On November 9, 2016, a compliance inspection was performed for the groundwater remediation system of the Catalent Pharma Solutions groundwater remediation system at 2021 Roosevelt Avenue, Monroe, Union County. During this inspection the recovery and treatment system were reviewed, the recovery wells were checked for operational functionality and the treatment system was discussed with representatives of Rogers & Callcott and Aqua -Trot, Inc. Please see the attached inspection report. The permit expiration date is August 31, 2018. Per permit requirements, a renewal application is due 180 days prior to expiration. The system was found to be in good operating order. A slight bacteria sheen was noticed in both the wet well and in the holding tank. The wet well high water alarm was tested and was found to be in good working condition. The SCADA system called the ORC to report a high water alarm condition. The recovery wells appear to be in good working order and the outfall was clear of debris, foam, odor and color. The out fall had been moved to a secured area inside the driveway of the loading dock. Paperwork and laboratory data were found to be in good order an no compliance issues were noted during the site visit. Most times this system does not discharge to daily maximum limits. The system acts as a pre-treatment system which then is discharged into a SSO line owned by the City of Monroe. This happens via a permit between the RP and the City of Monroe. Well MW-2 is currently being used as a recovery well. Representative Sampling Samples and measurements taken as required herein shall be representative of tyre volume and nature of the monitored discharge. All samples shall be taken at the monitoring points specified in this permit and, unless otherwise specified, before the effluent joins or is diluted by any other wastestreanr, body of water, or substance. Monitoring points shall not be changed without notification to, and approval by, the permit issuing authority. 2. Reporting a) Monitoring results obtained by the permittee shall be reported on forms specified by the City of Monroe, postmarked no later than the twentieth day of the month following the month in which the samples were taken. Results based on laboratory analysis shall include the laboratory report. If no discharge occurs during a reporting period (herein defined as each calendar month) in which a sampling event was to have occurred, a form with the phrase "no discharge" shall be submitted under the signatory requirements of Part H, Section 13. Copies of these and all other reports required herein shall be submitted to the City of Monroe to the following address: Pretreatment Coordinator City of Monroe PO Box 69 Monroe, NC 28111 b) If the sampling performed by the permittee indicates a violation, the permittee shall notify the City of Monroe within 24 hours of becoming aware of the violation. The permittee shall also repeat the sampling and analysis and submit the results of the repeat analysis to the City of Monroe within 30 days after becoming aware of the violation. LRJP#=> LP-001 Page:7 Effective Date: July 1, 2016 PART II General Conditions Local Industrial User Permit (LIUP) c) Laboratory reports shall include the following: 1. sample preparation - type and date(s) and time(s) performed; 2. analysis start dates and times; 3. analyst(s) initials; 4, analytical techniques and methods used; 5. results of the analyses; 6. chain of custody records which contain the following Information a. sampling location; b. date(s)/time(s) sample(s) taken; c. sample type: composite (time, flow or hand) or grab d. container type; e. teflon liner and/or zero headspace, if applicable; f. type of preservative used, if any; g. sample iced upon receipt; h. parameters to be run from that particular bottle; i. individual(s) who performed the sampling and/or field measurements; j. samples relinquished/received by who and when (date & time). In addition, the laboratory performing the analysis shall maintain on file for up to three years after the analysis all laboratory data taken and calculations during the analysis, including dates and times, the analyst performing the work, and the data and calculations from all quality assurance procedures and testing. This data shall be available for inspection by personnel of the City of Monroe upon request. 3. Test Procedures Test procedures for tine analysis of pollutants shall be performed by a North Carolina Certified Wastewater Lab in accordance with the techniques prescribed in 40 CFR part 136 and amendments thereto unless specified otherwise in the monitoring conditions of this permit. The laboratory shall be certified by the State of North Carolina for each specific test parameter on which their results are reported. 4. Additional Monitoring by Permittee If tine permittee monitors any pollutant at the location(s) designated herein more frequently than required by this permit, using approved analytical methods as specified above, the results of such monitoring shall be submitted to the City of Monroe. The City of Monroe may require more frequent monitoring or the monitoring of other pollutants not required in this permit by written notification. 5. Duty to Comply The permittee must comply with all conditions of this permit. Any permit noncompliance constitutes a violation of the City of Monroe Sewer Use Ordinance and is grounds for possible enforcement action; for Permit termination, revocation, and reissuance, or modification; or denial of a Permit renewal application. Duty to Mitigate - Prevention of Adverse Impact The permittee shall take all reasonable steps to minimize or prevent any discharge in violation of this permit which has a reasonable likelihood of adversely affecting human health, the POTW, the waters receiving the POTW`s discharge, or the environment. 