Please confirm that you understand the necessity for awaiting the EFH Assessment and the subsequent
consultation between the Corps and NMFS as described, prior to making a decision on the 401 certification due

Please see the response letter and other attachments related to your request for additional information regarding
the Shinn Creek Estates HOA proposed dredging project.
I left you a pretty lengthy voicemail on this.... We are initiating an Essential Fish Habitat Assessment as
strongly suggested by the Corps in their 11/19/20 letter to reinitiate their consultation with NMFS regarding the
proposed project. The assessment will be thorough and require some time to complete. The Corps has agreed to
an assessment submittal date of no later than 1/15/21. I believe you were copied by Liz Hair at the Corps with
that agreement. The assessment and follow up consultation between the Corps and NMFS will relate to the
fisheries concerns in your request for additional information. The HOA is spending a significant amount of
money for the assessment work and would like to know that a decision on the issuance of a 401 certification
will be made after the EFH assessment submittal and the Corps/NMFS consultation process since concerns are
directly related and the decision is best made with the resulting information. Please confirm that this will be the
