In accordance with your application received on March 19, 1997, we are forwarding herewith
Permit No. WQ0013622; ,dated May 9, 1997, to Mineral Earth Products for. the distribution and marketing
of a fertilizer containing poultry waste products which meet exceptional quality standards.
This permit shall be effective from'the date of issuance until April 30, 2002 and shall be subject to
the conditions and limitations as specified therein. Please pay particular attention to the monitoring and
reporting requirements contained in this permit. Failure to establish an adequate system for.collecting and
maintaining the required. operational information will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form,of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

amended, and other applicable Laws, Rules, and Regulations

distribution and marketing of a fertilizer containing poultry waste products, which meet exceptional quality
standards, throughout the State of North Carolina, .with no discharge of wastes to the surface waters,
pursuant to the application received -on March 19, 1997, and in conformity with the project plan,
specifications, and other supporting data subsequently filed .and approved by the Department of
Environment, Health and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until April 30, 2002 and shall be subject to
the following specified conditions and limitations:
I. PERFORMANCE STANDARDS
1 The program for the distribution and marketing of a fertilizer containing .poultry waste
products which, meet exceptional quality standards shall be effectively maintained and
operated as a non -discharge system to prevent the discharge of any wastes resulting from
the operation of this program.
2. This permit shall become. voidable in the event of failure of the distribution and marketing
program to adequately protect the assigned water quality standards of the surface waters _

3. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this program.
4. In the event that the distribution and marketing program is not operated satisfactorily,
including the creation of nuisance conditions, the Permittaa shall take any immediate
corrective actions as may be required by the Division.
5. When wastewater residuals are sold or given away, one of the Class A pathogen
requirements in 40 CFR Part 503.32(a) must be met. Additionally, an evaluation must be
performed which demonstrates the residuals ability to comply with this requirement. Upon
request, a copy of this evaluation must be submitted to the Assistant Chief, Technical
Support Branch, Division of Water Quality, Post Office Box 29535, Raleigh, NC 27626-
0535.
II.
OPERATION AND MAINTENANCE REQUIREMENTS
1. For a waste product of exceptional quality to be sold or given away in bags or other
container for application to the land, the following must be satisfied:

2. A label shall be affixed= to the bag of other container in which residuals that art soldor
given away for application to the land, or an information sheet shall be provided to the
person who receives the residuals sold or given away in an other container for application
to the land. The label or information sheet shall contain. the following- information:
a. The name and address of the person who prepared the residuals that is sold or given
away in a bag or other container for application to the land.
b. A statement that application of the residuals to the land is prohibited except" in
accordance with the instructions on the label or information sheet.
c. A statement which indentifies that this material shall be prevented from entering any
public or private water supply source (including wells) and any stream, lake, or river.
d. Residuals shall not be applied to any site that is flooded, frozen or snow-covered.
e Adequate procedures shall be provided to prevent surface runoff from carrying any
disposed or stored residuals into any surface waters.
MONITORING AND REPORTING REQUIREMENTS
1. Any monitoring (including groundwater, surface water, residuals, soil, or plant tissue _
analyses) deemed necessary by the Division of Water Quality to,insure protection of the
environment �;vill be established and an acceptable saamptng a:d rPpor*ngtschedule shall be
followed.
2. Proper records. shall be maintained by the Permitted tracking all residual activities. These
records shall include, but are not necessarily limited to the following information:
a. source, volume and analysis of the poultry waste product
b. name of residuals' recipient, volume received, and intended use

3. A residual analysis shall be conducted annually from the date of permit issuance by the
Permittee. The results of all analysis shall be maintained on file by the Permittee for a
minimum of five years. The residuals analysis shall include the following parameters:

4. Three copies of all required monitoring and reporting requirements as specified in
conditions III 2 and I113 shall be submitted annually on or before March 1 of the following
year to the following address:

5. Noncompliance Notification:
The Permittee shall report by telephone to the appropriate DWQ Regional Office (as
outlined in attachment 1) as soon as possible, but in no case more than 24 hours or on the
next working day following the occurrence or first knowledge of the occurrence of any of
the. following:
a. Any occurrence with the distribution program which results in the land application of
significant amounts of wastes which are abnormal in quantity or characteristic.
b . Any failure of the distribution program resulting in a release of material to receiving waters.
c. Any time that self -monitoring information indicates that the facility has gone out of
compliance with the conditions and limitations of this permit or the parameters on
which the system was designed.
d. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate residual treatment.
. e. Any spillage or discharge from a vehicle or piping system-duiring- transportation of
residuals.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within five (5) days following first knowledge of the occurrence. This report must
outline the actions taken or proposed to be taken to ensure that the problem does not recur.
IV. INSPECTIONS
1. The Permittee or his designee shall inspect the residuals storage, transport, and treatment
facilities to prevent malfunctions and deterioration, operator errors and discharges which
may cause or lead to the release of wastes to the environment, a threat to human health, or a
nuisance. The Permittee shall maintain an inspection log or summary including at least the
date and time of inspection, observations made, and any maintenance, repairs, or corrective
actions taken by the Permittee. This log of inspections shall be maintained by the Permittee
for a period of five years from the date of the inspection and shall be made available to the
Division of Water Quality or other permitting authority, upon request.

