Dear Mr. Hopper:
Froehling & Robertson, Inc. (F&R) is submitting this Pre -Construction Notification (PCN) to the
US Army Corps of Engineers (USACE) for written concurrence for allowable impacts to "Waters
of the United States." F&R is also sending a copy to the North Carolina Division of Water
Resources (NCDWR). F&R has been contracted by CJS, Inc. to perform wetland consulting
services for the above -referenced project site located in the Town of Wilson's Mills in Johnston
County, North Carolina and within the Neuse River Basin.
The site currently consists of paved roadway and associated road shoulder and Right -of -Way
(ROW). Much of the roadway traverses agricultural lands, with the occasional neighborhood
entrance and rural driveway.
The impacts to Waters of the United States for this project, as proposed, will be:
• A total of 0.0 acres of permanent and 0.01 acre of temporary wetland impacts that do
not require mitigation
• A total of 0.0 acres of permanent and 0.03 acre of temporary stream impacts that do
not require mitigation
• Riparian buffer impacts include a total of 5,136 sq ft of temporary impacts in Zone 1 and
4,086 sq ft of temporary impacts to Zone 2.

PURPOSE AND NEED
The Buffalo Water District - Buffalo Road Booster Pump Station Upgrade and Transmission Main
project is necessary to enable the shifting of the Wilders Township area into the 492
Chloramine Pressure Zone with direct water supply from Johnston County's Timothy G. Broome
Water Treatment Plant (WTP), while maintaining acceptable pressures in this pressure zone.
The project includes the construction of approximately 28,000 LF of 24-inch transmission main
along Buffalo Road, starting at the connection with the transmission main from the WTP just
north of Buffalo Creek, extending northward to Highway NC 42. The project will also include the
upgrade of the existing Buffalo Road Booster Pump Station to provide a firm pumping capacity
of 6.5 MGD. The booster pump station and transmission main will convey water supplied from
the WTP, north toward the Archer's Lodge Water District and 492 Chloramine Pressure Zone.
This station upgrade is necessary to allow for adequate pressures in the pressure zone and
meet the growing water demands and fire flow demands. Because the proposed work is for a
water line utility, the project can be verified under NWP 12. This Purpose and Need statement
provides general project information and a description of the design aspects utilized to reduce
and eliminate wetland and stream impacts to the maximum extent practicable.
The project site is located along the right-of-way of Buffalo Road, almost entirely on the West
side of the road, from NC-42 south to Live Oak Church Road in Johnston County, North Carolina.
The review area consists primarily of existing maintained public right-of-way (ROW), driveways,
roadside swales, some wooded areas as well as maintained lawns.
A Jurisdictional Determination (JD) for the Buffalo Road Booster Pump Station Upgrade review
area was submitted to the ACOE November 30th, 2020 and has been assigned SAW-2020-02119.
The wetland and stream delineation efforts resulted in the identification of one wetland and
four streams within the assessment area. These features are mapped on the wetland impact
maps included.

AVOIDANCE AND MINIMIZATION
The design of the water transmission main incorporates several measures to help reduce the
potential wetland/stream/buffer impacts. The water main has been designed with the intention
of maintaining the limits of disturbance within the existing public road right-of-way as much as
possible to avoid wetland and stream impacts to the maximum extent practicable. Fortunately,
Buffalo Road is situated along a ridge and most jurisdictional features are located in lower lying
areas outside of the road right-of-way. There are a limited number of streams and wetland
areas that cannot be avoided. The transmission main begins on the north side of Buffalo Creek
where it crosses Buffalo Road and the main continues north, avoiding direct impacts to Buffalo
Creek. In some locations, the water main must be installed outside the right-of-way to avoid
overlap with existing utilities such as fiber optic conduit and cable or to avoid excessive
installation depths under existing storm drainage culverts/pipes. The required easement area
outside the right-of-way in these instances is minimized by using pipe fittings to go in and out of
the right-of-way in a short span. Where construction within the right-of-way limits allows,
water mains are installed beneath storm drainage pipes to minimize impact to stream channels
and buffers. These planning and design measures above have been undertaken to effectively
reduce the amount of wetland and stream impacts to the greatest extent practicable in
compliance with the general and regional requirements of NWP 12.
Project construction will result in 0.01 acre of temporary wetland impacts and 0.0 acres of
permanent wetland impacts. Project construction will additionally result in 1,097 sq feet of
temporary fill as the pipeline crosses four perennial streams. No mitigation is required for these
impacts as they are below the 1/10 acre threshold required for mitigation under NWP 12.
LISTED SPECIES
The US Fish and Wildlife Service's iPaC results include eight species of interest. The species are
listed below.
• Red -cockaded Woodpecker (Picoides borealis)
• Neuse River Waterdog (Necturus lewisi)
• Carolina Madtom (Noturus furiosus)
• Atlantic Pigtoe (Fusconaia masoni)
• Dwarf Wedgemussel (Alasmidonta heterodon)
• Yellow Lance (Elliptio lanceolata)

