On May 21, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification; to:'.: " impact 192 linear feet of perennial stream, 15,004 square feet of Zone 1 Neuse River basin }prot.&cted., riparian buffers and 9,770 square feet of Zone 2 Neuse River basin protected riparian, buffers, In order to meet Condition Nos. 6 and 7 of the 401 Certification for this project, a stormwatef: management plan for Phase 213, dated November 29, 2010 was received by the DWQ on November. 29, 2010. The signed and notarized Operation and Maintenance Agreement for the entire Caterpillar _ i Access Road project was received on November 10, 2010. This stormwater management plan for Phase 2B of the Caterpillar Access Road project has been,-,,, : , reviewed and satisfies the stormwater management conditions of the 401 Water Quality Certification. You are required to meet the following conditions: The stormwater management system (consisting of three permanent sediment basins to serve Phase 2B and all associated sediment and erosion control devices including check dams, scour holes, vegetated filters, and level spreaders), all stormwater conveyances and the grading and drainage patterns depicted on the plans, as approved by this office must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. The stormwater management structures shall have maintenance access to allow for the ability to maintain the structures, and to perform corrective actions. The stormwater easements shall be recorded to provide protection of the structures from potential alterations by future property owners. 2.