2. Any duly authorized officer, employee, or representative of the Division of Water Quality
may, upon presentation of credentials, enter and inspect any property, premises or place on
or related to the treatment site or facility at any reasonable time for the purpose of
determining compliance with this permit; may inspect or copy any records that must be kept
under the terms and conditions of this permit; and may obtain samples of groundwater,
surface water, or leachate.
V . GENERAL CONDITIONS
1. This permit shall become voidable unless the distribution activities are carried out in
accordance with the conditions of this permit, the supporting materials, and in the manner
approved by this Division.
2. This permit is effective only with respect to the nature and volume of residuals described in
the application and other supporting, data.
3. This permit is not automatically transferable. In the event that there is a desire for the
facilities to change ownership or a name change of the Permittee, a formal permit request
must be submitted to the Division of Water Quality accompanied by an application fee,
documentation from. the parties involved, and other_ supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may
not be approved.
4. Failure to abide by the conditions and limitations contained in -this permit may subject,the
Permittee to an enforcement action by the Division of Water Quality in accordance with
North Carolina General Statute 143-215.6(a) to 143-215.6(c).
5. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4). .
6. The issuance of 'this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
7. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the "
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
8. This permit may be modified, or'revoked and reissued to incorporate any conditions, _
limitations and monitoring requirements the- Division of Water Quality deems necessary in
_'ordar to adequately protect the environment "and public health. .

the proposed regional water council that was held on
September 12,-1995.
Since then, Bill Janes, Marinette Mitais, Paul Squires and.I
have met and would like to go forward with our plans to form
a regional water council. To this effect, we propose
forming a steering committee, composed of David Draughn,
David Lane, Marc Maxwell, Kim Talbott,_ Bill Janes, Marinette
Mitais, Paul .Squires and myself, to determine how the
council will be structured and who should be asked to serve
on the council. We have scheduled a -steering committee
meeting on January 16, 1996, and our vision is that the
first council meeting will be soon after that.
I would like to personally thank you for your time and

us as an organized council soon.

Marinette Mitais brought the meeting to order at 9 a.m. with opening remarks about the Pacolet
Area Conservancy (PAC) and PAC's role as facilitator in establishing a regional water council.
This being an organizational meeting, she spoke briefly of the possible objectives of the proposed
council and asked all present to think about the role each would be willing to take in assisting the
council, when formed.
Bill Janes presented some of the history of PAC's involvement in -water quality and the
conceptualization of a regional council. He emphasized the need to go beyond political
boundaries in water quality and quantity planning; hence a regional or basin organization is the
goal.. He spoke.of short-. and long-term planning,for the region, mentioning such things as the
economics of clean, plentiful water, the problems which are beginning to appear in this area, and
some long-term considerations with which other communities are having to deal. He expressed
the need for sound planning to maintain the environment we are blessed with and to prepare for
future needs.
Marilyn Meares -Stowell gave an introduction to the geopolitical layout and complexity of the
region being discussed. She oriented the group to the region by pointing out on a map the major
watersheds, the municipal sources of water, and how NC, SC, four counties and four townships
are involved. She mentioned the complex situation of municipal water supplies coming from
counties or states other than their own. She emphasized her support for a council that could
assist the different units of government in making decisions in regards to planning and water
quality maintenance.
The participants were asked- to introduce themselves and give comments concerning the concept
of the council and how they might be involved. In general, the participants who were from
outside the proposed region were willing to be resource people who would contribute expertise as
needed. Most wanted to stay informed as to developments.
Doug Waldrop, Resource Manager, Spartanburg Water System, Spartanburg, SC, stated that
water quality in the N. Pacolet River was important to Spartanburg County in particular because a
new water treatment plant is being built on Lake Blalock which is fed by the Pacolet River. He
offered to make available data that his agency has collected from its regular monitoring of the N.
Pacolet River in Spartanburg County. He also offered in -kind services such as water quality
monitoring:.
kim Talbot, Mayor, Saluda, NC inforined the group the town of Saluda has a seventeen-year
contract'for water with the town of Hendersonville... He would like to see Saluda develop its own
water source rather than be dependent on the renwal'of the existing contract.
David Draughn, Town Manager, Tryon, NC, is responsible for the town's water treatment facility.
Tryon has recently begun to use water`from tributaries of the N. Pacolet upstream from the town.
He felt that a regional council might provide the organization needed to take an inventory of the
existing water supply to better determine how to meet future needs.
David Lane, Town Manager, Columbus, NC, emphasized the importance of not inhibiting growth
or alienating any factions of the community. He suggested that Duke Power, local developers and
others be included in the group. He also felt that -the public needs to be kept informed of the
Council's establishment and activities in order to maintain support.
Mark Maxwell,. Planning and Zoning Director, Polk Co., NC, issues zoning permits and use
,permits in water supply watersheds. He has knowledge of the development in the area and will be
able to keep the council abreast of growth and development issues.
Lee NorIleet, Soil Scientist, NRCS, Greenville, SC, suggested that this council study other basin -
wide resource evaluation projects that have been done in the southeast. He also recommended
-including someone from the timber industry on the council.
Leslie Morgan, SCDNR, spoke of the inter -relatedness of the two states and their effect on each
other in terms of water quality. He mentioned that his agency could provide aerial maps of the
area which would be helpful in determining land use and changes, because they are taken.every
five years.
After a short break, Ms. Mitais opened the second portion of the meeting with the suggestion -of -
inviting the press to any future meetings. It was agreed that the press from Greenville,
Spartanburg, Asheville, Hendersonville, and Polk County would be invited to the next meetings.
It was agreed to develop a list of individuals, industries or organizations not present who should
be invited to participate in the,future. -Some suggestions follow:

