Division of Water Resources Mooresville Regional Office 610 East Center Avenue, Suite 301 Mooresville, NC 28115 Sent by email: alanjohnson@ncdenr.gov ECT Project No. 180477 RE: Water Quality Certification Modification (DWR# 19-0460) Stanly Solar Development, Stanly County, North Carolina Dear Mr. Johnson: Environmental Consulting & Technology of North Carolina, PLLC (ECT) was contracted by Stanly Solar, LLC (the Client) to submit this modification request for Water Quality Certification (WQC) for the Stanly Solar Development (Project) located at 35.28975°, - 80.23723° (Attachment A). The Project is located on 336 acres in Stanly County, North Carolina and was initially permitted for three stream crossings. USACE issued Nationwide Permit (NWP) authorization for the original site design under NWP 14 on November 19, 2019 (SAW-2019-00558), and NC Division of Water Resources (DWR) issued WQC on June 4, 2019 (DWR# 19-0460). Because of topography challenges, the Client revised the access road layout and reduced the stream crossings to one 135-foot crossing. The existing access road in northern portions of the site will only be used for array areas north of Stream 7. A new access road constructed entirely in upland will access the array area between Streams 7 and 10. A second new access road at the southern limits of the site is proposed to cross Stream 12 to provide access to the array area between Streams 12/ 11 and Stream 10. The small array area east of Stream 12 has been abandoned. The proposed crossing of Stream 12 will require 135 linear feet (0.003 acre) of permanent impacts to that will include approximately 105 linear feet of channel that will be straightened and culverted and 30 linear feet of channel on either end of the culvert that will be stabilized with riprap. The steep topography of the area required increased grading to allow for a safe crossing for large equipment. ECT is coordinating simultaneously with the USACE for NWP authorization. ECT submitted the required DWR Pre -Filing Meeting Request Form on December 6, 2020. We have also compiled the revised impacts and site plan (Attachment A) for your review. The revised site plan is included in Attachment A and revised impact estimates are in Table 1 below.
