file with the Division of Water Quality and City of Lincolnton and operated under
Permit Number 0019 issued by the City of Lincolnton.
An on -site inspection indicated that the wastewater treatment facilities listed on
the attached tax certification are used exclusively for waste disposal or to abate, reduce,
or prevent the pollution of waters in accordance with North Carolina General Statute
105-275.(8)(a).
The Company may use this certification to obtain tax benefits in keeping with
the appropriate Statutes.

Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and directs the
Environmental Management Commission of the Department of Environment & Natural Resources to
protect and preserve the water resources of the State. The Division of Water Quality (DWQ) has the
delegated authority to enforce adopted water pollution control rules and regulations.
Enclosed please find a copy of a Complaint Investigation Report for the investigation conducted
on June 26, 2007, by Mr. Wes Bell of this Office. As a result of the investigation, the following condition
was found to be in violation of G.S. 143-215.1 and G.S. 143-215.83(a):
The washwater/oil resulting from the pressure washing of engines and/or
transmissions was being discharged onto ground and into a drainage
swale.
Please be advised that this report is being issued as a Notice of Violation (NOV) for the violations
of G.S. 143-215.1 and 143-215.83(a). Be advised that pursuant to G.S. 143-215.88A, any person who
intentionally or negligently discharges oil or other hazardous substances, or knowingly causes or permits
the discharge of oil in violation of G.S. 143-215.83(a), or who fails to report a discharge as required by
G.S. 143-215.85(b), or who fails to comply with the clean up requirements of G.S. 143-215.84(a), shall
incur, in addition to any other penalty provided by law, a penalty in an amount not to exceed five thousand
dollars ($5,000.00) for each such violation. Be advised that G.S. 143-215.6A provides for a civil penalty
assessment of not more that twenty-five thousand dollars ($25,000.00), or twenty-five thousand dollars
($25,000.00) per day when the violation is of a continuing nature, against any person who is required but
fails to apply for or to secure a permit required by G.S. 143-215.1. Penalties may also be assessed for any
damage to the surface waters of the State that may result from the unpermitted discharge.

REPORT:
On June 19, 2007, this office was referred a complaint by the Division of Waste
Management's Hazardous Waste Section regarding engine washwater being discharged to a ditch
at the AAA Auto Part (AAAAP) business site in Lincolnton, N.C. Mr. Wes Bell of this office
investigated the complaint on June 26, 2007.
Mr. Bell met with Mr. Kyle Clark, AAAAP, at the business site. Several engines and
transmissions were observed on a concrete pad adjacent to the shop entrance. Mr. Clark
indicated that the engines and/or transmissions are normally pressure washed with no cleaners;
however, a biodegradable cleaner had been occasionally used. No engines/transmissions were
being washed during the investigation; however, the water hose for the pressure washer was
leaking onto the concrete pad. The water leakage discharged the residual transmission
fluid/petroleum products (on the concrete pad) onto the ground and into a drainage swale.
Petroleum sheens were observed throughout the discharge. The discharge did not enter any
surface waters. Mr. Bell discussed the containment of the washwater and other nondischarge
options with Mr. Clark during the investigation. Note: Mr. Clark cut off the water supply to the
pressure washer to prevent any continuing discharges. All domestic wastewater is
disposed/discharged to a municipal sewer collection system. In addition, all potable water is
supplied by the local municipality.
Mr. Bell observed oil stained soil adjacent to the shop entrance/parts removal area. Mr.
Bell informed Mr. Clark that the contaminated soil would be referred to the Division of Waste
Management's UST Section.

Mr. Bell discussed the relevant environmental regulations and penalties regarding the
washwater/oil discharges. In addition, Mr. Bell indicated that any contaminated soil resulting
from the washwater/petroleum discharges had to be properly remediated. Mr. Clark was very
helpful and courteous during the investigation. A follow-up investigation by this Office may be
necessary to verify the facility's corrective actions.

renewal of your permit. Second, it serves as an invoice for the $400.00 application processing
fee required to process your application request. To assure continued coverage under the general
permit this form must be completed and returned along with the fee by May 22, 1997.
Failure to request renewal within this time period may result in a civil assessment of at least
$250.00. Larger penalties may be assessed depending on the delinquency of the request.
Discharge of stormwater from your facility without coverage under a valid stormwater NPDES
permit would constitute a violation of NCOS 143-215.1 and could result in assessments of civil
penalties of up to $10,000 per day.