Jessica Miles, NC Water Supply Assistance, suggested that there could be different levels of
participation. Local representatives should be the ones involved in policy and' decision making,
with resource, people available as consultants and advisors.
Current issues and long range planning were discussed. Mr. Lane brought up the issue of
funding: It was decided to contact the following organizations to see if they would be willing to
assist with funding:

Western NC Community Foundation
Mountain Valleys RC&D Council
Appalachian Council of Government in SC
Isothermal Planning Commission
Polk. County Rural Development Panel
Division of Forest Resources
Some of the other issues that the group felt the Regional Water Council should tackle are:
Water sources - wells, rivers, lakes, and creeks
Siltation
Infrastructure assessment- water, sewer, and distribution
Water quality monitoring - chemical and biological
Development
Current and future needs .
Land usage patterns and trends in watersheds
Inventory of permitted discharges
Public relations
Education on best management practices (BMPs)
Geographic Information System (GIS) for the area
Water quantity
Ms. Mitais suggested the next meeting be devoted to getting an organizational structure: times
and places of future meetings, what projects to work on, and deciding whether the group should
set up committees for different issues or focus on -one issue at a time. It was decided thA the
agencies present could best serve as advisors and that the local government representatives would
have a more active role. Representatives from the local municipalities and counties would plan to
participate in.the next meeting, while other agencies would be sent an agenda and it would be up
to each to decide whether his/her presence would be be It was suggested that an
invitation be extended to a similar council (such as the Edisto Basin Project) to address 'our
council and explain successful approaches to water management.
There being no further discussion, the meeting was adjourned.

After months of collaboration, a North
Carolina .conservation group has ham-
mered together an interstate, intercounty
council aimed at addressing water needs
and conservation in Spartanburg, Green-
ville and Polk counties.
The newly formed group, tentatively
dubbed the Regional Water. Council, has
peen pieced together by the Pacolet Area
Conservancy, a nonprofit conservation
group based in Columbus, N.C.

"We want to look at the water issues in

sentatives from Tryon, Columbus, and Sa-
' luda, N.C., 'and Landrum, as 'we'll as
county officials from Polk, Spartanburg
and Greenville counties, and state officials
from North and South Carolina.

invite all the governmental bodies involved to participate in a
round table to' discuss the '.feasibility of a Regional Water- Council.
Representatives of the Towns of Tryon and. Columbus and Polk County
have already met on two occasions with members of.the Pacolet Area
Conservancy, Soil and Water Conservation, and Mountain Valley
Resource Conservation and. Development Council. All agree that the

As requested by Mr. Boroumand I am continuing to
furnish you technical aspects of the proposed development.
First - The over-riding concern appears to be
"densi�tv." and the associated road classification related to
density.
Enclosed is a map showing a typical sample of the
building density which is presently permitted by
Spartanburg, Greenville, and Polk Counties. The Polk County
density is based_on the minimum 2 acre lot sizes as
currently zoned. I am sure you will agree that density
differences between Polk County and the South Carolina
portion are not easily observed..
If "people" density is a concern, there are no
means of measuring this parameter and, obviously, the
ordinances do not designate limits of people.
I live in a 2 acre lot neighborhood which was
originally rural in character and is now completely built up
with homes, -driveways, swimming pools and tennis courts -
typical fora two acre lot sub -division.
On weekends the population includes many guests.
Motor vehicles including R.V.'s, boats and -trailers,
automobiles of -all types are plentiful. The swimming pools
and tennis courts are full of people. We do not have
multiple housing but we do have a multiplicity of
development and people. The construction in Polk County as
shown on the enclosed map is copied from our fifteen 2 acre
lot sub -division.

Second----,-,, Much concern has been expressed about the

�Sewa-ge_freatment�-plant and pollution from a breakdown.
`Modern treatment plants are under the full time supervision
of a certified and state licensed operator who monitors the
plant continuously. He is fully alerted to any type of
failure. The development will have a top quali-ty plant of
the type tried and tested at the multi -million dollar
Carolina Country Club Estates project developed by Roger
Milliken and Associates.
There is no doubt that the present stream is
polluted from non=point pollution sources all the way to the
Pacolet River. "Non -point" sources include runoff from
barns, stables, faulty sewage -septic tank systems,
underground home fuel oil storage tanks(this seepage goes on
for years undetected), lawn and garden chemicals, and oily
runoff from asphalt pavements.
The planned treatment plant and the development
are engineered by law to meet the strictest E.P.A. A
regulations. If an environmental cleanup of the present
stream is mandated, all persons, landowners and associations
deemed to be contributing to the pollution would, under
federal law, be required to proportionately share in the
cost of the cleanup.
Your organization may wish to discuss the above
aspects :regarding density with the Polk County Planning
Commission and the pollution of the stream with the
appropriate Health Officials.