7. Facilities Operation, Bypass The permittee shall at all times maintain in good working order anti operate as efficiently as possible, all control facilities or systems installed or used by the permittee to achieve compliance with the terms and conditions of this permit. Bypass of treatment facilities is prohibited except when approved in advance by the City of Monroe. Bypass approval shall be given only when such bypass is in compliance with 40 CFR 403.17. Treatment facilities shall be as diagrammed in Figure 2. 8. Removed Substances Solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be disposed of in a manner such as to prevent any pollutants from such materials from entering the City of Monroe sewer system or the surface waters of the State of North Carolina. The permittee is responsible for assuring its compliance with any requirements regarding the generation, treatment, storage, and/or disposal of "Hazardous Waste" as defined under the Federal Resource Conservation and Recovery Act. the permittee shall maintain records of disposal of these substances for a minimum of three years. 9. Upset Conditions An "upset" means an -exceptional incident in which there is an unintentional and temporary noncompliance with the effluent limitations of this permit because of factors beyond the reasonable control of the permittee. An upset does not include noncompliance to the extent caused by operational error, improperly designed or inadequate treatment facilities, lack of preventative maintenance, or careless or improper operations. An upset may constitute an affirmative defense for action brought for the noncompliance. The permittee has the burden of proof to provide evidence and demonstrate that none of the factors specifically listed above were responsible for the noncompliance. Such evidence shall include operating logs properly signed, or other relevant evidence that: 1. An upset occurred and that the permittee can identify the cause(s) of the upset; 2. The permittee facility was at the time being properly operated; and 3. tine permittee submitted notice of the upset as required in Part H, Section 30, of this permit 4. Right of Entry The permittee shall allow the staff of the State of North Carolina Department of Environment and Natural Resources, Division of Water Quality, the Regional Administrator of the Environmental Protection Agency, the City of Monroe, and/or their authorized representative, upon the presentation of credentials: 1. To enter upon the permittee's premises where a real or potential discharge is located or in which records are required to be kept under the terms and conditions of this permit; and 2. At reasonable times to have access to and copy records required to be kept under the terms and conditions of this permit; to inspect any monitoring equipment or monitoring method required in this permit; and to sample any discharge of pollutants. 11. Availability of Records and Reports The permittee sl►all retain records of all monitoring information, including all calibration and maintenance records as well as copies of reports and information used to complete the application for this permit for at least three years. All records that pertain to matters that are subject to any type of enforcement action shall be retained and preserved by the permittee until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired. Except for data determined to be confidential under the Sewer Use Ordinance, all reports prepared in accordance with terms of this permit shall be available for public inspection at the City of Monroe. As required by the Sewer Use Ordinance, effluent data shall not be considered confidential. 12. Duty to Provide Information The permittee shall furnish to the Director of Water Resources or his/her designees, within a reasonable time, any information which the Director, his/her designee, or the Division of Water Quality may request to determine compliance with this permit. The permittee shall also furnish, upon request, copies of records required to be kept by this permit. 13. Signatory Requirements All reports or information submitted pursuant to the requirements of this permit must be accompanied by the following certification by the Authorized representative: "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those persons directly responsible for LIUP##=> LP-001 Page:10 Eftective Date: July 1, 2016 PART II General Conditions Local Industrial User Permit (LIUP) gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility, of fine or imprisonment for knowing violations. " The Authorized Representative shall be as defined by the City of Monroe Sewer Use Ordinance. If the designation of an Authorized Representative is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, or overall responsibility for environmental matters for the company, a new authorization satisfying the requirements of this section must be submitted to the City of Monroe Water Resources Director or his/her designee prior to or together with any reports to be signed by an authorized representative. 14. Toxic Pollutants If a toxic effluent standard or prohibition (including any schedule of compliance specified in such effluent standard or prohibition) is established under Section 307(a) of the Federal Clean Water Act for a toxic pollutant which is present in the discharge and such standard or prohibition is more stringent than any limitation for such pollutant in this permit, this permit may be revised or modified in accordance with the toxic effluent standard or prohibition and the permittee so notified. 15. Civil and Criminal Liability Nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance. 16. Federal and/or State Laws Nothing in this permit shall be construed to preclude the institution of any legal action or relieve the permittee from any responsibilities, liabilities, or penalties established pursuant to any applicable Federal and/or State law or regulation. 