed, it should be placed on the streams banks, or, if it is necessary to be placed in the stream bed, the finished top of the riprap should not exceed that of the original stream bed. The proposed top of riprap exceeds the original stream bed at Impact Site 4 (permanent stream impacts to S1) for the construction of a rock and roll riffle. As currently designed, a NWP 18 may be the best option to permit the proposed activity. Please provide additional information to verify compliance with NWP 18, e.g., calculate the cubic yards below the plane of the ordinary high water mark for the proposed activities. The existing stream bed needs to be raised in order to accommodate the proposed interceptor to pass beneath without impeding stream flows. The installation of the rock and roll riffle will generate approximately 10 cubic yards (or < 0.001 ac.) of permanent impacts to stream S1 at Impact Site 4. Therefore, “the quantity of discharged material and the volume of area excavated do not exceed 25 cubic yards below the plane of the ordinary high water mark or the high tide line” and “the discharge will not cause the loss of more tan 1/10-acre of waters of the United States”, which is in compliance with NWP 18. Please see the attached PDF for calculations. 3)Each impact should be recorded in the PCN and plans independent of other impacts, e.g., impacts to S3 for culvert extension should be calculated separate to impacts to S4 for culvert extension. Additionally, the USACE is required to record loss for each aquatic resource separately; therefore, wetland impacts should be recorded based on the type of impact and the aquatic resource impacted. For example, Impact Site 9 impacts were calculated together for impacts to W17 and W10 (sheet 9 & 10). Please separate impacts based on type/aquatic resource and update the PCN and plans accordingly. Permanent impacts to wetlands will result from the utility line construction and new easement construction. Permanent wetland fill impacts will be minimized to the extent practical resulting in primarily conversion impacts. Limited areas of grade/fill impacts to wetlands will occur at some of the sites. Temporary impacts to wetlands will occur as a result of construction access as part of the repair/construction of the utility line. Temporary impacts will be restored to pre-construction contours and re-vegetated with native woody vegetation upon completion of the proposed project. 3. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts to streams, wetlands and riparian buffers have been avoided and minimized to the extent practical. The proposed sanitary sewer line is being constructed largely within an existing sanitary sewer and greenway easement as much as practicable to minimize impacts from new easement construction. Additionally, this project was designed to almost completely avoid Walnut Creek and stream impacts due to the installation of the utility line are temporary. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Impacts to streams, wetlands, and protected riparian buffers within the corridor and its vicinity will be minimized to the extent practical throughout the construction process by avoiding these features with equipment, materials, and access corridors. Where feasible, staging and construction access routes will be located in upland areas throughout the corridor. Silt fencing will be installed around the limits of disturbance to help ensure that all construction equipment will remain within the project area throughout the construction process. Sediment control measures will be used to reduce stormwater impacts to receiving waters and minimize runoff from the construction sites. 2.