Dear Neighbor:
Over the past few years, we've all heard rumors of development plans for the old Blockhouse
racecourse'. Now, it appears those rumors are becoming fact.
In January, Spartanburg County granted preliminary approval to Phoenix Ventures of
California, the owner of the old racecourse, for a -forty-unit townhouse -development, to
occupy approximately 5.9 acres of the old Blockhouse course. The site lies entirely in
South Carolina because of the lack of comprehensive zoning requirements in Spartanburg
County, thus allowing the developer great latitude in the type and quality of it' proposal..
The site plan calls for, among other things, a so-called "package sewage treatment plant"
that would empty its effluent directly into the stream which crosses the Blockhouse propexty,
flowing through much of the old hunting country before emptying into the Pacolet River.
These package plants require surveillance and periodic shutdowns for,maintenance.and repair.
Please note that when the'application for construction of the sewage treatment
_plant is
received by the State, the property will be posted soliciting public comment: It is our
understanding .that`once this treatment plant is'approved, final approval for the development
as a whole is virtually automatic,
This is -to say nothing, of 'course, about the fact that a housing development would be jainned
cheek -by -jowl against a designated National.Historic Landmark; or the increased traffic
that Blockhouse Road, Ridge Read, and Hunting Country Road will be forced to bear; or the
despoilation of one of the last open tracts of land .in the area, and one which for many
of us holds historic and sentimental value.
We believe that there are serious discrepancies in the site plan itself, and in the way
in which the County Planning Commission has applied existing land use statutes. For exaxrrole,
a development of this size must be located on a designated "major residential road", defined
by county statute as one which contains irore than 115 dwellings. The total: number of
dwellings on Blockhouse Road is seven,a fact which the developer has-conveniently'chosen
to overlook.
Don't let unchecked, irresponsible, and inappropriate land use destroy the character of
our neighborhood. We urge you to study the enclosed materials, register your thoughts wih
he Planning Commission,. and attend future hearings to make your voice heard!

This letter is written on behalf of Mr. A. R.
Boroumand, the Owner of the subject property. It is my
pleasure to provide you with the following pertinent
information regarding news articles recently published in
the Spartanburg Herald -Journal and The Tryon Daily Bulletin
about the development of the South Carolina portion of the
property.
Mr. Boroumand called me and expressed his
amazement and surprise at the neighborhood reaction to his
very professional and environmentally sensitive effort to
provide the area with a best quality type housing that is
not now available_ to many persons wishing to have a Tryon
home address.
Mr. Boroumand is perhaps the Owner of the largest
amount of land fronting on Hunting Country Road. He has
lived in Tryon and is familiar with the life-style of its
residents. If this plan of development were ill-conceived,
inappropriate for the area, and damaging to land owners as
indicated in the news reports, he would suffer the greatest_
loss. The Polk County portion of his property contains
31.89 acres. Obviously, he is keenly aware of the need to
guard against negatively impacting his own investment in the
adjacent property.
He has therefore retained a qualified, experienced
design team of architects and engineers to implement
Spartanburg County's Multi -Family Development Ordinance
No. 336 enacted into law January 22,1986.
This ordinance was developed to provide balance
and protection between adjacent areas of mixed land use. It
includes much detailed attention as to population density,
landscape planting including canopy heights, stormwater
runoff management, buffer yards, access, egress, etc. Many
hours of volunteer work went into the compilation of this
professionally written document.
A project presented to the County Planning
Commission for "Approval to Construct" is carefully studied
by a professional staff for adherence to the full intent and

purpose of the Ordinance before any action by the Commission
is taken. The development will �be directed toward affluent
purchasers who wish to avoid the individual maintenance
responsibilities and time consuming chores normally required
with home ownership. The project has been given the name
"Block House Village". The "Village" will be exclusive and
private. The units be will upscale and "pricey". Persons
attracted to the Village should comfortably meld into
existing Tryon society and life style.
A Resident Manager and Staff will maintain a
twenty-four hour responsibility for all aspects of
operation. Leisurely flow of auto traffic will be the norm
for all hours at the Village. The.volume should impact the
existing road system considerably less than traffic
generated by F.E.N.C.E. activities.
The sewage treatment plant will be a copy of the
state-of-the-art plant built and is being operated at the
Carolina Country Club Development-- perhaps the most
pres igious development in our immediate two -state area. The
plant, of course, is planned to be located along the South
Carolina line adjacent to the Owner's Polk County acreage.
The Owner will receive the highly treated effluent in a
creek which will flow for over 1000 feet before leaving his
property. Hence, it is obvious that his concern will be
devoted toward building a highly .efficient,dependable plant.
Mr. Boroumand is most anxious to have everyone
understand his sincere best -intentioned efforts to provide
Tryon with a prestigious, well -planned, and highly desirable
use of this historic property. He will be investing a very
large sum of money to accomplish this and he needs
understanding and support from the Tryon community.
He has.directed me to do everything possible to
allay your fears and publicize the merits of this very
beneficial asset for Tryon and Polk County.
My personal view is to say that it is doubtful
that a better or higher use could be made of this property
as long as Spartanburg and Greenville Counties are without
comprehensive land use and zoning laws on a county -wide
basis - a need which will not occur in=the foreseeable
future.