17. Penalties The Sewer Use Ordinance of the City of Monroe provides that any person who violates a per►nit condition is subject to a civil penalty not to exceed $25,000 dollars per day of such violation. Under state law, (NCGS 143-215.6B), under certain circumstances it is a crime to violate terms, conditions, or requirements of pretreatment permits. It is a crime to knowingly make any false statement, representation, or certification in any record or other document submitted or required to be maintained under this permit, including monitoring reports or reports of compliance or noncompliance. These crimes are enforced at the prosecutorial discretion of the local District Attorney. LIUP#=> LP-001 Page :11 Effective Date: duly I, 2016 PART II General Conditions Local Industrial User Permit (LIUP) The City of Monroe enforcement response will be in accordance with an Enforcement Response Plan approved by the North Carolina Division of Environmental Management and on file in the office of the Pretreatment Coordinator. However, the City reserves the right as described in separate contract with R.P. Scherer, to require the permittee to immediately discontinue all discharge of treated ground water to the City of Monroe system at the sole discretion of the City of Monroe. 18. Need to Halt or Reduce not a Defense It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity to maintain compliance with the conditions of the permit. 19. Transferability This permit shall not be reassigned or transferred or sold to a new owner, new user, different premises, or a new or changed operation without approval of the City. 20. Property Rights This permit does not convey any property rights in either real or personal property, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any infringement of Federal, State or local laws or regulations. 21. Severability The provisions of this permit are severable and, if any provision of this permit or the application of any provision of this permit to any circumstance is held invalid, the application of such provision to other circumstances and the remainder of this permit shall not be affected thereby. 22. Permit Modification, Revocation, Termination This permit may be modified, revoked and reissued or terminated with cause in accordance with the requirements of the City of Mouroe Sewer Use Ordinance and North Carolina General Statute or implementing regulations. 23. Re -Application for Permit Renewal The permittee is responsible for filing an application for reissuance of this permit at least 120 days prior to its expiration date. The permittee is not authorized to discharge after the expiration (late of this permit if this re -application deadline has not been met. 24. Dilution Prohibition The permittee shall not increase the use of potable or process water or in any other way attempt to dilute the discharge as a partial or complete substitute for adequate treatment to achieve compliance with the limitations contained in this permit. Reports of Changed Conditions The permittee shall give notice to the City of Monroe of any planned significant changes to the permittee's operations or system which might alter the nature, quality, or volume of its wastewater at least 60 days before the change. Such changes, however, do not stay any condition of this permit. If the changes require additions or modifications to pretreatment facilities to comply with this permit, all such modifications shall be approved and constructed before planned changes are made. The permittee shall not begin the changes until receiving written approval from the City of Monroe. Also see PART H, 30 below for additional reporting requirements for spill/slug issues. 26. Construction No construction of pretreatment facilities or additions thereto shall be begun until Final Plans and Specifications have been submitted to the City of Monroe and written approval and an Authorization to Construct has been issued. 27. Reopener The permit shall be modified or, alternatively, revoked and reissued to comply with any applicable effluent standard or limitation for the control for any pollutant shown to contribute to toxicity of the WWTP effluent or any pollutant that is otherwise limited by the POTW discharge permit. The permit as modified or reissued under this paragraph may also contain any other requirements of State or Federal pretreatment regulations then applicable. 28. Categorical Reopener This permit shall be modified, or alternatively, revoked and reissued, to comply with any applicable effluent standard or limitation issued or approved under Sections 302(b)(2)(C) and (D), 304(b)(2), and 307(a)(2) of the Clean Water Act, if the effluent standard or limitation so issued oe• approved: 1) contains different conditions or is otherwise more stringent than any effluent limitation in this permit; or 2) controls any pollutant not limited in this permit. The permit as modified or reissued under this paragraph shall also contain any other requirements of the Act then applicable. 24. General Prohibitive Standards The permittee shall comply with the general prohibitive discharge standards in 40 CFR 403.5(a) and (b) of the Federal pretreatment regulations, and shall comply with the prohibitive discharge standards in §52.020 and §52.023 of the City Sewer Use Ordinance except as specifically stated otherwise in this permit. The permittee shall also notify the City of Monroe immediately of any changes at its facility affecting the potential for spills and other accidential discharge, discharge of a non -routine, episodic nature, a non -customary batch discharge, or a slug load as defined in the City of Monroe Sewer Use Ordinance. Additionally, the permittee shall notify by telephone the City of Monroe immediately of all discharges that could cause problems to the POTW including any slug loadings as defined in the Sewer Use Ordinance. If the permittee experiences such a discharge, they shall inform the City of Monroe Pretreatment Coordinator, telephone number (704) 282-4632, if no answer, the Wastewater Treatment Plant, telephone number (704) 282-4630 and (704) 507-8351, if no anwer, the Wastewater Treatment Plant Superintendent, telephone number (04) 226-6093 immediately upon the first awareness of the commencement of the discharge. Leaving a message will not be acceptable until all phone numbers listed above have been attempted. Notification shall include location of the discharge, type of waste, concentration and volume if known and corrective actions taken by the permittee. A written follow-up report thereof shall be filed by the permittee within (5) clays, unless waived by the City of Monroe. The Permittee shall provide and operate monitoring facilities for the inspection, sampling and flow measurement of the permittee's process wastewater discharges. 