The mitigation requirement may be met through one of the following options: (a) Payment of a compensatory mitigation fee to the Riparian Buffer Restoration Fund pursuant to 15A NCAC 02B .0269 contingent upon acceptance of payments by the NC Ecosystem Enhancement Program, or to a private mitigation bank that complies with banking requirements of the US Army Corps of Engineers, currently set out at http://www.saw.usace.army.mil/WETLANDS/Mitigation/mitbanks.html or from the US Army Corps of Engineers, P.O. Box 1890, Wilmington, NC, 28402-1890, and the applicable trading criteria in 15A NCAC 02B .0273; (b) Donation of real property or of an interest in real property pursuant to Item (7) of this Rule; or (c) Restoration or enhancement of a non-forested riparian buffer pursuant to the requirements of Item (8) of this Rule. If time is of the essence, I would go with payment to EEP. If not, then I would look for areas that might meet item C above on school property and come up with a mitigation plan for the proposed areas. Are there any banks set up at this point that are serving the Jordan mitigation needs at this point? The school has asked me if they could do some preservation on lands they own nearby. They own 20 acres, but I'm not really sure what the streams or wetlands amount to and it would only be preservation. What are your thoughts on that issue? -----Original Message----- From: Gilleski, Lia jmailto:lia.m.gilleski(@ncdenr.govl Sent: Thursday, December 16, 2010 10:25 AM To: W Mullin Cc: Gyamfi, Joseph Subject: RE: Jordan High School Bill, Yes it is still the same for road impacts, but now you have to purchase Jordan Buffer Credits and provide the documentation to us about who you are purchasing them from, etc. - Lia -----Original Message----- From: W Mullin rmailto:wmullin(@ihcarterinc.coml Sent: Wednesday, December 15, 2010 10:54 AM To: Gilleski, Lia Subject: Re: Jordan High School Hello I was just speaking with Jim Thames and he caught a bit of an error on the PCN form and the project site is in the Cape Fear not the Neuse. So with the Jordan buffer rules is mitigation still the same? I;m at (910-690-3825 right now if you could get in touch with me so I can make sure I get this right very quickly. Thanks Bill... z
