In order to meet Condition Nos. 6 and 7 of the 401 Certification for this project, a stormwatef:

This stormwater management plan for Phase 2B of the Caterpillar Access Road project has been,-,,, : ,
reviewed and satisfies the stormwater management conditions of the 401 Water Quality Certification.
You are required to meet the following conditions:
The stormwater management system (consisting of three permanent sediment basins to serve
Phase 2B and all associated sediment and erosion control devices including check dams, scour
holes, vegetated filters, and level spreaders), all stormwater conveyances and the grading and
drainage patterns depicted on the plans, as approved by this office must be maintained in
perpetuity. No changes to the structural stormwater practices shall be made without written
authorization from the DWQ. The stormwater management structures shall have maintenance
access to allow for the ability to maintain the structures, and to perform corrective actions. The
stormwater easements shall be recorded to provide protection of the structures from potential
alterations by future property owners.
2. All operation and maintenance activities shall be followed as stipulated in the Operation and
Maintenance Agreement signed and notarized on November 5, 2010, and received in our office
on November 10, 2010.

3. The applicant and/or authorized agent shall provide a completed Certification of Completion
Form to the DWQ 401 Program within ten (10) days of the project completion (available at:
http://portal.ncdeiu.or web/wq/swp/ws/401/certsandpennits/appl /f?onns).
This letter completes the review of the DWQ under Section 401 of the Clean Water Act. If you have any