comprehensively address all certification requirements prescribed in the North Carolina
Administrative Code (15A NCAC 2H .08-00), promulgated methods, and applicable Code of
Federal Regulations (40 CFR Part 136). It is the responsibility of the certified laboratory to address
any required changes in Wastewater/Groundwater Laboratory Ce►tification application information,
and to correct the Laboratory Standard Operating Procedures and the Laboratory Quality
Assurance Manual when requirements of the above cited codes `are not in compliance.
If a future inspection should reveal that the deficiencies/requirements cited in the inspection

This laboratory was inspected to verify its compliance with the requirements of 15A NCAC 2H .0800 for
the analysis of environmental samples.
II. GENERAL COMMENTS:
Mr. Burell is congratulated for doing a very good job of implementing the Field Parameter Certification
requirements. All equipment is well maintained. Records are well kept and most data appeared
accurate. Some further quality control procedures need to be implemented.
III. DEFICIENCIES, REQUIREMENTS, COMMENTS, AND RECOMMENDATIONS:
Total Residual Chlorine
NOTE: The facility uses a pocket colorimeter for high level and a spectrophotometer for low level
A. COMMENT: The pocket colorimeter has not had its internal calibration curve verified across the
range of the meter with five standards. At the present time three gel standards are analyzed each day.
These are acceptable as daily calibration verification standards but not for the verification of the
internal curve across the range of the meter. This must be performed with primary standards at least
annually., One calibration verification standard must be analyzed with each set of samples.
REQUIREMENT: A verification of the internal calibration curve must be performed annually. This is
performed by verifying the readings of five standards. The concentrations of the five standards must
bracket the concentration of the samples analyzed. One of the standards must have a concentration
equal to or below the lower reporting concentration. The minimum reporting level that the Division of
Water Quality will accept for a pocket colorimeter is 0.1 mg/L. It is recommended that the values
obtained not vary by more than 10% of the known value. If the stored program readings vary by more
than this, the stored calibration program should not be used for quantitation until troubleshooting is carried
out to determine and correct the source of error. Ref: Standard Methods, 18th Edition - Method 4500-CI

IV. PAPER TRAIL INVESTIGATION:
A review of data was conducted. This consisted of comparing laboratory bench sheets and contract lab
reports to Discharge Monitoring Reports (DMRs) submitted to this Division. Data were reviewed for
these months: January and April 2003. No errors were noted. It appears the facility is doing a good job
of accurately transcribing data.
V. CONCLUSIONS:
This laboratory is doing a good job overall. Correcting the above comment should help to produce
quality data and meet certification requirements. Please submit a written reply to all lettered
comments.

approximately 8:30 a.m., June 24, 2003 at the Tryon WWTP. The scope of the inspection will include all
methods marked on Attachment I of the laboratory's current North Carolina Wastewater /Groundwater
Certificate and /or marked, on the application for NC Wastewater/Groundwater Laboratory Certification. A
copy of the current Attachment I is enclosed for your reference. The purpose of the inspection will be to
verify the Field Parameter laboratory's documented quality control/quality assurance procedures and
adequacy in meeting the requirements of 15A NCAC 2H .0800.
Please have available for review all documentation related to the generation of the Field Testing data
reported on the Discharge Monitoring Report (DMR) produced for Tryon Middle School WWTP for the past
twelve months. This may include your operator's logbook, meter calibration documentation, and all records.of

