Barnett Properties LLC &Wilco-Hess LLC 04. a Request for 401 WQC Modification Al ?4tOc % Dear Ian: 11* Cy In 2007, Barnett Properties, LLC and Wilco-Hess, LLC obtained 404/401 permits for the Surf City Market project located at the intersection of Highways 17 and 210 in Pender County. These permits expire on December 31, 2010. We formally request that the IP be modified and the expiration date extended for two more years. Additional time to complete the project is needed because the anchor tenant of this development has postponed construction in the region due to the slow economy. This has delayed the overall project. No work has begun on this site and no changes to the site plan that was previously authorized are proposed. However, we request that the project be divided into two phases of development and that two permit conditions be modified to reflect this phasing. Permit Condition #8. This condition required the applicants to make a payment into the NC EEP to mitigate for 4.61 acres of wetland impact within 60 days of permit issuance. This has not yet occurred due to the delay of the project. We request that this condition be modified to require payment prior to wetland impacts and in phases that correspond to phases of development. Phase 1 will impact 0.55 acre of wetlands and Phase 2 will impact 4.06 acres of wetlands (please see attached map). Permit Condition #9. This condition required that a stormwater plan be submitted to DWQ within 60 days of permit issuance. Because the project has been delayed, a stormwater plan has not yet been developed. The applicants anticipate having a stormwater plan for Phase 1 prepared by March 1St, 2011. A specific time line for Phase 2 is still undetermined; however no wetland impacts will occur until a stormwater permit is obtained.
