Skvarla, III Secretary This letter is a follow up to our conversation on October I7th regarding the residuals discovered at the City of Morganton's Wastewater Treatment facility. The Division's primary concern is in regard to stabilization of the slope underlain by residual material. Please move forward with stabilization activities as needed and provide the Division a brief narrative of those activities. Subsequently, in order to fully evaluate the residuals, it is important to have some understanding of the volume and composition of the material. The Division recommends conducting some limited assessment activities to approximate the residuals volume. A TCLP analysis should be conducted on the residuals of a representative number of samples. We will make additional recommendations depending on the results of the analyses and estimation of the volume of the material. Please submit a copy of your findings to the Asheville Regional Office. Landon Davidson, Regional Supervisor Water Quality Regional Operations, NCDENR-ARO 2090 US Highway 70 Swannanoa, NC 28778 Subject: Notice of Violation: NOV-2015-PC-0117 Dear Mr. Davidson, I have reviewed the permit violations within in our 2014 Annual Composting Report. It was noted that on 2/6/2414 there was a violation for Fecal Coliform Bacteria from a reported value of 20,806 MPN. After reviewing and discussing this with staff, it was determined that the 2/6/2014 sample for Fecal Coliform was for informational purposes only required by the Caldwell County landfill. The material sampled was used as a bulking agent for digester sludge removed and disposed of during construction. This compost material was not sold or distributed. Also, no new compost was available for sampling in the I" quarter of 2014. All compost sold during this time was from compost beds containing material processed and released in the 4th quarter of 2013. However, the ISt quarter distribution tracking log does not indicate that the material sold was from beds containing compost prepared in 4th quarter 2013. This was a record keeping error and has been addressed. Moving forward, each load of compost that is being sold will be easily identified according to the bed that it comes from. The other violation noted was on sampling date 4/1/2014 that showed Arsenic at a reported value of 65 mg/kg. This was resampled on 5/14/14 and a result of <1.3 mg/kg was obtained. This lab result was omitted in error. A copy of this lab result is attached. I have instructed plant staff to scrutinize and review lab data more closely as they are received. Telephone 828-437-8863 305 East Union St. Post Office Box 3448 www.ci.morganton.ne.us Morganton, NC 28655 Morganton, NC 28680-3448 There were 3 data items you wanted us to clarify or re -submit. 1) For the 7/10/14 sampling event for selenium, the one from Statesville Analytical at 136 mg/kg was a result from lab error. The re -test of this sample showed 0.2 mg/kg. These results were entered and submitted in error. The split sample from Blue Ridge labs used for confirmation showed <2.7 mg/kg. All data from Blue Ridge Labs was used for this sampling date and was included in the 2014 report. 2) There was no sampling performed on 7/29/14. This was a data entry error on the residual sampling summary form. This should have been 7/10/14. This has been corrected and a copy attached. 3) A re -submitted Annual Residual Sampling Summary Form is attached. It reflects data for the 7/10/14 sampling event from Blue Ridge Labs only. The original form included data averages from Statesville Analytical and Blue Ridge Labs. Blue Ridge Labs data should have only been used as it was for confirmation. All of these data sheets from Blue Ridge Labs, including the one containing the Zinc result, were submitted with the original Annual Report. It is evident that the plant staff are very experienced in the operation of the composting facility but show inexperience with compiling data and reporting. I believe they attempted to give a good report but provided too much information that made it very confusing. My apologies. I hope this helps clarify any concerns over the compliance and reporting requirements of our facility. I would respectfully request some technical assistance and to discuss overall compliance of this composting facility and distribution program prior to submitting our next report.