Dear Wastewater System Owner or Operator,
,House Bill 1160, the Clean Water Act of 1999, was ratified by the North Carolina General
Assembly on July 20 and signed into law by the Governor on July 21, 1999. This legislation has placed
significant, new reporting requirements on those entities that own or operate wastewater treatment and
collection systems. This letter is provided as guidance to assist you in meeting this aspect of the new
reporting requirements.
Spill Notification
One of the new requirements that became effective October 1, 1999 for all wastewater facilities
that collect or treat wastewater is that they must notify the public of wastewater spills. Wastewater facility
owners or operators must issue a press release after a discharge to surface waters of 1,000 gallons within
48 hours of first knowledge of the spill by the owner/operator. The law requires that the press release must
be issued to "all electronic and print news media outlets that provide general coverage in the county where
the discharge occurred." A copy of the press release must be maintained for one year by the
owner/operator. This press release is required in addition to the permit requirement of contacting the
North Carolina Division of Water Quality (DWQ). A list of media outlets, sorted by County, and a sample
press release are attached for your reference.
If a discharge of 15,000 gallons or more reaches surface water, a public notice is required in addition
to the press release. The public notice must be placed in a newspaper having general circulation in the County
in which the discharge occurred and the county immediately downstream. A sample public notice format is
also enclosed for your reference. If a discharge of 1,000,000 gallons of wastewater or more reaches surface
waters, the DWQ regional office must be contacted to determine in what additional counties, if any, a public
notice must be published. A copy of all public notices and proof of publication must be sent to the DWQ to
the attention of "NDCEU" at the letterhead address- within 30 days of publication. A sample public notice is
attached for your reference. The minimum content of the notice is the location of the discharge, estimated
volume, water body affected, steps taken to prevent future discharges and a phone number and contact name.
Annual Report
Another new requirement is that the owner or operator of any wastewater treatment works or
wastewater collection systems that treats or collects primarily domestic or municipal waste must provide an
annual report to its users or customers and to the Department of Environment and Natural Resources that
summarizes the treatment works' or collection system's performance over a 12 month period. The
following is provided as guidance to assist you in meeting this aspect.of the new reporting requirements.
The new law states the above mentioned report shall summarize the performance of the treatment
works or collection system and state the extent to which any terms of its permit, federal laws, or any State
laws, regulations or rules related to the protection of water quality have been violated. In order to meet the
spirit of this law, it is strongly suggested that, at a minimum, the report contain the following information:

Water Quality's Basinwide Management Plan and the NC Wetlands Restoration Program's
Watershed Restoration Plans? (Make page specific references to the plans, and explain how

Polk County Soil & Water Conservation District worked with the previous owner on a
voluntary basis and following BMPs was .able to impact and improve the water quality of
Walnut Creek from impaired to excellent in five years. A conservation easement on the -riparian
corridor and responsible upland use with protected riparian zones on the tributaries will
continue the improvement of Walnut Creek's water quality including the prevention of further
habitat degradation and sedimentation which are noted as significant water quality issues in the
project area. (Section A.4.2 p.54, A.4.2.1 p.54-55) Protection of a 600-foot corridor along
Walnut Creek will ensure -,that no further stream bank erosion or loss of riparian vegetation will
-occur. (Section A.4.2.2 p.57; A.4.2.5 p. 59)
7) What will be the measurable and enduring outcomes of the project? (0-20 points)
Wide riparian areas will provide sustainable improvement of habitat and will continue to
improve water quality of the receiving waters by reducing sedimentation. Appropriate
publicity, signage and educational tours'w_ ill increase public awareness of the key role CWMTF
has. in water quality protection.
8) Does the -project employ innovative procedures or technology? If -so, what are'the
implications for water quality? (0-5 points)
In addition to the project area it is currently'planned to protect an additional 1300 acres with a
working ;educational forest easement. The owner's innovation.in,designing such a
comprehensive plan will help assure the continued excellent rating of the water of Walnut
Creek and maximizes the benefit to both the public and the State.
k 9) Does the project establish functional riparian buffers or greenways?, If so, provide details
of buffer design and estimates of pollution reduction. , (0-20 points)
The project will widen existing functional riparian buffers. Currently, there -are harvestable
stands of timber located within 100 feet•6f Walnut Creek. The easement will prevent timber
harvesting which was the cause of the previous rating of impaired. Protecting the riparian
buffer will continue to reduce the sedimentation that currently impacts the receiving waters.
10) To what extent does the project provide public education uses? (0-5 points)
The project area will be open to the public on �a limited basis for educational purposes which
will include a demonstration -of responsible use pf upland areas. Walnut Creek contains rare
plant species of great interest to school groups and other conserv: tion organizations. A working
educational forest in connection with healthy, diverse stream ecology will provide. learning
opportunities for all.

owners' concept and plans. The Plant Conservation" Program already has <a project in Polk
County, with funding pending from the Natural Heritage Trust. A grant application for the
uplands portion of the tract to be submitted under the federal Forest Legacy.Program 2005 .
cycle is in the planning stages. All of these funding sources will be pursued. However, CWNITF
is the only possible source for protection of the riparian areas.

Property Name: Grassy Knob
As a land trust, The Pacolet Area Conservancy, Inc. is obligated to conduct a field visit
to each property annually to ensure .the properties are being used in accordance with
the guidelines mutually agreed upon in the Conservation Easement. In order to
ensure funds are available to provide for these visits "in perpetuity", -the Pacolet Area
Conservancy requests a contribution be made to the Stewardship fund where the
annual interest pays for annual inspections. Below is the formula used to estimate the

buffer lengths for each stream or waterbody. Walnut Creek 12,300 and the
„ main tributary 1,900. If the buffer will protect both sides of the creek, please
count the buffer length twice. 28, 400 lineal feet.

The entire tract is 1952 acres. 10% or 195.95 acres is within, 300 feet and is
the conservation easement area for which we are requesting funding.

project. Approximately 1500 acres of uplands will be slowly converted from a
h lo61olly pine plantation to:,a sustainable, mixed hardwood forest using,BMP's

forest in the buffer and pine plantation -in the upland.

