The system is part of a remediation being conducted in compliance with 15A NCAC 2L to remediate groundwater impacted by a release of gasoline at the facility. Charlie Swartz in the Groundwater Section at the Mooresville Regional Office is the project manager for this remediation. In conducting the Comprehensive Site Assessment to address the petroleum release at the property, groundwater sampling identified the presence of chlorinated hydrocarbons, including tetrachloroethane, trichloroethane and dichloroethane, at the property. The chlorinates were originally identified in the deep well, which is screened in bedrock. Subsequent sampling revealed chlorinates, at even higher concentrations, in the shallow groundwater. Documents from the Groundwater Section's files indicate that the DEM has been aware of the existence of chlorinated hydrocarbons in the groundwater upgradient from the Beall Oil property since 1987/88. Copies of such documents are attached. In accordance with the Corrective Action Plan submitted to the MRO, the pump and treat system was installed in Spring of 1995. However, thus far, start-up of the system has been delayed based on a concern that the incidental treatment of chlorinates in this system will violate the general permit, because such a permit is not aimed at addressing chlorinates. The MRO Mr. Rex Gleason February 14, 1996 Page 2 Groundwater Section is aware that we are delaying the remediation for this purpose and have requested that we move forward with the remediation as soon as possible. We have been informed by the equipment manufacturer, Ejector Systems, that the tray striper should remove the chlorinated hydrocarbons as well as the BETX. The treatment system is equipped with two carbon canisters in series, that should remove any contamination after the air stripper. Specifications for this system are attached. The surface water body subject to the permitted discharge is a stream running behind the Beall Oil facility. We recently sampled the stream upgradient and downgradient of the facility. The results, which are attached, indicate that surface water is contaminated with chlorinates both above and below the Beall Oil area of the petroleum release. The sampling results also indicate that the petroleum release is affecting the stream. In addition to concerns about violation of the discharge permit, we have concerns about the potential liability implications should the system's operation affect the direction or speed of the flow of the chlorinated solvent coming on -site from upgradient. This concern has contributed to the delay in operating the system. To address this concern, we would like to run a pilot test of the system to establish the system's radius of influence. Our goal is to document that the system's influence does not extend off -site and is not speeding the downgradient migration of chlorinates. Through a pilot test, we hope to also document the efficiency of the treatment system. As part of the pilot test, the system would be monitored before it enters the tray stripper, between the stripper and the first carbon vessel, between the carbon vessels, and prior to the stream discharge. The system would be sampled at start up, three days after start up, seven days after start up and two weeks after start up. We intend to request a 48-hour turn around for the sampling results. If the water entering the first carbon is non -detect for chlorinates, we would sample as required in the permit with the inclusion of sampling for chlorinates between the carbon vessels and prior to discharge to the stream. The pilot test is planned to last for 180 days at which time the system will be evaluated. Based on the initial results, plans for additional operation will be determined. Considering the above information, we request the water quality section's input on the following questions: 1. Can we conduct a pilot test as described above, under the general permit as issued? If not, can we operate a pilot test, under different conditions? 2. If the general permit is used, can Beall Oil be held responsible for discharge of chlorinates to the stream, even if Beall Oil is not the source of the chlorinates? If a pilot test can be conducted, and is successful in addressing the other concerns, can the general permit be used for operation of the pump and treat system? We welcome any other comments or suggestions that you have to assist us in moving this matter forward. As Mr. Swartz is aware, we certainly intend to move the remediation of the petroleum release forward as soon as possible, but simply can not take any actions that will result in liability for remediation of the chlorinates under CERCLA or any other statute, or would violate the general permit or any other water quality violation. We would like to move forward to actively remediate the petroleum release as soon as possible and believe that the pump and treat system is the best method to address the petroleum most rapidly. The Groundwater Section has stated that, due to our concerns, we could possibly pursue other, more passive, remediation methods. However, we have looked into other methods and it is our position that only a pump and treat system will be effective to reduce the petroleum contamination levels fast enough to avoid discharge of petroleum contaminants to the stream. After understanding this matter more thoroughly the following is what I've spoken to Karen on 10/5/95 at approximately 1:30pm. In 1987/88 Rhyne Mills Plant 4 6 discovered the well that provided drinking water and sink water to the facility was contaminated. The water had an odor, and after contacting Lincoln Countv Health Department, Rhyne Mills began bringing bottled water onto the site for its employees and also to occupants of a rental house, owned by Rhvne Mills According to Maggie Dollar (Lincoln County Health Dept. 704-736-8634) both local and Federal EPA personnel were brought in to conduct testiny, of wells and at that time detected the three chemicals listed on the notification you sent me. After inspection of Rhyne Mills # 6 there was no evidence found of contaminants or dumping However, it was noted that H & S Knitting and Finishing was possibly dumping their waste This was never proved and no one charged because at the time of Rhyne Mills' contamination of wells this facility was closed and not in operation. ppppppp� PAGE TWO Maggie Dollar has stated that she worked through this with Keith Overcash at that time. To my knowledge and through my internal investigation. Rhyne Mills # 6 has never dumped or released solvents, or other contaminants on its own property or any other. This work was done to provide data relevant to remediation planning now underway between your law firm, Smith, Helms, Mulliss and Moore, and the NC DEM, Mooresville Regional Office. At the first sampling, in December, three grab samples of stream water were taken. The locations were up and down stream of the former UST location on the stream crossing the Westside property and the stream which crosses beneath the highway and joins the site stream down stream of the release. On January 25 three more samples were taken. Locations were all from the site stream, where it enters the property, adjacent to the former UST, and just above the junction with the other stream. You will see that chlorinated compounds are present in both streams and that gasoline constituents are present in the stream in the vicinity of the former UST release.