2. The permittee shall maintain appropriate discharge flow measurement devices and methods consistent with approved engineering and scientific practices to ensure the accuracy and reliability of measurements of the volume of monitored discharges. Devices installed shall be a continuous recording flow meter capable of measuring flows with a maximum deviation of less than 5% from true discharge rates throughout the range of expected discharge volumes. 3. The approved wastewater meter shall he installed, maintained, and calibrated once every six months. 4. The wastewater meter must have a non-resettable mechanical totalizer that reads in gallons. 5. Flow monitoring equipment and sampling point should be located in an area accessible to the City of Monroe personnel without prior notification. The City of Monroe must be supplied with any keys and/or other tools necessary to perform the aforementioned. 6. There shall be no by-pass capability of the wastewater metering devices or the sampling point. 7. The permittee shall maintain flow, maintenance, and calibration records for a minimum of three years. 8. In the event of temporary unintentional failure of the flow meter, the permittee shall notify the Pretreatment Coordinator as soon as possible, but in no case beyond 24 hours after first becoming aware of the failure. Repair shall be under taken as quickly as possible. 3. Based on the Oil and Grease data and weekly inspections, there has been no indication of such a recurrence for more than five years. At this time, we plan to discontinue testing for Oil & Grease and by-pass the oil/water separator as these measures are no longer needed. Flow from MW-4 will be restored to its original configuration by closing a valve to the separator. The oil/water separator will remain connected to the system in the event it is needed in the future. An approximately one -week system shutdown is tentatively scheduled for the week of April 19, 2004, for system maintenance, including rust treatment of the air stripper and replacement of the above ground galvanized piping and fittings. A 24-hour verbal report and written confirmation were submitted to your office on July 30, 1999, when we received the first indication of a possible upset. Since then, the laboratory analyses were completed and an analytical report was received on August 18, 1999. As indicated in our written confirmation to the 24-hour verbal report, two repeat samples of the effluent were collected for confirmation on July 30, 1999. The samples were collected at the effluent sampling port and at the end of the pipe. The system was also shut down temporarily on July 30, 1999 until results of the confirmation samples became available to prevent any discharge that potentially could had any adverse effects. Laboratory analysis of the initial effluent sample collected on July 21, 1999 indicated that the upset had resulted in readings above the NPDES effluent daily maximum for trichloroethene and tetrachloroethene. The detected levels were 160 and 590 ug/L, compared with the daily maximum of 92.4 and 8.85 ug/L for each compound, respectively. Other VOCs were detected but were not above any established daily maximums. However, analysis of the repeat samples (collected on July 30, 1999) did not confirm the results of the earlier sample. No VOCs were detected in the two repeat samples except 9 Five -Day Written Report of a Possible Upset NPDES Permit #NC0084344, Non -Discharge Permit #WQ0010607 R. P. Scherer/Chelsea Laboratories August 19, 1999 for tetrachloroethene at concentrations of 0.79 and 0.63 ug/L. These concentrations are more than ten times below the daily maximum of 8.8 ug/L. Copies of the laboratory analysis reports are attached. A Daily Monitoring Report (DMR) is being prepared and will be submitted to the NCDENR by the end of August as required by the NPDES permit. In an effort to identify the cause of the upset, Rogers & Callcott has interviewed the operator and the manufacturer of the system. We have also closely reviewed the system design, its operation and maintenance, sampling and analysis procedures and historical data from the site. The evaluation confirmed that the system was properly designed, and at the time was being properly operated and maintained. Enclosed are copies of the operation and maintenance records for the last three months and a table and graph showing the amount of VOCs recovered from the aquifer. Moreover, as the data submitted in the monthly DMRs show, no significant changes have occurred in the influent concentrations in July 1999. Therefore, it is apparent that the upset was due to factors beyond our control that are unrelated to the system design, operation or maintenance. Because the latest effluent data did not confirm the July 21, 1999 results, R. P. Scherer plans to re -activate the remediation system as soon as possible. In my discussion with Mr. Bou-Ghazale on August 18, 1999, R. P. Scherer was authorized to re -activate the system on August 23, 1999. It is important to re -start the system in August to allow for the routine influent/effluent and groundwater monitoring required by the permits for August.