The riparian buffer of this`grant request is the interior portion of the largest
undeveloped tract of land in Polk County. All other large tracts in the, area
.have been sold for, large up -scale residential development: This particular .
'parcel was targeted by a local developer for anew lake site; but the Grassy
Knob LLC outbid the'developer: The riparian area would have been suitable
`for timbering, farming and residential development, complete with the•scenic
waterfall in the southwest corner of the property.
16) Is this project part -of a larger planning project, such as a master.pfan? Briefly ;
outline any ongoing or previous efforts to protect land in or near the project area
for purposes: of water quality. Describe.. how these and possible future -efforts may

This project is an integral part of a larger, comprehensive plan to protect

Is the landowner willing to forego any of these activities? (i.e. farming; hunting
leases; timbering)
Currently; a private hunt club is leasing the tract. The landowner is willing
to forego whatever activity threatens the integrity of the conservation
easement in the eyes of CWMTF. Hikers and horseback riders currently
utilize the logging trails on the entire tract. The owners would Iike the trails
to remain open on a limited basis.
26) Do you have any other uses planned for the property (such as recreation,
education)? List all known and anticipated activities to be constructed or
developed on the Property or Easement Area (e.g., viewing platforms,
boardwalks, decks and piers, convenience facilities,. picnic tables, parking areas, ;
foot or vehicular bridges,' educational- facilities).
Current plans include a foot bridge to cross Walnut Creek for the purpose of '
educational groups to be able to access important plant�groupings on. both
sides. of the creek.

suitable co -investors. The initial bid was rejected, as were all other bids. Negotiations continued
and in -September 2003 Grassy Knob Lands LLC reached agreement with International Paper on
a contract to purchase the Grassy Knob Tract at the list price of $3,787,000. with the closing
scheduled for December 17, 2003. `
The Land
The Grassy Knob Tract is composed of thirteen parcels varying from one half acre to
over 500 acres. All parcels that are outside of the proposed protected watershed areas have been
planted in Loblolly pine plantations dating from the mid 1970's to the mid 1990's. The largest
segment was planted in 1986 after a fire. The elevations of the tract vary from 880 feet to 1240
feet. There are multiple streambeds that begin on the property and two that begin outside the
property and flow through it from north or west, all merging into Walnut Creek that flows out to
the southeast and merges into the Green River. There is a small, waterfall in the southwest corner
of the property. There are many outstanding panoramic views of the Wild Cat Spur range and of
Chimney Rock to the west'as well as of Tryon Peals -to the south and Bill's'Mountain to the
north. This tract is the last undeveloped tract of its. size in Polk. County, now that the 4500-acre
Deep Gap, tract nearby has been purchased for approximately $18M. The Deep Gap development
plan calls for 1200 high -end home sites and one if not two golf courses.- The Grassy Knob Tract
is in an area of Polk County that is currently subject to no zoning laws.
Grassy Knob Lands LLC and -its principal(s)
Bob Strickland is the titled owner of 94 acres adjoining project tract. Bob is a former
aerospace engineer who bought the land -("Serenity Farm") in February 1992 and who has been
working the land as an organic grower for more -than 5 years. Bob's wife, Barbara (Babs), is a
corporate attorney who left her private practice in 1998 but continues to work as Corporate

Water Quality Objectives
In 1999 Walnut Creek was listed as Support Threatened; in 2002 Walnut Creek was
upgraded to Supporting with sedimentation and habitat degradation still an issue. The probable
cause for improved water quality on Walnut Creek from 1999-2002 is the cessation of upland
logging activities. Grassy Knob Lands LLC's principal Barbara Suddath Strickland wants to
widen and protect the riparian areas through the CWMTF conservation easement and slowly
convert the appropriate upland areas to a sustainable educational forest which will further help
the water quality of Walnut Creek.
Total Project Funds
Grassy Knob Lands LLC will pay $3,787,000 for the entire 1952- acre,tract. The total
cost to CWMTF for the purchase .of the riparian area easement is $366,477 which is loss than

1/10 of the total project cost and will provide a vital starting point for the protection of another
1300 acres of the 1952-9cre tract.
Other Possible Funding Sources,
,- Many funding -sources have'been explored. Only one application has been submitted to
date. (to EEP). EEP. is..focusing .on projects contiguous with other preserved lands and .the strict
parameters of ESP's guidelines do not allow for agricultural upland management. Therefore
EEP �is not considering this project." The Wildlife Commission would like to have the entire
1952-acre tract, but they are looking for lands contiguous to other game lands, and this.tract does
not adjoin lands already owned by the State. NCDENR is not interested in managing any more

educational forests in this part of the state, although they are very supportive of the owners'
concept and plans. The Plant Conservation Program already has a project in Polk County, with
funding pending from the Natural Heritage Trust. A grant application is in the planning stages

