We signed the proposal on Monday and it states that the surveyor will start within 5 days. I don't think we will get a completed survey until Dec 27th or 28th. Howard needs the answers this survey will tell to finish his analysis on solutions to satisfy the State SW permit. Once we get those options, we need to compare with the wetlands solutions and choose what will be most feasible. I can't see this being decided until January. I was under the impression that all parties including the USCOE understood this latest delay and time was granted. Am I in error? This permitting process will be more time consuming and costly than a NWP. Part of that cost would be the mitigation. Constructed wetlands that are part of a stormwater permit are not under ACOE jurisdiction and will not count as mitigation. Instead, the applicant would need to buy into a mitigation bank for all of the proposed wetland impacts. Hopefully we can discuss this in greater detail early next week during our meeting. As you know, this conversion to a stormwater treatment "facility" to satisfy Section 402, removes the Corps jurisdiction under Section 404. Accordingly, this conversion would need Corps authorization in the form of a DA permit; however, our regional conditions for the NWPs prohibit the use of wetlands for stormwater management .... .except for NWP 18...but this NWP has a maximum impact of 0.10 acres. That said, they could apply for an Individual Permit. While this can be a time-consuming process (for us and the applicant), I could potentially see this as a viable project provided they do not have any other practicable alternatives for meeting the State's requirements. I had a meeting yesterday with Ralph Ronalter of Baseline Construction, regarding the existing Dollar General Store that was built off NC 211 in Supply, Brunswick County, without a State Stormwater permit. It is my understanding that the Corps is requiring the impacted wetlands at this site to be restored. The site's current stormwater management was designed to meet Brunswick County's pre/post ordinance, which does not provide sufficient storage to satisfy the Division's requirements for storage/treatment of the runoff from a 1.5" storm. They are looking into a variety of options for after-the-fact stormwater treatment in order to secure the required state stormwater permit. One of the options is a constructed wetlands. Would the Corps consider the use of the restored wetlands as a constructed wetland under the stormwater permit, which would allow them to be used as a stormwater BMP? I believe that either Mr. Ronalter or his consultant, Howard Resnik, P.E. or Rodney Wright, will be getting in touch with you or Jennifer to discuss this possibility. I volunteered to send this upfront email so that you and Jennifer would know that the Division is aware of this proposal and to assure you that the Division will not permit a constructed wetland in the restoration area unless the ACOE agrees with the concept.