• Michaux's Sumac (Rhus michauxii)
The Red -Cockaded Woodpecker (RCW) inhabits old growth stands of longleaf pine (Pinus
palustrus). There are no stands of appropriate habitat in or adjacent to the assessment area so
the RCW is not expected to be present or adversely affected by the project. The Carolina
Madtom as well as the mussel species Atlantic Pigtoe, Dwarf Wedgemussel, Tar River Spiny
Mussel, and Yellow Lance inhabit well oxygenated, higher quality streams with continuous flow
and are not anticipated to utilize the first order agricultural streams crossing the corridor for
this project. Although perennial, the streams in the corridor appear to often be stagnant, with
intermittent, flashy flows, fine sediment deposition, and relatively low apparent dissolved
oxygen. These conditions are not conducive to the habitat needs of the mussel species of
interest. Additionally, the stream impacts for the project as proposed are minimal and do not
require mitigation. With regard to Michaux's Sumac, a portion of the site includes maintained
ROW and agricultural land, which are potential habitat for this species. A pedestrian survey of
the areas within the assessment area with potential habitat did not result in any observation of
Michaux's Sumac; therefore, the project is unlikely to adversely affect this species.
In summary, the proposed utility enhancement project is respectfully submitted for your review

To Whom It May Concern:
The species list generated pursuant to the information you provided identifies threatened,
endangered, proposed and candidate species, as well as proposed and final designated critical
habitat, that may occur within the boundary of your proposed project and/or may be affected by
your proposed project. The species list fulfills the requirements of the U.S. Fish and Wildlife
Service (Service) under section 7(c) of the Endangered Species Act (Act) of 1973, as amended
(16 U.S.C. 1531 et seq.).
New information based on updated surveys, changes in the abundance and distribution of
species, changed habitat conditions, or other factors could change this list. Please feel free to
contact us if you need more current information or assistance regarding the potential impacts to
federally proposed, listed, and candidate species and federally designated and proposed critical
habitat. Please note that under 50 CFR 402.12(e) of the regulations implementing section 7 of the
Act, the accuracy of this species list should be verified after 90 days. This verification can be
completed formally or informally as desired. The Service recommends that verification be
completed by visiting the ECOS-IPaC website at regular intervals during project planning and
implementation for updates to species lists and information. An updated list may be requested
through the ECOS-IPaC system by completing the same process used to receive the enclosed list.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally -listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally -protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or

evaluation and can be found on our web page at http://www.fws.gov/raleigh. Please check the
web site often for updated information or changes
If your project contains suitable habitat for any of the federally -listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally -protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and
bats.

towers (e.g., cellular, digital television, radio, and emergency broadcast) can be found at: http://

Not all Threatened and Endangered Species that occur in North Carolina are subject to section 7
consultation with the U.S Fish and Wildlife Service. Atlantic and shortnose sturgeon, sea
turtles,when in the water, and certain marine mammals are under purview of the National Marine
Fisheries Service. If your project occurs in marine, estuarine, or coastal river systems you should
also contact the National Marine Fisheries Service, http://www.nmfs.noaa.gov/

Federal agencies to include conservation of threatened and endangered species into their project

Re: Archaeological Reconnaissance of the Proposed Buffalo Road Water Main and Booster Pump
Station Upgrade, Johnston County, ER 20-0384
Dear Ms. Reid:
Thank you for your May 21, 2020, submission of the archaeological report and site forms for the above -
referenced undertaking. We have reviewed the report and offer the following comments.
Two newly recorded archaeological sites (31JT628 and 31JT629) and one historic cemetery (31JT627)
were identified and documented by the survey. Given their poor integrity and research potential, the two
archaeological sites are not considered eligible for listing in the National Register of Historic Places. No
areas likely to contain sites eligible for the National Register were identified during the reconnaissance
survey, and no further archaeological work is recommended in the project area. We concur with these
recommendations.
The Henry Cemetery (31JT627) is protected under North Carolina General Statutes (NCGS) Chapter 14-
148 and 149 and afforded consideration under NCGS Chapters 65 and 70. Please provide final project
designs showing how the cemetery will be avoided, and a description of measures that will be taken to
ensure the cemetery will not be subject to ground disturbance during construction.
We note that the artifacts identified as a result of this survey were returned to the respective property
owners. North Carolina Office of State Archaeology (OSA) Standards and Guidelines
(https:Hfiles.nc.gov/dncr-arch/OSA—Guidelines—Dec2Ol7.pdf) state that:
All materials — including artifacts, floral and faunal remains, and sediment samples, along with related
documentation such as original field notes, maps, photographs, artifact inventory lists, and analysis forms —
recovered and created for purposes of compliance with state and federal regulations shall be permanently
curated in an approved archaeological repository, preferably in the state of North Carolina. (OSA
Guidelines p. 19)

These guidelines are intended to allow for transparency of process, access to materials by future

• Dates on and methods by which property owners were contacted regarding artifact curation
• Original image files of all artifacts, in native file format and size, organized by site number
• Original field notes for all sites, or scans at a resolution no less than 400 dpi, organized by site
number
Please submit this information on CD-R or DVD-R disks, with CD-R Archival Gold or DVD-R Archival
Gold disks preferred. Disks should be labeled directly using either CD -safe markers or a laser -printer, with
laser -printing preferred. Adhesive labels should not be placed on CDs. Disks should be labeled with the
following information:
• name of the submitting party,
• the environmental review number,
• range of site numbers to which the associated data pertain, and
• the date data was transferred to CD (month/year).
Discs should be stored in acid -free paper sleeves labeled with the same information written or printed on
the CD.

Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36