General Statutes of North Carolina as amended, and other applicable
Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO
SUNNYVIEW CAR WASH
FOR THE
operation of a 720 GPD septic tank ground absorption wastewater
treatment system to serve Sunnyview Car Wash in Polk County, N.C.;
and pursuant to the application received on February 8, 1991, and in
conformity with the project plans, specifications, and other
supporting data, subsequently filed with the Department of
Environment, Health, and Natural Resources and considered a part of
this Permit.
This Permit shall be effective from the date of its issuance
until rescinded, and shall be subject to the following specified
conditions and limitations:
1. Flow limiting devices shall be used on all facilities
. at the Sunnyview Car Wash .
2. This -Permit is effective only with respect to the
nature and volume of wastes described in the
application and other supporting data.
3. This Permit shall become voidable in event of failure
of the soil to adequately absorb the wastes, and may
be rescinded unless the facilities are installed,
maintained, and operated in a manner which will protect
the assigned water quality standards of the surface
and ground waters.
4. This facility shall not discharge directly to the surface
waters of the State.

5. In the event the facilities fail to perform satis-
factorily, the owners shall take such immediate
corrective action as may be required by this Depart-
ment.
6. This Permit is not transferable.
7. The method for final disposal of screenings, scum,
and sludges from these facilities shall not result
in any contamination of the surface or ground waters
of this State.
8. This disposal system shall be abandoned immediately
upon the availability of a regional sewer system.
9. Any monitoring deemed necessary by the Division of
Environmental Management to insure -the protection of
ground waters will be established and an acceptable
sampling and reporting program shall be followed.
10. The approved nitrification field site must not be
disturbed, regraded, or substituted without written
permission from the Asheville Regional Supervisor.
11. The cleaning of engines is prohibited. Appropriate signs
shall be posted at the car wash advising patrons that
engines shall not be cleaned.
12. Oil drained from engine crankcases, antifreeze or
degreasing solvent wastes shall not be discharged into the
disposal system.

Dear Permittee:
The Division of Environmental Management issued the subject permit on
2/11/91 for the construction and/or operation of a subsurface wastewater
treatment and disposal system. This Division processed a nondischarge
permit under the jurisdiction of North Carolina General Statutes
143-215.1 and 130A-335 and North Carolina Administrative Code Section 15%
NCAC 2H .0200; "Waste Not Discharged to Surface Waters" which was issued
until rescinded.
On July 14, 1992, House Bill 1545 was ratified in the North Carolina
General Assembly which transferred the authority for the plan review,
permit issuance and compliance monitoring of most Environmental
Management Commission subsurface wastewater treatment and disposal
systems, whose staff body is the Division of Environmental Management, to
the Commission for Health Services through the local health departments
and the Division of Environmental Health. Under this new authority, the
nondischarge permit for the wastewater treatment and disposal system
under Permit No WQ0004700 is now under the jurisdiction of the POLK
County Health Department and the Division of Environmental Health. Under
this new authority, any renewal requests, or requests for modifications,
upgrades or repairs of this system will now be reviewed and processed by
the POLK County Health Department.

Proposed Sunnyview Car Wash
Polk County
On January 4, 1991 met with Mr. Bud Pace to discuss a
proposed two bay wand type car wash to be built on his property
in the Sunnyview Community of Polk County. Soil conditions on
the site were evaluated by placing a boring four feet deep in
the area of the proposed ground absorption system. The soils
consisted of a silty clay loam throughout the .four feet. No
rock or ground water was detected. The soils are suitable for a
ground absorption system. The area to the North of the site
which have been filled should be avoided. The recommended area
of the proposed drain field would be at the toe of the slope to
the Southern edge of the site.
It was recommended that the car wash be served -by utilising'
grit and oil traps in the bays followed by one or two septic
tanks.` A drain field consisting of 4 (3 x 75 ft.) drain lines
is proposed with a 0.8 GPD/SF loading rate. This design and
application rate is more than adequate.
In discussing the project with Mr. Don Link of the Ground
Water Section he recommended including special conditions in the
permit preventing the use of solvents and standard`conditions
which would require ground water monitoring in the future if
deemed necessary. The.permit will be'drafted with .these
conditions.
.It is recommended that the permit be issued for this
project.

On February 12, 1991 I investigated the soils of property
owned by Mr. Bud Pace to be used to dispose of wastewater from a
car wash using a septic tank filter field.
The area is a toe slope of an intermountain hill. The
property had been cut and filled to level it. The portion of
the property where the filter field is to be located is a 75 x
30 foot rectangle. The edge closest to the cut slope has less
than one foot of fill dirt on it. The soil under the fill is a
truncated soil profile consisting of the horizons just above the
saprolite, (see profile description *1). The side of the
rectangle closest to the cut is provisionally suitable.
The side of the rectangle closest to the fill slope has 2
to 4 feet of fill dirt over a buried but intact profile, (see
profile description #2). This side of the rectangle is suitable
if the bottom of the trench is installed in the topsoil of the
buried natural soil profile.
The flagging that marked the 75 x 30 foot rectangle was
moved 10 feet toward the fill slope so that the trench bottom
closest to the cut slope would not be in saprolite.
